The undersigned accuses FRANCIS VENANCIO of the crime of


Frustrated Homicide, committed as follows:

That on or about October 29, 2005, in the City of Manila,


Philippines, the said accused, armed with a kitchen knife on his left
hand and a “balisong” on his right hand, with intent to kill, did then and
there willfully, unlawfully and feloniously attack, assault and use
personal violence against one JONZEN DELA CRUZ, by then and there
attacking and stabbing him in the different parts of his body, causing
mortal wounds, thus, performing all the acts of execution which should
have produce the crime of homicide, as a consequence but nevertheless,
did not produce it by reason of causes independent of his will, that is the
timely and able medical attendance rendered to said JONZEN DELA
CRUZ, which prevented his death.

TABOTABO, by then and there stabbing and hitting on the chest and
different parts of the body and holding him on the mouth and neck,
causing mortal wounds, thus, performing all the acts of execution which
should have produce the crime of homicide, as a consequence but
nevertheless, did not produce it by reason of causes independent of his
will, that is the timely and able medical attendance rendered to said
MANUEL DAGANDAN III y TABOTABO, which prevented his death.
