MEMORANDUM
1. Reference: Police Blotter Entry # 5680 Page Nr. 0151 dated June 25, 2016.
3. Investigation disclosed that while the victim and his cousin Jimuel P. Mani-
an was walking home after having a drinking spree at Ferguzon Road, Baguio City going
to the direction of La Funeraria Paz, they were unaware of the presence of suspect at the
stated place of incident then stabbed the victim five (5) times back portion not contented
he mauled resulting the victim laid on the ground which was witnessed by his cousin of
the victim. The suspect walked away from the place of incident. Mr. Mani-an immediately
look for a help to nearby establishment it so happened that two Police Officers conducting
foot patrol and immediately informed the matter and pinpointed the suspect that was
casually walking not away from the crime scene.
4. The two police Officers immediately responded and able to arrest the
suspect. The victim was already dead as it was declared by Dr. Jaime Rodrigo Leal
(Medico-Legal Officer). The scene was cordoned and the victim was brought a the La
Funeraria Paz waiting for the consent of relatives of the victim for autopsy while the
suspect was brought at the Baguio General Hospital for medical examination. Pertinent
documents are now being prepared for inquest proceeding. Progress Report will follow;

4. The wife of the victim who was identified as Joy Dana Liwag, 26 years old, born
on August 15, 1988 housewife native of Camp 1, Rosario La Union appeared at this office
and gave her voluntary statement to P03 Leo F. Marrero. She filed her complaint against
the suspect on behalf of her deceased husband. A case of murder was filed at the
Prosecutors Office under National Prosecution Service Docket No. 01-02-03 dated June
25, 2016 wherein “treachery and evident premeditation” were present in the commission
of crime that served as the qualifying circumstances. Duty Inquest Prosecutor Conrado
Villamor Catral, Jr signed an inquest resolution directing the arresting officers to turned
over the accused at the Baguio City Jail.

1. Request for the presence of SOCO Team to process the crime scene
located at Quirino Highway particularly at the waiting shed of MRR Queen of Peace,
Baguio City.

2. This request is made with the assurance that the Duty Investigator being in
charge of the Crime Scene shall remain and provide all necessary security and
support to the SOCO Team during the whole process until after the crime scene is
released.
3. Further request that this Office be furnished a copy of the list of evidence
gathered and the result of examination conducted thereon.

2. The purpose of which is to determine if the blood sample being collected to the
suspect will matches to the stainless kitchen knife likewise blood sample collected from
the T- Shirt of the suspect.

PRELIMINARY DISPOSITION
It appears from the documents of the record that the respondent was arrested
validly without warrant pursuant to the provision of Section 5, Rule 113 of the Revised
Rules on Criminal Procedure and has not executed a valid waiver on the provision of
Article 125 of the Revised Penal Code. Hence, the case must be resolved based on the
evidence submitted by the complainant.
The evidence on record clearly shows that there exists sufficient probable cause
that the case was committed and that the respondent probably guilty thereof. There is
therefore reasonable ground to have the respondent detained so that he may be held
liable to answer the commission of the offense.
Wherefore, in view of the foregoing, peace officers are hereby advised to transfer
custody of the arrested respondent at the Baguio City Jail and further instructed to
transmit the records of the case with the City Prosecutor for appropriate action within the
period prescribed by law.

I. AUTHORITY:
PBE Nr. 5680 Page Nr. 0151 dated June 25, 2016.
IV. DISCUSSION:
In connection with the follow-up investigation conducted by this Office it revealed,
that according to Jimuel P.Mani-an during his interview at this station the suspect was
hiding at the waiting shed when he suddenly stabbed the victim at the back and
subsequently mauled the victim to death whereby it contemplates such murder’s
qualifying circumstances of treachery and evident premeditation. That according also to
one Robin Padilla Menzi (neighbor of the victim) the incident emanated when the victim
allegedly having an affair with the live-in partner of the suspect named Angel Lopez Locsin
wherein the suspect only learned it before the incident happened. He (Robin) also averred
that before the occurrence of incident, the suspect was asking him on the whereabouts
of the victim in which he also noticed the angry tone of voice and displayed reaction of
the suspect. That presumptively be considered as the motive and reason in committing
the crime by the suspect.
V. CONCLUSION:
Based on the gathered pieces of evidence and statement of the
complainant and witnesses the violation of Article 248 of the Revised Penal Code was
consummated whereby the victim with evident premeditation was treacherously stabbed
and mauled to death by the suspect.
VI. RECOMMENDATION:
Case should be considered close and solve. I also humbly recommend that
involved personnel’s be given an awards for their well performance and accomplishment.

JOINT AFFIDAVIT
We, PO1 Jazle D. Muskara, of legal age, single and PO1 Dennis S. Modi, of legal age
single, members of the Philippine National Police after having been duly sworn to under oath and
accordance with law hereby depose and state the following wit:
2. That on June 24, 2016 at around 10:35PM, while we are conducting foot patrol
along along Quirino Highway particularly at the waiting shed of MRR Queen of
Peace, Baguio City a male person asking for a help that his cousin was stabbed and
mauled and pin pointed to as the person who was responsible on the said crime.
3. That upon informing as we responded immediately and arrested the said male
suspect who was casually walking and I P01 Jazle D.Muskara reads the constitutional
rights of the suspect in Ilocano dialect which he fully understood which reads as follows:
Ada karbengam nga agulimek, amin nga ibagam ita nga kanito ket maaramat wenno
mausar kontra o laban kanyam idiay korte ti husgado. Ada karbengam nga mangala
wenno agbayad ti abogadom iti sarilim nga pili, no awan ti kabaelam nga mangala ti sarilim
nga abogado, ikkan daka ti gobyerno ti libre nga abogado nga mangilaban kanyam.”
4. After which, we asked him if he understood what we have said, and the suspect
answered, “wen” Sir. After which brought to our office for proper disposition on board of
our Mobile Patrol 81

5. That, I P01 Jazle D.Muskara asked the personal circumstances of the arrested
suspect and stated his name as John Mark Nalula y Dulnuan, 24 y/o, single, taxi
driver, high School graduate native and a resident of Dominican Road, Baguio,
City.
6. That we know latter the name of the victim identified as wherein victim
identified as one Ferdie Liwag y Dulnuan, 27 y/o, born on June 29,1987, married,
College level, Embalmer and residing at La Funeraria Paz located at #79 Naguilian
Road, Baguio City, native of Camp 1, Rosario La Union.
7. That we turned over the suspect to the duty investigator for disposition of
the case and for filing.
7. That, we are executing this affidavit to attest to the truthfulness of the foregoing
facts.
