Sec. 4. Any person desiring to manufacture, sell or distribute fireworks and other
pyrotechnic devices shall file his application for the issuance of license or business permit
with the Chief of PNP, through the provincial director of the province where the business or
project is located.
Sec. 5. Qualifications of Manufacturers or Dealers. — A license or permit to manufacture or
to deal in wholesale or retail of firecrackers and pyrotechnic devices shall be issued only to:
(a) Filipino citizens of good moral character; or (b) entities duly registered with the Bureau
of Commerce of the Department of Trade and Industry (DTI) or the Securities and
Exchange Commission (SEC), one hundred per centum (100%) of the capitalization of
which is owned by Filipino citizens.
Sec. 11. Penalties. — Any person who manufactures, sells, distributes or uses firecrackers
and other pyrotechnic devices in violation of the provisions of this Act shall be punished by
a fine of not less than P20,000.00 nor more than P30,000.00, or imprisonment of not less
than 6 months nor more than 1 year, or both such fine and imprisonment, at the discretion
of the court in addition to the cancellation of his license and business permit and the
confiscation by the Government of his inventory or stock.

RULE III
Sec. 1. Manufacturer’s License
Authority to possess explosive(s) ingredients for use in the manufacture of authorized and
allowable firecrackers and pyrotechnic devices for sale to the public. Further, a
manufacturer’s license is also deemed to be considered to possess a dealer’s license within
his manuafcturing comples only. Every manufacturer must have at least one license
pyrotechnician. The granting of a poyrotechnician’s license shall be based ion the level of
experience, training, expertise in the manufacture of firecrackers and pyrotech nic devices
and the completion of manufacturer’s training course provided by PNP Civil Security Group
(PNP CSG) or its duly accredited institution.

Sec. 2. Dealer’s License


Authority to possess authorized and allowable firecrackers and pyrotechnic devices for
sale to the public.

Sec. 3. Retailer’s Permit


For individuals selling firecrackers of not more than fifty (50) kilograms of finished
products and pyrotechnic devices of not more than five (500) kgs of finished products, a
Retailer’s Permit may be issued by the PNP. The authorization is given by a license dealer
of firecracker and pyrotechnic devices to the person who intends to retail his product/s
and the permit will be approved by the Chief, Firearms and Explosives Office (FEO) if
within Regions 1 2 3 4A 4B 5 CAR and NCR.
Sec. 7. Any person desiring to manufacture, sell or idistribute firecrackers or pyrotechnic
devices shall file his application with the Director, CSG through the Provincial Director of
the province or city where the business is located.

RULE IV
Sec 1. Manufacturer’s License
a. Prescribed applation form;
b. For a corp, Cert of registration with the SEC
For a single propriertorship or partnership, cert of registration with the DTI
c. Cert of Registration of business from City./Mun treasurer
d. For provincial applciants, endorsement from the Provincial/City Director
e. Business permit, police and court clearance
f. Special bank Receipt
g. Location sketch and floor plan of warehoise and site devt plan of the manufacturing
complex
h. Zoning certifiecate from City/Mun Engineer that the manufacturing complez is
located in the designated zone (300m away from the nearest residential unit
i. Prov Polica Office and/or FESAGSS Inspection Report with the properly labled
pcitures of the warehoise and manufacturing complex for provincial applicants
j. Cert from the BFP that the company has complied with the prescribed safety
measures;
k. Firewroks safetry training course (FSTC) Certificate by PNP CSG

Sec 2. Dealer’s License


a. Same requirements with manufacturers license except 1g and 1i;
b. Detailed lcoationm proper signage and floow plans of the store and the warehouse
c. Inspection report with properly labeled pictures of the store and the warehouse

Sec 3. Retailer’s Permit


a. Letter request establishing the exact address where the selling will be done
b. Certification from the dealer’s owner that theperson applying for retaileer is
authrorized by him;
c. Photocopy of Manufacturers/Dealer’s licebse
d. Brangay, Police, Court Clearance
e. Firewroks safetry training course (FSTC) Certificate by PNP CSG

RULE V

Sec 1. PNP, thru Firearms and Explosives Office, and other auithorized PNP Units/Offices,
shall have the sole authority to process approve or disapprove as the case may be,
applications for all kinds of licenses and permits;
