ROAD USAGE AND

DEVELOPMENT GUIDELINES

SECTION 1: INTRODUCTION -- ENTERTAINMENT CITY AND ENTERTAINMENT CITY
ESTATE MANAGEMENT INC. (ECEMI)

1.1 Entertainment City

Entertainment City (also known as PAGCOR Entertainment City) is a PAGCOR-initiated


development where privately owned integrated resorts consisting of hotels and
entertainment and gaming facilities are/will be constructed to form what is envisioned as a
Macau/Las Vegas-like gaming and entertainment complex. It lies on an 8 km² area of
reclaimed land in Parañaque City. Entertainment City has direct access to and from the
airport terminals through the elevated NAIA Expressway (hereafter, “NAIA-X”).

Entertainment City is the location of the Integrated Resorts of the following PAGCOR
Licensees (or “Licensees”):

a. Solaire Resorts and Casino Manila (Bloomberry Resorts and Hotels, Inc.)
b. Okada Manila (Tiger Resort, Leisure and Entertainment, Inc.)
c. Resorts World West Side (Travellers International Hotel Group, Inc.)

A fourth PAGCOR Licensee, City of Dreams Manila (MCE Leisure (Philippines)


Corporation/SM Consortium), is located just outside the Entertainment City geographical
boundary.

Other entities and/or establishments are also located within the Entertainment City in
addition to PAGCOR Licensees.

1.2 Entertainment City Estate Management Inc. (ECEMI)

1.2.1 On 19 July 2012, the ECEMI was incorporated for these primary purpose/s:

1.2.1.1 To promote the general welfare, property, service and reputation of the
Entertainment City and such additional or contiguous areas which in the
future may apply for and be accepted by the governing board of the
Corporation as members thereof or as included in its jurisdiction; and,

1.2.1.2 To promote the best interest and well-being, as well as safeguard the welfare
of the licensees, locators, sub-locators, lessees, sub-lessees, concessionaires
and occupants of the Entertainment City and such additional or contiguous
areas which in the future may apply for and be accepted by the governing
body of the Corporation as members thereof or as included in its jurisdiction.

1.2.2 Consistent with said primary purposes, ECEMI has the responsibility of managing,
maintaining and operating the paved roads, bridge and utilities of Entertainment
City for the common interest and well-being of the Entertainment City and its
licensees.

1.2.2.1 Entertainment City has more than 2,000 meters of well paved roads and a
bridge crossing the inland water channel that dissects the property. All
utilities such as water, drainage, power and communication are buried
underground in compliance with Boulevard 2000 Integrated Framework
Plan.

1.2.3 Pursuant to the Memorandum of Agreement dated August 8, 2018 executed by and
between ECEMI and the Philippine Amusement and Gaming Corporation
(PAGCOR), ECEMI has been authorized by PAGCOR to improve, manage, maintain
and control the common infrastructure inside PAGCOR Entertainment City, which
includes the maintenance and development of Entertainment City’s Road Network as
defined in these guidelines.

SECTION 2: ROAD NETWORK

2.1 Road Specifications and Cross Sections

2.1.1 The road network of Entertainment City is privately owned by PAGCOR but is open
to the public all the time. It is pedestrian-friendly and adequately landscaped. The
road network has its own characteristics defined by its function, width, vehicular
capacity, and other related attributes.

2.1.2 There are two major roads traversing within and connecting Entertainment City to
the nearby destinations, namely;

a. JW Diokno Boulevard Extension (formerly known as Bay Boulevard)


This is a road that runs parallel to Macapagal Boulevard.

b. New Seaside Drive


This is a road that connects to the on/off ramps of the elevated NAIA
Expressway and to Macapagal Boulevard.

2.1.3 The Common Service Road has a twelve (12) meter right of way that serves as an
access to the utility buildings of MERALCO, MAYNILAD, and a property to be
developed by Travellers International Hotel Group in partnership with PAGCOR.

2.2 Right of Way Dimensions

2.2.1 ECEMI has an assignable right-of-way over the road network inside the
Entertainment City. It may create an access to and from the adjacent properties of
the Licensees or other establishments and/or entities within the Entertainment City.

2.3 Traffic Regulations

2.3.1 The road caters primarily to light vehicles. It can also accommodate delivery vans
and trucks servicing the Licensees or other entities and/or establishments located
within the Entertainment City.

2.3.2 Pedestrian crossings are placed on intersections and near the Rotunda located along JW
Diokno Extension.

2.3.3 The speed limit for motorists is set at 40kph, while the load limit of the bridge is
placed at 20 tons.

2.3.4 All roads are No Parking areas. All vehicles must be parked in their designated
parking areas. Illegally parked vehicles will be towed and will be charged a
fee/recovery charge.

2.3.4.1. In case a major event happens or is conducted in any of the establishments of


the Licensees or other ECEMI members and extra parking is needed, prior
coordination with ECEMI is required if the Licensee or establishment wishes
to utilize the road as additional parking. In such cases, the parking fees
indicated in ____ apply.

2.3.5 The public shall be made aware that excessive speed, road or drag racing, and other
traffic violations are strictly prohibited. Vehicular traffic rules and regulations shall
be applied and enforced by government accredited security/ traffic personnel of
ECEMI.

SECTION 3: DEVELOPMENT AND CONSTRUCTION

3.1 General

3.1.1 Although ECEMI’s jurisdiction is limited to the Road Right Of Way (RROW)
mentioned in the foregoing section, it is essential that road safety, cleanliness, and
orderliness within the entire Entertainment City be maintained at all times. Thus the
Licensees, other ECEMI members, developers, contractors, and the public will be
encouraged to cooperate fully to achieve this goal.

3.2 Site Logistics

3.2.1 Within the RROW of Entertainment City, there are road furniture such as traffic
lights, street lights, road signages, and others that are directly under the
responsibility of the ECEMI. Incurred damages to these devices and materials shall
be chargeable to the party(ies) involved.

3.2.2 Beyond the RROW of Entertainment City, it will be the responsibility of Licensees,
other ECEMI members, developers, and contractors to maintain the area in a clean
and orderly manner. Each of the ECEMI members, developers, and contractors will
provide a logistical plan describing the overall site facilities and services that they
will establish and the operational strategy that will be followed ensuring that their
construction works proceed smoothly and safely, with a minimum impact on the
surrounding areas.

3.2.3 In order to avoid traffic congestion, there is a need to inform ECEMI regarding the
access of construction vehicles to the construction sites. There is also a need to avoid
certain access routes within Entertainment City. A Construction Vehicle Pass will be
required for construction vehicles that will be used for delivery, services, and other
purposes. Only vehicles with the Construction Vehicle Pass will be permitted to the
site.

3.2.4 It is the responsibility of the ECEMI members, developers, and contractors to provide
their own necessary control and guidance procedures/guidelines for their respective
visitors and/or guests to their work site to ensure their protection. If necessary, safety
gear must be provided for use of their visitors/guests while on site.

3.2.5 The ECEMI members, developers, and contractors must submit in advance on a
weekly basis their anticipated deliveries of materials and equipment. Deliveries not
indicated in the anticipated schedule of deliveries may be denied access to the site,
unless permission for access is being requested by ECEMI members, developers, and
contractors, which ECEMI shall approve not later than twenty-four (24) hours from
such request. Deliveries of abnormal loads such as heavy and long construction
equipment and others must be included and highlighted in the schedule within a
minimum of forty eight (48) hours in advance of such delivery. The concerned
ECEMI member, developer, or contractor must coordinate closely with ECEMI
regarding the access routes to the site location. Delivery of this equipment must not
interfere with the normal vehicular traffic flow/condition of the road.

3.2.5 Developers/contractors shall ensure that their vehicles, especially the wheels, are
clean before proceeding onto the roads. Wash bays must be provided and be located
within their property. The developers, suppliers, and contractors will be responsible
for cleaning of debris, mud, concrete laitance, and other matter left by their vehicle on
the road, which may result in inconvenience and pose a hazard to motorists. Failure
to do so will result in fines and penalties.

3.2.6 The ECEMI members, developers, and contractors must provide temporary protection
for all construction and installations, whether or not completed outside their property
or protected easements as required – in order to maintain existing works, services,
connections, and finished works in an undamaged condition.

3.3 Site Services

3.3.1 Each ECEMI member, developer, and contractor shall be responsible for the
compliance with ECEMI rules and regulations. Cleanliness must be maintained at all
times.

3.3.2 Temporary facilities and others services must be on the property of the respective
ECEMI members and developers. A setback of at least three (3) meters from the
RROW must be observed.

3.3.3 Outdoor canteens and sidewalk vendors will not be permitted.

3.3.4 Upon completion of the works, the ECEMI members, developers, and contractors
must remove all temporary accommodations and facilities within fourteen (14)
calendar days from the time of completion of such work and final handover to the
client. Failure to do so will entitle ECEMI to undertake removal without prejudice to
loss, penalty charges, and legal action when applicable.

3.3.5 In case the ECEMI members and developers will have delays in the construction
activity at their site, the site must always remain in clean and tidy condition – grass
trimmed and no observable excessive vegetation. Rubbish or trash of any type such
as junk, scrap, bottles, boxes, and the like must be removed from or stored
appropriately or inconspicuously at the site. Failure to comply will compel ECEMI to

remove such materials at the expense of the concerned ECEMI member and/or
developer/s.

3.3.6 All current local and national regulations regarding the disposal of waste and rubbish
must be followed by all ECEMI members, developers, and contractors.

3.3.7 Rodent, insect and pest control services must be provided to prevent spreading to
other areas.

3.4 Site Construction

3.4.1 Temporary Board up and Fence

a. Before any external or structural works can commence, construction premises


must be properly boarded up with prior approval from ECEMI.

b. The peripheral board up shall be constructed using any long span roofing
material, painted green (unless there is specific design for the building), and with
the provision of an access door. The door must swing inwards so that it will not
obstruct traffic flow. It shall be closed at all times during construction of external
and structural works and shall be padlocked during non-construction hours.

3.4.2 Protective Nets / Dusts Screen

To avoid and prevent accidents due to construction materials from high rise building
which are being constructed or demolished, ECEMI will adopt the applicable
requirements of the National Building Code Rule XV (Protection and Safety
Requirements for Construction and Demolition) specifically on sub-paragraphs from
2.4.1 to 2.4.3, to wit:

a. When the horizontal distance between the outermost face of the building and the
other edge of the sidewalk is less than the one-half the height of the building, a
protective net extending from the uppermost part of the construction/demolition
to ground level shall be required in addition to a fence and canopy

b. Wherever required, protective netting/covering shall be of approved type and


substantially strong material such as G.I. wire gauge 16, 38mm mesh nylon net,
canvas.

c. Where a wall of the building abuts or fronts a street, dust screens shall be erected
to cover the entire wall so as to prevent nuisance from dust.

3.4.3 Construction Materials Delivery

a. Deliveries must be directly brought to the construction site.

b. Light or small deliveries will be allowed at all times. Abnormal, long and wide
cargoes might be scheduled during night time when traffic might be lighter

c. Storing or unloading of construction materials on sidewalks and street areas are


prohibited. Appropriate fines and penalties shall be imposed upon discovery and
clearing cost shall also be added if done by other parties.

3.4.4 Fire Safety

a. All ECEMI members, developers and contractors, shall ensure that fire protection
equipment such as fire extinguishers are readily available on site.

b. Smoking is strictly prohibited on site unless there is a designated smoking area.

c. Cooking is strictly prohibited at the construction site.

d. Sufficient water supply and distribution facilities for firefighting shall be


provided and regularly maintained by the ECEMI member, developers, and
contractors in conformance with the local fire code.

e. All ECEMI members, developers, and contractors, shall make provisions for fire
lanes within the property as necessary to provide access at all times to fire
department equipment.

f. Flammable materials and liquid shall be stored properly and safely in


conformance with the National Building Code and Fire Code.

3.4.5 Requirements for Construction Manpower

a. It shall be the developers’/contractor’s responsibility to provide IDs for all


workers who will work inside the property of the concerned ECEMI member.
Such IDs shall be signed by the Contractor’s Project Manager. The Contractor
shall be required to submit an updated status of all their workers every end of
the month to ECEMI Security.

b. Workers of each Contractor shall be in company uniforms. No worker shall


be in slippers and/or undergarments unless a particular construction activity
requires so. It will be the contractor’s responsibility to ensure that their
workers must have personal protective equipment (hard hat, safety shoes,
gloves, goggles, etc.).

c. Loitering of workers beyond the area of construction is strictly prohibited.

d. The developers and contractors must be responsible for the conduct of his
workers. Gambling, carrying of deadly weapons, drinking, carrying
intoxicating beverage, possession or use of prohibited drugs and other
nuisance behavior in the construction site is strictly prohibited.

e. Raising and maintaining of any livestock within construction premises shall


not be allowed. Pets such as chicken, dogs, and cats may be allowed if
properly caged, tied and or cooped unless further restricted, and are subject to
regulations of ECEMI.

3.5 Site Utilities

3.5.1 Utility provisions are buried underneath the roadway and along the carriageway.
These include electrical conduits/pipes (for power, telecommunications, and other
auxiliary systems), water pipes, and drainage system pipes.

3.5.2 The access to all underground utilities is by means of manholes, handholes, and stub-
outs located in designated areas. Improper opening, accessing, and tapping of these
utilities will be subject to fines and penalties.

3.5.3 Underground ducts and manholes for the power lines for both transmission and
distribution systems are exclusively for use of MERALCO personnel and their
contractors.

3.5.4 Entertainment City’s water distribution system was provided by MAYNILAD, who
has sole responsibility for tapping, connection, and maintenance works of the
pipelines, manholes, and all ancillaries.

3.5.5 A closed concrete rectangular drainage channel (CCRDC) was provided as the site
drainage system. Sewerage lines must not be tapped to the existing CCRDC.

3.5.6 Work permits must be secured from ECEMI for works on the RROW and utility
provisions. These works will be permitted once the requesting party(ies) provide(s) a
safety plan, methodology, duration, and related documents assuring that their works
will not hinder the smooth flow of traffic.

3.5.7 All ECEMI members, developers, and contractors, must secure the necessary permits
from PEZA/LGU. ECEMI members, developers, and contractors must likewise
secure any and all necessary applications with the local utility providers such as (but
not limited to), MERALCO, MAYNILAD, and telecommunication companies.

3.5.8 For works that require excavation or demolition (such as for the embedment of utility
pipes or connecting to the existing utility provision), it will be the responsibility of
the concerned ECEMI member, developer, and contractor to repair and restore the
affected areas to their former state.

3.5.9 The cost of any damage done to the existing utilities and its peripherals shall be borne
by the party involved. Failure to rectify the works shall be subject to fines and
penalties as an additional cost will be incurred if done by others.

3.6 Site Security

3.6.1 ECEMI has its own security force for site security and traffic management. Beyond
that, it is the sole responsibility of the ECEMI members, developers, and contractors,
to provide their own security. Close coordination of all security agencies with ECEMI
Security is required.

3.6.2 Illegal settlers, peddlers, and other street dwellers will not be allowed to enter the
Entertainment City, or any of the respective premises of the ECEMI members.

3.6.3 Certain locations within the RROW will be Restricted – e.g. whole area under the
inland bridge and any other location to be declared by ECEMI as hazardous and
unsafe to roam around. These areas can be accessed by ECEMI authorized personnel
only.

3.6.4 Routine inspections by ECEMI personnel will be conducted beyond the limit of the
RROW if there is a clear indication that safety and security of the Estate will be
compromised. Violations will result in fines and penalties

3.6.5 If there will be violations and/or non-compliance with safety and security that
persist and remain uncorrected or unresolved within a considerable time period, a
work stoppage order will be issued.

3.7 Environmental Protection

3.7.1 ECEMI members, developers, and contractors will be responsible for the government
permits required for the protection of the environment.

3.7.2 Destruction or burning of natural vegetation on areas not included in the contractor’s
scope of work is strictly prohibited.

3.7.3 All ground covers, trees, and other landscape installed by ECEMI must freely grow
and must not be harmed by any activities or development in the adjoining property.

3.7.4 Dumping of wastewater, debris, and other matters that will cause clogging of the
drainage lines will not be permitted.

3.8 Advertising Streamers and Banners

3.8.1 Advertising streamers and banners along the median streetlight and sidewalk post of
the major roads shall conform to the following requirements:

a. Size: 1yard x 3 yards (vertical streamer);


b. Material made of tarpaulin will be allowed;
c. The streamer must have a rigid pipe guide (1/2” dia.) on both ends for
fastening at the top and bottom of the post; and
d. Text and design must be approved by ECEMI.

3.8.2 The Advertiser shall pay a thirty percent (30%) down payment upon confirmation of
the specified location and the remaining balance will be paid upon installation of the
streamer. The payment shall be as follows:

3.8.3 The approval shall be on a “first come, first served” basis, depending on the
availability of the lamp post or location.

SECTION 4: ROAD USER’S GUARANTEE DEPOSIT

ECEMI shall collect a road user’s guarantee deposit from the Licensee’s contractor,
developers, and suppliers who are engaged in new construction and/or renovation works.

4.1 The Road User’s Guarantee Deposit shall be non-interest earning and will be
refunded upon project completion or termination of services of the concerned
contractor/developer/supplier, less the total amount of fines imposed for any
damages and violations. All fines and penalties mentioned in the succeeding Section
5 shall be chargeable to the guarantee deposit.

4. 2 The Road User’s Guarantee Deposit, which shall be deposited to the bank account of
ECEMI, will be used to cover: (1) any damage(s) to roads, underground utilities,
sidewalks, and other road furniture that are part of the Entertainment City common
area; and (2) fines for any violation of ECEMI rules and regulations contained in
this document.

4. 3 The amount of Deposit shall be as follows:

1. New Building Construction

a. 5 Storeys and below - PhP 1,500,000.00


b. 6-10 Storeys - PhP 2,500,000.00
c. Above 10 Storeys - PhP 3,500,000.00

4.4 Within fifteen (15) calendar days upon receipt of advice from ECEMI that the Road
User’s Guarantee Deposit has been reduced to fifty percent (50%) of the required
amount or less, the concerned contractor/developer/supplier shall replenish the
Road User’s Guarantee Deposit to the full required amount. In case of failure to
replenish the Road User’s Guarantee Deposit, ECEMI shall impose additional
sanctions, such as, but not limited to, enforcing work stoppage, facility closure, and
prohibition to enter the site.

SECTION 5: FEES, FINES AND PENALTIES

5.1. CONSTRUCTION VEHICLE PASS FOR CONTRACTORS, DEVELOPERS,


AND/OR SUPPLIERS

Construction vehicles (six-wheeler and above) will be charged PhP200 plus VAT per
delivery/entry.

Any contractor, developer, or supplier who has been issued a Notice of Violation
must settle the corresponding amount of fines/penalties within the prescribed
period, as highlighted in the Notice.

Failure by the concerned contractor, developer, or supplier to settle the account


within the prescribed period shall cause ECEMI to impose additional sanctions, such
as, but not limited to, enforcing work stoppage, facility closure, and prohibition to
enter the site.

SECTION 6: WORK PERMIT/VEHICLE PASS/OTHER APPLICATIONS

6.1 Checklist of Requirements

6.1.1 In order to facilitate the issuance of work permits and vehicle passes, the following
requirements must be submitted by the applicant, as applicable (see matrix below):

A. Request letter or endorsement from the ECEMI member, developer, or supplier


B. Request letter or endorsement from the ECEMI Building Administration;
C. Request letter from Utility Company (MERALCO, MAYNILAD and
telecommunication provider)

6.1.2 The processing, and evaluation of permits and other applications must be submitted
for approval by ECEMI at least five (5) days prior to the implementation of activities
or schedule of deliveries.

6.2 Forms

6.2.1 Contractors and suppliers must secure all applicable construction forms at ECEMI
office as follows;

A. General ECEMI Permit


B. Construction Work Permit
C. Temporary Fencing Clearance
D. Notice of Violation (to be issued by ECEMI)
