CREATING A SPECIAL INVESTIGATION COMMITTEEE FOR THE


ADMINISTRATIVE INVESTIGATIONOFPHILHEALTH RETURN TO
HOSPITAL(RTH) AND DENIED CLAIMS (FILED BEYOND 60 DAYS PERIOD
FOR FILING) AT THE RIZAL PROVINCIAL HOSPITAL SYSTEM (RPHS) –
BINANGONAN ANNEX.

WHEREAS, on 30 April 2019, areport from the Office of the Provincial


Accountant was received by the Human Resource Management Office pertaining
to a list of unpaid denied claims at RPHS – Binangonan Annex, for the year
2018 including also the months of January and February 2019 with a total
amount of PHP4,637,688.00, PHP 855,120 of which is for the category: Filed
beyond sixty (60) days, to the prejudice of the province;

WHEREAS, this Office, in accordance with the mandate of Republic Act


7160, otherwise known as theLocal Government Code of 1991 and the Revised
Rules on Administrative Cases in the Civil Service (RRACCS) is clothed with the
power to conduct administrative investigations involving its erring employees;

WHEREAS, the concerned employees, though considered as employees of


the Rizal Provincial Government, are considered as PUBLIC HEALTH
WORKERS (PHW) as defined under Rule III of the Revised Implementing
Rules and Regulations on the Magna Carta of Public Health Workers of
R.A. 7305, to wit:

“Public Health Workers (PHW) – Persons engaged in


health and health-related works. These cover employees in
any of the following:

a. Any government entity whose primary function according


to its legal mandate is the delivery of health services and
the operation of hospitals, sanitaria, health infirmaries,
health centers, rural health units, barangay health stations,
clinics or other institutional forms which similarly perform
health delivery functions, like clinical laboratories, treatment
and rehabilitation centers, x-ray facilities, and other similar
activities involving the rendering of health services to the
public; and
b. Offices attached to agencies whose primary function
according to their legal mandates involves provision,
financing or regulation of health services.

Also covered are medical and allied health professionals, as


well as administrative and support personnel, regardless of
their employment status.

WHEREAS, under the Revised Implementing Rules on the Magna


Carta of Public Health Workers otherwise known as the Republic Act 7305
(Rule I Section 1) “…all persons engaged in health and health-related works
employed in all hospitals, sanitaria, health centers, rural health units, barangay
health stations, clinics and other health related establishments owned and
related establishments owned and operated by the government or its political
subdivisions, regardless of their employment status, including medical and allied
professionals and support service personnel”are covered by said law;

WHEREAS, pursuant to Rule XI Section 5 of the above-cited Magna


Carta of Public Health Workers, Administrative charges against a public health
worker shall be heard by a committee composed of the Provincial Health Officer
of the province where the public health worker belongs, as chairperson, a
representative of any existing national or provincial health worker’s organization
or in its absence its local counterpart and a supervisor of the office mentioned
above;

WHEREAS, a Special Investigation Committee is hereby created for the


purpose of conducting the formal investigation on the subject Administrative
issue and to submit its actions and recommendation/s to the Disciplining
Authority, for review and final order within thirty (30) days from termination of
its investigation.

NOW THEREFORE, I, REBECCA A. YNARES, Governor of the Province of


Rizal, by virtue of the powers vested in me by the Republic Act No. 7160, do
hereby order:

Section 1. Creation of Special Investigation Committee. There is


hereby created a Special Investigation Committee designated as the body to
investigate the above-cited matters involving public health workers within the
purview of R.A.7305.

Section 2. Composition. The Special Investigation Committee shall be


composed of the following:

DR. ILUMINADO A. VICTORIA -Chairperson

NILO S.A. DOLOR - Member

JOYLANI SAN JUAN - SAMSON - Member

Section 3. Duties and Functions. – The Special Investigation Committee


shall exercise the following duties and functions:

a. Conduct the formal investigation in accordance with the RRACCS on


the veracity of the available information, make a finding on the possible
administrative liability of personnel and to determine if there exist a prima facie
case to warrant the filing of an administrative charge; and

b. To submit a resolution, appropriate administrative recommendation to


the Disciplining Authority based on the investigation conducted within thirty
(30) days from the date thereof;

Section 4. Funding and Compensation. – The Committee shall perform their


duties and functions without compensation or remunerations;

Section 5. Effectivity. – This administrative order shall take effect upon its
approval.
