MEMORANDUM

FOR : The Acting City Director

(Attn: CIDMU, CIU and TOC)

FROM : The Station Commander

SUBJECT : Investigation Report on Alleged Murder (Stabbing)

DATE : June 25, 2016

I. AUTHORITY:

PBE Nr. 5680 Page Nr. 0151 dated June 25, 2016.

II. MATTERS BEING INVESTIGATED:

To determine the facts and surrounding of the case of an alleged Murder,
on complaint of JOY DANA LIWAG in behalf of his husband, 26 years old, wife of the
victim and presently residing at Camp 1, Rosario La Union, Baguio City as committed by the
suspect John Mark Nalula y Dulnuan, 24 y/o, born on August,30,1992, single, taxi driver
and a resident at Dominican Road, Baguio, City

III. FACTS OF THE CASE:

Attached herein are the following documentary pieces of evidence that
justifies the truth and supported the credibility of the case:
1. Statement of Joy Dana Liwag marked as Annex “A” stated that
when she was about to sleep, Jimuel P. Mani-an called her thru cellular
phone informing that her husband Ferdie Liwag was stabbed and mauled
to death by John Mark D. Nalula at around 11:20 PM
2. Sworn Statement of Jimuel P. Mani-an marked as Annex “B”.
Stating that he saw and witnessed the suspect stabbed and mauled the
victim to death for an unknown reason.
3. Sworn Statement of Robin Padilla Menzi marked as Annex “C”.
Stating that the incident emanated when the victim allegedly having an affair
with the live-in partner of the suspect named Angel Lopez Locsin wherein
the suspect only learned it before the incident happened. He also averred
that before the occurrence of incident, the suspect was asking him on the
whereabouts of the victim in which he also noticed the angry tone of voice
and displayed reaction of the suspect.
4. Joint Affidavit of Arrest marked as Annex “D”, the arresting officers
stated that upon arrival and assessment of the place of incident they
immediately arrested the suspect wherein cousin of the victim pinpointed
the suspect casually walking at the nearby place of incident, afterwards
apprising the suspect’s Miranda Rights.
5. On the aforementioned gathered information and statement of the
witnesses and pieces of evidence and considering the same, the crime of
Murder be charged and filed against the suspect.

IV. DISCUSSION:
In connection with the follow-up investigation conducted by this Office it revealed,
that according to Jimuel P.Mani-an during his interview at this station the suspect was
hiding at the waiting shed when he suddenly stabbed the victim at the back and
subsequently mauled the victim to death whereby it contemplates such murder’s
qualifying circumstances of treachery and evident premeditation. That according also to
one Robin Padilla Menzi (neighbor of the victim) the incident emanated when the victim
allegedly having an affair with the live-in partner of the suspect named Angel Lopez Locsin
wherein the suspect only learned it before the incident happened. He (Robin) also averred
that before the occurrence of incident, the suspect was asking him on the whereabouts
of the victim in which he also noticed the angry tone of voice and displayed reaction of
the suspect. That presumptively be considered as the motive and reason in committing
the crime by the suspect.

V. CONCLUSION:
Based on the gathered pieces of evidence and statement of the
complainant and witnesses the violation of Article 248 of the Revised Penal Code was
consummated whereby the victim with evident premeditation was treacherously stabbed
and mauled to death by the suspect.
