EXTRA-JUDICIAL SETTLEMENT OF ESTATE WITH DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This Extra-Judicial Settlement of Estate with Deed of Sale made and entered into by and
among:

MARIELLE D CASON, Filipino, of legal age, single, having residence and postal
address at 031 Pasong Camachile I, City of General Trias, Cavite;

OHLEAF JR. D. CASON, Filipino, of legal age, married to Jo-ann A. Cason, also
a Filipino, of legal age and both having residence and postal address at Block 3 Lot 9
Villa Maria Subdivision, Molino 3, City of Bacoor, Cavite;

GEL MARK D. CASON, Filipino, of legal age, single, having residence and postal
address at number 033 Barangay Pasong Camachile, City of General Trias, Cavite

WITNESSETH:

WHEREAS , We are the legitimate children and the sole heirs of our father JAIME
PAGSOLINGAN DE GUZMAN, Filipino, of legal age, married to EMERENCIA DIMALIG DE
GUZMAN, also a Filipino, of legal age and both having residence and postal residence at 078
Barangay Pasong Camachile I, City of General Trias, Cavite ;

WHEREAS, our above-mentioned deceased parents died intestate, without Will or


Testament, and without any outstanding debts in favor of any person or entity;

WHEREAS, our deceased parents the late CONRADO LUGAY and ESPERANZA
LUMUCSO are the joint -owners of a parcel of land, and with the other half having been
acquired from Gabriela Lugay through Deed of Absolute Sale , measuring TWO THOUSAND
SIX HUNDRED EIGHTY – SIX (2, 686) square meters , covered by Transfer Certificate of Title
no. T- 545945 of Registry of Deeds for the Province of Cavite and located at Barangay Pasong
Kawayan II, City of General Trias, Cavite, Philippines. The subject property is conjugal in nature
and is more particularly described as follows :

“A parcel of land (Lot 2296-G of the subd. plan (LRC) Psd –


329922, approved as a non-subd. project, being a portion of Lot
2296, San Francisco de Malabon Estate; L.R.C. Rec. No. 5964),
situated in the Bo. of Pasong Kawayan, Mun. of Gen. Trias,
Province of Cavite, Island of Luzon. Bounded on the NE., pts. 1
to 2 by Lot 2296-F, of the subd. plan; on the SE., pts. 2 to 3 by
Lot 2295; pts. 3 to 5 by Lot 3072, both of San Francisco de
Malabon Estate; and on the NW., pts. 5 to 1 by Road. Beginning a
a pt. marked “1” on plan, being S.31 deg. 25’W., 1620.42m. from
Mon. No. 105, San Francisco de Malabon Estate thence S.81 deg.
13’E., 20.45 m. to pt. 2; thence S.14 deg. 14’W., 110.00m to pt.
3; thence S.56 deg. 50’W., 19.33m to pt. 4; thence S.70 deg.
39’W., 13.49 m. to pt. 5; thence N. 15 deg. 59’E., 129.81 m. to
the pt. of beginning, containing an area of TWO THOUSAND SIX
HUNDRED EIGHTY-SIX (2,686) SQ. METERS, more or less. All pts.
referred to are indicated on the plan and are marked on the
ground as follows: Pts. 3 by 5 by Old PLS and the rest by P.S.
cyl. conc. mons. 15X60 cm.: bearings true; date of orig. survey,
June 1905-July 1908, and that of the subd. survey, exec. B. Pedro
A. Angeles Jr., G.E., on June 17, 1984”

WHEREAS , we the parties herein, all of us being of legal ages, with full capacity to contract
, and in view of the above facts and circumstances, pursuant to Sec. 1, Rule 74 of the Revised
Rules of Court of the Philippines, we are therefore co-owners and to terminate co-ownership
over the same we have agreed to divide as we do hereby divide and adjudicate to ourselves , the
above- mentioned parcel of land , in equal shares pro indiviso;
That we hereby affirm that we have executed the foregoing instrument out of our own
voluntary free will without force, intimidation or violence upon our person, that we have
hereby received our just and proper share and have no claim or demand against each other;

IN WITNESS WHEREOF, we have hereunto set our hands this 24th day of May, 2017 at
the City of General Trias, Cavite Philippines.
