SERVICE CONTRACT
DEPOSIT
Fifty percent (50%) of the estimated contract cost is due and demandable on based on the
payments terms stated in our package by the CATERER unless other stated agreement will be
imposed on a separate document.
FINALPAYMENT
Final Payment will be due and demandable based on the payments terms stated in our
package
PAYMENT METHOD
All prices quoted are based on cash payments
Check payments are due seven (7) days before the event date and subject to clearance.
NSF checks or checks not honored by the bank will be subject to 2% interest weekly from the
day it is issued
SERVICE CHARGE
There will be a service charge imposed on special charges such as provincial rates for the
transportation, for staff wage and overtime, service charges for other supplies.
INCLUSIONS
Inclusions are based on the amenities on the packages to be ordered. All inclusions are on
the package and the client cannot say or assume that an amenity or anything is included in
the package which is not in the inclusion based on the fine print on the package.
GUEST COUNT
The initial guest count will be at the time of 1st meeting, Final Guest Count, not subject to
reduction, is due two (7) days prior to the event date. Any additional Guest after the stated
period is subject to extra charges as may be imposed by the CATERER.
CHILDREN
A child who occupies a full seat will be charge as an adult also unless the client will provide a
separate seat for them by bringing their own or renting to the Caterer.
FOOD QUANTITY
The CATERER will prepare an extra ten percent (10%+staff food) overage based on the final
number of guest count registered by the CLIENT. Part of this overage is to include food for the
staff and/or service providers of the Caterer. The food quantity is based on a 1 round of service
plus 10% of the total quantity ordered.
LEFTOVERS and FOOD SERVING
Leftover is the responsibility of the caterer and the catere shall not be responsible if there will
be no leftover because of verifiable circumstances such as the following (guest count exceeded
or deceeded, guest who did not follow the standard portion serving of food and came back for
second serving), 1 serving is equivalent to one guest; food that was used not for dinner but for
drinking menu or pulutan. Containers for leftovers will be provided by the Client and not by the
Caterer. The Caterer shall not have any liability for any spoilage of food after the event and
casualties that will occur from the spoilage.
BEVERAGES
Bottomless beverages will only be applicable at the time of eating and not the whole entire
event. Additional beverages provided by the CLIENT will be subject to limitation of
responsibility of the Caterer.
TIME
The Caterer must be provided at least 4 hours of setup time prior the event time. The
maximum service time is 4 hours (not including setup time). The CLIENT will be billed for
additional staff hours for any time extension beyond the prior agreed upon time. 100
pesos/waiter/hour will be imposed as overtime pay and will not exceed 3 hours. The caterer
will arrive at exactly 3 hours before the event, if the client will ask for an earlier set up time,
the client will be charged a fix 300 pesos per staff for the overtime.
CHANGE OF EVENT DATE or VENUE
Change of event date and venue will not be accepted by the CATERER if not made 1 week
before the date. Change of date will be subject to availability (if the new event date will not be
available, the CLIENT must choose an available date in the Caterer’s records). Changes in venue
will be subject to availability (if the new venue will be chargeable of transportation fees, the
CLIENT must pay the necessary fees estimated by the Caterer. Drastic change of venue of the
client will not be accepted by the caterer (example from Pasig to Batangas Change). Change of

ADDITIONAL AREA FLOOR SERVICE

Unless the venue is on a 1 floor area or the venue has a working service elevator, the
Client must pay a 50 pesos per floor per waiter for the additional labor exerted by the
waiter.
RENTALS
CATERER may provide all or part the rental items for the event. However, certain items may
incur restocking & cancellation fees. If CATERER arranges rentals, for the CLIENT, through a
rental company, CLIENT will have to pay the rental company directly. Any loss or damage to
any rentals will be billed to CLIENT after the event.
THIRD PARTY SUPPLIER
The caterer in a client’s permission may book some supplies that is not the caterer’s itself,
such as photo booth, emcee, clowns and such shall be subject for limitations such as delays,
non-delivery or failure to deliver in a complete manner, these limitations are not the fault of
the caterer but the supplier who will render the service, the caterer however may accept the
payment and process all things that may occur whether positive or negative and the caterer
will assist if there will be any refunds or changes in the packages to be availed.
ATTACHED IN THIS DOCUMENT IS THE JOB ORDER WITH ALL DETAILS AND INFORMATION
FOR ANY SPECIFIC INSTRUCTION BEYOND THE CONTRACT, PLEASE ATTACH AN ALLONGE
WITH SIGNATURE OF BOTH THE CATERER AND CLIENT.
VENUE RESTRICTION
The caterer shall not be liable if the client shall not disclose or inform the caterer of specific
rules and regulations of the venue. Specific permits mandated by the venue shall be
accomplished by the client with the information provided by the caterer. Any incident that
may delay the caterer from the set up time due to the venue issue shall be the sole liability of
the client and will invalidate the time period of set up stated in the job order.
STORAGE
Prior approval from the CATERER is required for any storage service before or after the
event/function. Such storage will be subject for limitations such as limited liability as stated by
the depository act of the Philippines. State storage items
ASSIGNABILITY
This contract is not assignable without the prior written consent from the CATERER.
CANCELLATION BY: CLIENT / VENUE / ACTS OF GOD
The 50% down payment and the reservation fee will not be refundable if the Client will cancel
their event. Acts of God will not be an excuse for cancellation of event unless made 2 days
before the event, but it will be subject to charges imposed by the caterer (example: Storm
arriving PAR)
CANCELLATION BY CATERER
The CATERER reserves the right to terminate this contract for any valid reason. IF the CATERER
terminates this contract before thirty (30) day period prior to the event date,(APPLICABLE ONLY
IF THERE IS A RESERVATION FEE) all deposits and prepayments will be returned in full within ten
(10) days from the event date plus 10% penalty.
CORKAGES, BONDS AND OTHER FEES
Corkage’s, bonds and other fees imposed by the venue or other supplier that is not ordered to
DCS shall be shouldered by the client in full. Nonpayment of the said fees, the caterer shall not
be held liable and will have a right to cancel the event and still collect in full.
DAMAGE
The CATERER assumes no responsibility for ANY damage or loss of merchandise, alcohol,
equipment, furniture, clothing or other valuables of the Client prior to, during or after the event.
The CATERER will do everything possible to ensure that all of the CLIENT’s supplies, rentals and
equipment are cared for and maintained in good working order and without damage. When
providing the location for the event/function, the CLIENT, understands that accidents/breakage
and/or damage may sometimes occur. The CATERER will not be liable for any damage or loss,
unless specifically caused by the willful negligent actions or conduct of the CATERER or its
employees. Proof must be obtained to legally enforce damage caused by the waiters
CATERER’S LIABILITY:
The CLIENT absolves the CATERER from any third party claims, except for actions caused by
CATERER and/or negligence of its employees. Food Related casualties such as spoilage or any
others will be strictly enforced to the caterer and shall refund the 2000 pesos for 50-100 guest
per dish and will adjust for the total number of guest. If the client brings food that is not ordered
from the caterer, liability from any casualty shall be waived due to difficulty of tracing whom
food is liable for the casualty. NON DELIVERY OF SERVICE WILL RENDER CATERER LIABLE FOR
THE WHOLE AMOUNT OF THE
CATERING EVENT PAID PLUS 25% PENALTY
TAXES
CLIENT will be charged the applicable current rate for all services rendered as determined by the
concerned government body such as VAT and other withholding or final taxes.
UNLAWFUL ACTIVITIES
The CLIENT will comply with all the laws of the Republic of the Philippines and all municipal
ordinances and all lawful orders of police and fire departments, and will not do anything on the
event/function premises in violation of any laws, ordinances, rules or orders. If unlawful
activities should occur on the premises, and the event is cancelled, there will be no refund of any
kind from CATERER to CLIENT. Any theft incident within the venue will be properly investigated
and shall be in equal assessment. The CLIENT shall not have any right to accuse the staff of the
caterer unless a credible proof will be given as evidence of the incident due to the quantity of
people in the function.
AMENDMENT AND SUPPLEMENT
Any amendment and supplement to this Agreement shall come into force only after a written
agreement is signed by both parties five (5) days before the event/function date. The
amendment and supplement duly executed by both parties shall be part of this Agreement and
shall have the same legal effect as this Agreement.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the
Republic of the Philippines.
IN WITNESS THEREOF the parties hereto have caused this Agreement to be duly executed on
their behalf by a duly authorized representative as of the date first set forth below.
