                                         DECREE
The plaintiffs have  filed this suit against the defendant
praying as follows; 
a)  for a decree in eviction against the Defendant in respect of the
suit premises viz. Flat No.8, Narayani Building, Plot No. 20/7,
Rafi   Ahmed   Kidwai   Road,   Wadala,   Mubmai   400   031
admeasuring   74.35   sq.meters   (carpet   area),   directing   the
Defendant   to   quit,   vacate   and   hand   over   quiet,   vacant   and
peaceful possession of the suit premises to the plaintiffs;
b)         For   a  temporary   order   and  injunction   of   this   Hon'ble   court,
pending   the   hearing   and   final   disposal   of   the   present   suit,
restraining the Defendant from inducting any person in the  suit
premises or parting with possession of the suit premises   viz.
Flat No.8, Narayani Building, Plot No. 20/7, Rafi Ahmed Kidwai
Road, Wadala, Mubmai 400 031 in any manner whatsoever;
c)     for interim and ad­interim reliefs in terms of prayer (b) above; 
d)     for costs of and incidental to this suit; 
 e)     for   such     other   and     further   reliefs   as   the   nature   and
circumstances of the case may require.
            This suit came on board on  01 st November, 2017, for
hearing   and     final   disposal   before   Ld.Judge   Shri.   P.   G.
Deshmukh   presiding   in   C.R.No.9.  Shri.   N.   D.   Jaywant
Advocate   for   plaintiffs   and  Amul   Jawale   Advocate   for
defendants

                        ORDER 
          Perused the Mediator's report Exh 10.  Both the parties are
present   before   the   Court.     They   have   admitted   the   contents     of
Consent   Terms   Exh.   11.   Plaintiffs   have   accepted   defendant   as   a
tenant of suit property.   Other legal heir of original tenant namely
Mamta Rajesh Parikh has surrendered her right of tenancy in favour
of defendant. Supporting  affidavit of the said person Mamta Parikh is
also   filed   along   with   consent   terms.     Plaintiff   Nos.   1   and   3   have
executed   power   of   attorney   in   favour   of   plaintiff   No.2.     Both   the
parties have admitted the contents of Consent terms Exh 11.  Hence, I
pass the following order.              
ORDER                                          
               a)   Suit is disposed off in view of Consent Terms Exh. 11.
                 b)   Consent  Decree be drawn up accordingly.
