The Court has been left in an unusual posture since the decision of Deirdre Evavold to

“quit” participation as a defendant in this case (see Docket #72, letter dated September 27, 2019).

The Court thereafter by letter dated October 11, 2019, directed the parties to provide input on

how to proceed on these cases (Docket #82, Court le l9HA-CV-l 8-905).

State Farm takes the position, in an unhelpful response to the Court, that it should enter a

nding of no coverage (letter of October 7, 2019; led at Docket #77). The Court received

correspondence from plaintiff s counsel on October ll, 2019, concerning the abandonment of
the case by Deirdre Evavold requesting that the litigation continue, with State Farm coverage for

her client’s claims in this case.

The foregoing exchange, in response to the Court’s request, begat a fuller order of

November l, 2019, requiring the parties to either agree to a plan for disposition of these cases
going forward or if unable to agree, to set forth their respective positons, and a proposed

scheduling order.

Again, not surprisingly, the parties formally set forth What they disagreed about in

correspondence, in response to this Court’s order.

As a consequence of these divergent viewpoints, the Court is left Without the ability to

formulate a plan, as the parties cannot agree on the issues Which remain in these cases, the timing

of any future events, nor a process under which these matters can be directed to a fair and orderly

resolution. Consequently, the Court Orders as follows:

ORER

1. The trial date for l9HA-CV-18-4286 of February 3, 2020, is hereby stricken.

2. Parties are directed that henceforth, the caption for both cases, as it appears above, will be

used on all lings with the Court.

The remaining parties (excluding Deirdre Evavold) are directed to mediate the claims and

issues, on or before April 6, 2020 and report the results mediated, hereafter to the Court.

4. In the event these cases are not resolved at mediation, the remaining parties are directed to

appear before the Court on April 20, 2020 at 9:00 a.m. at the Dakota County District Court

in Hastings, Minnesota for a pre-tn'al conference.

The parties are advised that absent a prior resolution, these remaining cases/issues shall be

the subj ect to a trial setting, dependent upon the Court’s availability, in June of 2020.
