A populr br nd resturnt in downtown Tmp's Chnnel district is cing legl ction rom its condominium
ssocition.

The Towers o Chnnelside Condominium Assocition Inc. hs led  lwsuit ginst Prk & Rec, the dult plyground-
themed br nd resturnt tht opened on the ground floor o the towers just beore Hlloween, sking the court to
resolve  dispute over the use o the buildings' shred spces.

The condo ssocition is seeking declrtory relie to stop Prk & Rec rom using  spce it reers to s "the overll lot,"
which includes the condo towers' common spces. Prk & Rec, the ssocition lleges, hs no right to the common
res, but hs still instlled televisions, lighting, spekers, wiring nd plumbing there.

Prk & Rec's lndlord, Tower Holdings LLC, is lso  deendnt in the lwsuit. The ssocition is sking the court to
declre tht Prk & Rec's "unpproved ltertions" hve resulted in dmges; it wnts to be wrded dmges in n
mount to be determined t tril.

Prk & Rec is lso using the common spce closest to its retil condo or storing items tht rnge rom propne tnks to
outdoor urniture to br equipment, lcohol nd energy drinks, ccording to the lwsuit. The ssocition lleges tht
Prk & Rec hs creted "hzrdous conditions nd lie sety issues" by blocking ccess to the common spce next to its
retil unit, storing unsecured propne tnks ner the rodwy nd storing propne tnk-ueled heters under
overhngs or close to the building.

Prk & Rec occupies more thn 9,900 squre eet nd cost more thn $1 million to lunch. The concept is the brinchild
o St. Petersburg resturteur Stephen Schrutt, who owns Hunger nd Thirst Group. Schrutt declined comment
Wednesdy.

"Prk & Rec uses the unpproved outdoor spekers until the erly morning hours nd employs unpproved flshing
colored lights tht were instlled ter the cese nd desist demnd," the lwsuit lleges.

The resturnt ctions “plce individuls nd property in jeoprdy o irreprble hrm, nd interere with the other
retil nd residentil unit owners’ quiet enjoyment o their units nd the shred cilities," the lwsuit lleges.
