SUBJECT: Command Guidance On Driving Under the Influence (DUI) of Liquor and
Prohibited Drugs

TO: All PAF Unit Commanders

1. It has been observed that despite the “Zero Tolerance” policy imposed by
the Command and the existing law prohibiting the driving of motor vehicles under the
influence of liquor and prohibited drugs, many personnel still commit said acts resulting
in serious losses of man-hours, damage to properties and loss of lives. Hence, the
Command issues this directive, aside from its safety programs, to address this issue. A
personnel is said to be driving under the influence of liquor or prohibited drug if he/she
was tested positive in alcohol and drug test regardless of the level of intoxication as
determined under RA 10586 and its implementing rules and regulations. The following list
is the standardized punishment for EP in every DUI case:
1) One rank demotion
a) If no physical injuries or homicide and
b) No other violation of laws, rules, regulations and ordinances

2) Two ranks demotion


a) If the violation resulted in physical injuries; or
b) If the offender has no updated driver’s license, motor vehicle
registration or both; or
c) If the offender has violated other laws, rules and regulations

3) Discharge without honor


a) If the violation resulted in homicide; or
b) If the offender has no updated driver’s license, motor vehicle
registration or both; or
c) If the offender has violated other laws, rules and regulations

2. Officers who are found after investigation, to have committed DUI shall be
referred to a Pre-Trial Investigation preparatory to General Court Martial proceedings.
3. If the offender was tested negative in alcohol and drug test but he/she
admitted the offense or that witnesses confirmed that the offender took intoxicating liquor
or prohibited drug prior to the incident, the offender shall be held liable under this policy.
4. Violation of other laws such as the Anti-Helmet Law and the Anti-Distracted
Driving Act, AFP rules, regulations and ordinances shall be considered as aggravating
circumstances. Commission of DUI during emergency situations will only be considered
as mitigating/exempting circumstance upon determination by the AFPM/Unit Provost
Marshals but will not exempt the offender from other violation of existing laws, rules and
regulations. Further, acquittal from an offense for violation of this directive shall not be
without prejudice to prosecution for violation of other laws, rules and regulations.
5. Any personnel who will conceal or conspire to conceal a DUI incident or the
real status of the offender during the incident and during medical examination in order to
avoid punishment under this policy shall be held administratively liable under the Articles
of War/Civil Service Law without prejudice to filing of appropriate cases in civil court.
Further, persons not connected with the organization who shall do the same shall be
charged before the civil court.
6. The Unit Commanders shall be responsible for the strict implementation of
this directive.
7. The Base Commanders shall cause the inspection of motorists entering
bases and the apprehension of personnel plying within bases who are violating this this
policy.
