Elements of Contract in Islam
1. Offer
An offer is the first stage of making a contract. The offer can be made in a number of
ways:-
2. Acceptance
The subject matter (consideration) is the third element of the contract. Muslims jurists
have laid down five conditions forte subject matter:-
i. the subject matter must actually exist at the time of the conclusion of the
contract;
ii. the subject matter of the contract should be able to be delivered to the
contracting parties;
iii. the subject matter can be ascertained and known by the parties to the extent
that the knowledge is sufficient to avoid further disputes;
iv. the suitability of the subject matter for transaction is related to the subject
matter itself to the purpose of the transaction;
v. The subject matter must be lawful. Therefore, wine, pork etc which are not
lawful in Islam cannot be taken as a good subject matter.
4. The Contracting Parties
The parties who want to enter into a contract must be legally competent to do so. A minor
(one who has not reached the age of puberty), or a slave, or an insolvent or a person of
unsound mind, or an intoxicated person cannot enter into a contract. Likewise, a person
suffering from death illness cannot make a valid contract. As such, the contracting parties
must possess the following qualifications:-

Dear Students, the above are four elements of the contract in Islam. Please be informed
that there numbers of exceptions to the above general rule, but for the purpose of our
understanding, it is suffice for all of you to remember this four.
With regard to the exam question, the question asked will be related to the case study
given. As such, you are to discuss the above four elements and relate the matter to the
case by giving your further opinion.
Mengikut Mazhab Shafi’e, elemen dikenali sebagai sesuatu yang diperlukan bagi
menjadikan sesuatu itu terjadi sama secara keseluruhan ataupun sebahagian daripadanya.
Oleh yang demikian, elemen-elemen kontrak dalam Islam adalah terdiri dari tawaran dan
penerimaan, pihak-pihak dalam kontrak dan perkara dalam kontrak tersebut:
1. Tawaran
Tawaran adalah perkara pertama yang perlu ada dalam kontrak. Tawaran dalam sesuatu
kontrak boleh dibuat melalui beberapa cara:-
2. Penerimaan
Penerimaan adalah peringkat kedua bagi menghasilkan kontrak yang sempurna. Ia dalah
sebenarnya satu manifestasi kesanggupan yang datangnya dari pihak yang menerima.
Kontrak itu bolehlah dikatakan sempurna apabila terdapat atau berlakunya satu pertalian
diantara pembeli dan penjual. Penerimaan, seperti juga tawaran, bolehlah dilakukan
melalui cara-cara tawaran yang diatas dibuat.
Perkara merupakan elemen ketiga bagi sesuatu kontrak. Para ulamak Islam telah
menetapkan empat kondisi bagi mengenalpasti kesahihan sesuatu perkara tersebut:-

Kepada pelajar, empat elemen diatas adalah elemen-elemen yang asas dalam kontrak
Islam. Adalah dimaklumkan bahawa walaupun terdapat banyak pengecualian ynag
mungkin timbul dari sesuatu kontrak, konsep asas diatas adalah memadai untuk difahami
dan digunapakai dalam kehidupan seharian.
Merujuk kepada soalan peperiksaan yang berbentuk “case study”, soalan yang
dikemukakan akan berkaitan dengan “case study” tersebut. Oleh yang demikian, anda
dikehendaki membincangkan empat elemen kontrak diatas dan mengaitkan elemen-
elemen tersebut dalam “case study” tersebut dengan membuat penghuraian anda sendiri.
