Learner Terms and Conditions

By submitting an enrolment form online on the website of the Company (“Plat f orm”) and payment or purchase order to enrol
in any of the courses offered by Learnture Ventures Private Limited (“Company”/ “Board Inf init y”), the Learner (defined
hereinafter) agrees to abide by the following conditions. Please read this document carefully. If you do not accept these Terms
& Conditions, your admission to the course will be considered null and void. By agreeing to the Terms and Conditions, you
are indicating your acceptance to be bound by these Terms & Conditions. Board Infinity reserves the right to revise these
Terms & Conditions from time to time.

DEFINIT IONS

Learner shall mean a candidate admitted to various career coaching and learning path programs offered by Board Infinity.
The Learner is hereinafter referred to as “You” or “User”.

Career Assessment Test shall mean a Learner shall satisfactorily complete and clear all the assignments.

Learning Path Program covers ebooks, online content, online classes, review and assessment and personalised coaching for
a specific technical or management domain e.g. Full Stack Development, Data Science etc.;

Career Coaching Program covers single (or multiple) online personalised session e.g. Resume building, mock interviews etc.
with industry experts.

T ERMS RELAT ED T O COURS E COMPLET ION

This section contains terms providing various facilities to the learners under this Agreement.

Every Learner on successful completion of the Learning Path Program will be eligible for career service program which will be
free of cost and will include the following:

Internship and Final Job Placement Support

Resume building
Mock Interviews
Job Placement Assistance
Job Overview Sessions

Learners must meet the following criteria specified by the Board Infinity in order to be eligible for free career service:

1. Learner must complet e minimum 80% of t he course they have opted/ enrolled for to be eligible for free career
service,
2. T hey must complet e all t he t asks including and not limited to assignments submitted and cleared, social media tasks
comprising those given on LinkedIn, Github, Keggle and others as provided by the platform.
3. Learner must qualify the Career Assessment T est to be conducted post completion of training, to be eligible for the
Free Career S ervices.
4. Unless otherwise expressly agreed in writing by Board Infinity, full payment which shall also include any payment due from
EMI, if the Learner have opted for EMI facility or clearance of all the post dated cheques (if issued), for availing the benefit
of free course is required at the time of registration.

PAYMENT AND REFUND POLICY

Unless otherwise expressly agreed in writing by Board Infinity, full payment for participation in a Program is required at the time
of registration. In case of Programs that include a trial window, such trial window shall be made available only after full
payment. During the trial window, upon a request of the Learner, and to the satisfaction of Board Infinity, Board Infinity may
choose to refund the Program Fees paid, subject to such charges as may be decided from time to time. Once the trial window
has concluded, there will be no refund allowed for any reason whatsoever.

It is the sole responsibility of the user enrolling for a Program to check the accuracy of, and evaluate the suitability and
relevance of, the Program elected. The enrolment to a Program is non-transferable.
To make payment for any Program or to purchase any services or products offered by Board Infinity through the Platform, you
must have internet access of the speed of not less than 4 mbps and a current valid accepted payment method as indicated
during sign-up (“Payment Method”). Board Infinity does not store any of your credit card information or such other information
restricted by RBI for processing payment, and has partnered with payment gateways for the payment towards the services.

Board Infinity will not be held responsible for any damages the user may suffer as a result of using the payment process. The
user agrees and shall defend, indemnify, save and hold Board Infinity harmless from any and all demands, liabilities, losses,
costs and claims that may arise or result from incorrect use of the online payment process or any other causes attributable to
the user.

Board Infinity will not be responsible for any refunds arising out of any failures in online payments and in case the amount gets
deducted from users saving/current account and does not get credited in Board Infinity account, before the transaction is
complete. Users in this case will have to contact either the Bank/Board Infinity to clarify the same.
Receipts of online payments along with confirmation of admissions by Board Infinity should be maintained by the user safely,
as this will be a pre-condition for processing any refund.
The course or workshop fees is not refundable once admission is confirmed. In deserving cases we can give some credits
that can be used within our portal at our discretion. In case of any difficulty or feedback, please write to our support team. In
most cases we have gone to extraordinary lengths to support Learner and incorporate their feedback. Any and all payment
made in advance for the course shall be non-refundable under all circumstances
All refunds will be processed within 10 working days after the refund request is approved by Board Infinity.

Privacy Policy

This privacy policy (“Policy”) applies to all Users who access the or User and are therefore required to read and understand
the Policy before submitting any Personal Information[1].
This Policy applies to the Platform and any other services that are owned and operated by Board Infinity. Third party websites
may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users,
for which Board Infinity is not responsible or liable.

We reserve the right to feature your name, college, or other testimonials used by us. Further, we may use your personal
information to inform you about other certification training courses offered by us. However, we shall not distribute or share your
personal information with any third-party marketing database or disclose your personal information to any third party except on
a case-to-case basis after proper verification of such third party or if required under any applicable law.

We may use Personal Information that the Learner provides to respond to the questions, provide the specific Program related
information and/or services the Learner’s select, send updates about the Programs or other Board Infinity events, and send
Learner the email messages about Platform maintenance or updates, among other things.

[1] Personal Information shall mean the information which identifies the User, name, identification number, email address, age, phone number, password or
any financial account information provided to Board Infinity at the time of registration or any time thereafter.
 Learner’s Code of Conduct

By subscribing the Courses offered by Board Infinity, Learners agree to abide by and follow the code of conduct as stated by
Board Infinity from time to time which includes and are not limited to the following:

1. Learner must not engage in any kind of harassment or misbehaviour with coach, expert and other learners, attendees and
support staff at any point of time during the validity of the course.
2. Learner must not indulge in any kind of unfair activity such as cheating in assignments or exams. If Learner are found guilty
of practicing any such activities they will be subjected to penalties as recommended by Board Infinity from time to time.
3. Learner must not be involved in distribution in any medium whether online or offline any material without Board Infinity ‘s
prior authorization.
4. Learner must not share any personal information such as phone number, email or residential address with the coach. If
such information is shared Board Infinity will not be responsible or liable for any breach arising out of such information
shared.
5. Learner must provide prompt response to any communication made to them and shall every time show good behaviour
towards the coaches or experts.
6. Providing feedback is mandatory after every session and learners are required to adhere to such condition.
7. Learner undertakes and agrees to contact the experts/ coaches through the Platform or any other medium approved by
Board Infinity.

CERT IFICAT E

For Learning Path Program, a Learner shall be awarded the Certificate if:

He/she has enrolled himself/herself has undergone the course of studies, completed the examinations and other
assignments as specified in the curriculum within the stipulated time and secured minimum marks or the grade specified for
the course, and
There are no dues outstanding in his/her name, and
The Learner has sent the hard-copy of documents to the Board where required and, in the way, specified and the same
have been approved by and accepted for admission by the Board and the required certifications are verified to be
genuine.
All Learners meeting the aforesaid mentioned criteria will be issued the Certificate. It can take upto 30 days to issue the
hard-copy certificate after successful completion of the course.

RES CHEDULING POLICY

Board Infinity reserves the right to change or cancel session at any time. Board Infinity will endeavour to give as much notice
as possible in the event of sessions being cancelled or rescheduled.

Learner shall have a right to reschedule the personalised session only if they have made the request for rescheduling
minimum 12 hours prior to the commencement of the session. Learner shall waive off their right to reschedule the session if
they have confirmed the timing from their end.

In the event, a Learner subscribes/ opts for a personalised session with the coach but fails to appear and attend such
session, such an event shall be considered as a ‘no- show’ and the Learner shall not be provided any other session/
replacement in lieu of such unattended session.

RECORDING POLICY

The sessions, classes, lectures, webinars shall be recorded by Board Infinity for quality control and training purposes.
The personalised sessions, upon User’s approval, shall be uploaded on our library for usage by any person.

INT ELLECT UAL PROPERT Y RIGHT

Excluding third party course materials, Board Infinity will own all copyrights, trade marks and other intellectual property rights,
title and interest in or pertaining to the Courses, recorded sessions, content or services developed and created by Board
Infinity for the purpose of this Agreement. No resale, transfer or re-export of the Course(s) content is authorized without the prior
authorization of Board Infinity.
Any material in any form be it video/audio lecture, case studies etc. given by Board Infinity shall be used by the Learner for
personal and non-commercial use, therefore prohibiting the Learners from copying or reproducing, transmitting or re-
transmitting, distributing, disseminating, selling, publishing or republishing, broadcasting, posting, modifying, uploading or
circulating any such material to anyone, unless they have executed a separate written license agreement with Board Infinity.

RIGHT T O US E AND PUBLIS H T HE INFORMAT ION

Learners hereby are granting Board Infinity rights to use their name, college name, profile and other testimonials available on
the website as part of marketing in order to promote the course and the platform in the reasonable and truthful manner.

GOVERNING LAW AND JURIS DICT ION

The Agreement is governed by and construed in accordance with the laws of India, without reference to conflict of laws,
principles and the User irrevocably and unconditionally submit to the exclusive jurisdiction of the courts located in Mumbai,
India

AMENDMENT S

Notwithstanding anything contained herein, Board Infinity may amend and implement the rules, whenever required, in the
interest to maintain standard of academics and any process related to admission or delivery of content.

LIMIT AT ION OF LIABILIT Y

Neither Board Infinity nor any of its partners, affiliates, employees, directors, officers, agents, vendors or suppliers shall be
liable to the Learner or any other person for any direct, indirect, special, incidental or consequential losses or damages of any
nature arising out of or in connection with the use or inability to use the Platform or programs, including, without limitation,
damages for loss profits, loss of goodwill, loss of data, work stoppage, accuracy.

INDEMNIT Y

User agree to indemnify and hold Board Infinity and any of its partners harmless from and against any and all claims, losses,
damages, liabilities, and expenses including attorneys’ fees, arising out of the unauthorized use of the Platform, services, and
the content and courses/ programs or any violation or breach of these terms and conditions or any provisions hereof.

T ERMINAT ION

Board Infinity will terminate Users’ access to the platform, if:

The User is a repeat copyright infringer;

The User breaches any terms of this Agreement;
Violation of any applicable law;
Use of the Platform by User disrupts business operations or affects any other User or;
Users’ have behaved in a way, which objectively could be regarded as inappropriate or unlawful or illegal or which would
bring any claims against Board Infinity.

DIS CLAIMERS

The services and all included content are provided on an “as is” basis without warranty of any kind, whether expressed or implied. The board infinity
specifically disclaim any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties
arising out of course of dealing or usage of trade, whether express or implied.
The Board Infinty further disclaim any and all liability related. To your access or use of the services or any related content. Learner acknowledges and
agrees that any access to or use of the services or such content is at your own risk.
WAIVER AND S EVERABILIT Y

Neither failure nor delay on the part of any party to exercise any right, remedy, power, or privilege hereunder shall operate as
a waiver thereof, or of the exercise of any other right, remedy, power, or privilege. No term of this Agreement shall be deemed
waived, and no breach consented to, unless such waiver or consent shall be in writing and signed by the party claimed to
have waived or consented. No waiver of any rights or consent to any breaches shall constitute a waiver of any other rights or
consent to any other breach.
In the event any provision of this Agreement is held invalid or unenforceable under the applicable laws of India, the remaining
provisions shall continue in full force and effect, and the Agreement shall be deemed to be reformed by replacing such
invalidated or unenforceable provision with a valid and enforceable provision that gives effect as closely as possible to the
intentions of the parties as expressed by the invalidated or unenforceable provision.
 MIS CELLANEOUS PROVIS IONS

By accepting the Terms through your use of the Platform, you certify that you are 18 years of age or older. If you are under the
age of 18 or under the legal age in your jurisdiction to enter into a binding contract you may use the Platform only under the
supervision of a parent or legal guardian who agrees to be bound by the Terms. If you are a parent or legal guardian
agreeing to the Terms for the benefit of a child below 18, be advised that you are fully responsible for his or her use of the
Platform, including all financial charges and legal liability that he or she may incur. By using the Platform, you represent and
warrant that you have the right, authority, and capacity to enter into the Terms and to abide by all of the terms and conditions
set forth herein. The Programs are not for the use of individuals under the age of 18 years.Board Infinity may freely transfer or
assign any portion of its rights or delegate its obligations under these Terms or any Program specific terms. User shall not
transfer or assign, by operation of law or otherwise, any portion of your rights or delegate your obligations under these Terms
or any Program specific terms without the prior written consent of Board Infinity.
