CONTRACT OF LEASE

KNOW ALL MEN BY THIS PRESENTS:

This Contract made and executed in _________________, this ___ day of


_________________, by and between:

_____________________, of legal age, Filipino, with address at


________________________________, and hereafter known as the
LESSOR,

-and-

______________________, likewise of legal age, Filipino, with


address at _____________________________________________,
and hereinafter known as the LESSEE.

WITNESSETH:

WHEREAS, the LESSOR is the registered owner of a residential house


situated in ________________________________________.

WHEREAS, the LESSEE desires to lease from the LESSOR the abovesaid
residential house.

NOW, THEREFORE, for and in consideration of the foregoing lease of the


abovesaid residential house, and payment of the rent hereinafter set forth, the
LESSOR hereby leases to the LESSEE and the LESSEE hereby rents and takes by
way of lease the aforesaid residential house subject to the following terms and
conditions, to wit:

(1) Term. - This lease is for a period of one (1) year beginning
___________________ up to ___________________. This contract shall be
renewable upon mutual agreement of the parties.

(2) Rate. - The rental for the leased premises shall be


_____________________________ (P____________) per month. The increase in
the monthly rental upon renewal of the lease shall be agreed upon by the parties.

(3) Advance, deposit and rental payments . - The LESSEE shall give the
LESSOR one (1) month advance rental and two (2) months guarantee deposit in the
total amount of ______________________________________ (P______________).
The one (1) month advance rental shall be used for the last month of his stay on the
leased premises. The two (2) months guarantee deposit shall be used by the
LESSOR to pay the remaining electric and water consumed by the LESSEE and to
answer for whatever damages caused by the LESSEE on the leased premises at the
end of this lease.

(4) Use of the premises.- The leased premises shall be used for residential
purposes only and shall not be used for illegal or immoral purposes such as but not
limited to, illegal trade, prostitution joint, drug or gambling den, gun running activities
or human trafficking. The LESSEE shall be solely responsible for such illegal and
immoral activities and shall hold free and harmless the LESSOR from any or all
criminal or civil prosecution.

(5) Subleasing. - The LESSEE shall not assign, transfer or sublease to any
third party or allow persons not members of his household to live therein without the
knowledge and written consent of the LESSOR.

(6) Improvements.- The LESSEE may introduce improvements on the


leased premises only with the knowledge and written consent of the LESSOR. Any
improvements so introduced by the LESSEE without the knowledge and consent of
the LESSOR shall be a breach of this contract. The LESSOR has the right to remove
the same anytime without right of reimbursement by the LESSEE. The LESSEE shall
further shoulder the cost of removal or demolition of such unauthorized
improvements, in case of demolition. Any improvements introduced by the LESSEE
shall become the ownership by the LESSOR, without right of reimbursement to the
LESSEE.

(7) Upkeep of property. The LESSEE admits that the leased premises is in
good condition and shall surrender to the LESSOR the same condition upon
termination of the contract. The LESSEE shall take good care of the leased
premises and shall not, among others, recklessly drive nails into the cement wall of
the building so as not to have unnecessary destruction thereto. Any damage caused
to the building shall be repaired by the LESSEE.

(8) Repairs - Minor repairs needed for the upkeep of the leased premises,
including fixing of door knobs, replacement of light bulbs, obstructed lavatory and
faucet fittings, holes in cement walls from nails and those due to wear and tear and
damages due to the fault and inadvertence of the LESSEE’S or her family, guest or
domestic helpers shall be the LESSEE'S responsibility and expense. Major repairs
shall be for the account of the LESSOR. Major repairs will include roofing and walls
damaged by typhoon and earthquake and obstructed drainage pipes and cleaning of
septic tank.

(9) Utilities. - Any liabilities that may arise from the LESSEE'S use of
telephone, water and electricity shall be the LESSEE'S sole responsibility. The
LESSEE shall observe safety and regulatory standards for utilities prescribed by the
proper authorities.

(10) Restrictions. - No firewood or charcoal shall be used as fuel by the


LESSEE inside the leased premises. No unnecessary noise, smoke, or foul odor
shall likewise be permitted therein.

(11) Inspection.- The LESSOR or her authorized agent shall have the right
to inspect the leased premises during reasonable hours of the day.

(12) Termination of lease.- The LESSOR shall have the right to terminate
this contract upon breach by the LESSEE of any of the terms hereof. For this
purpose, failure to pay two (2) months consecutive rent within the time specified shall
be considered as a breach of contract. If however the LESSEE shall decide to pre-
terminate, he shall inform the LESSOR one (1) month before he vacates. In case of
pre-termination, the LESSEE, shall forfeit the two (2) months guarantee deposit. In
addition, the LESSEE shall pay all the accrued bills and payables for telephone,
electricity, water consumption and for whatever damages caused in the leased
premises.

(13) Effect of Breach of Contract or Termination of the Lease- The LESSOR


is hereby authorized to request the public utility companies, such as MERALCO or
MAYNILAD to cut off the electricity and/or water supply and/or to padlock the leased
premises, without need of court action or court order.

(14) Court Litigation.- In case of the court litigation, the guilty party or one
who violated the terms and conditions shall be liable for the payment of attorney's
fees and other court litigation expenses.

(15) Lien.- The LESSOR shall have a lien on all properties of the LESSEE
inside the leased premises whenever the latter becomes delinquent. If the LESSEE
desires to vacate the leased premises, the LESSOR shall have the right to withhold
from the LESSEE any property/properties or money of such value as to compensate
for the delinquency.
