AFFIDAVIT

I, MONICO DEMETERIO, III, Filipino, of legal age, married and a resident

of San San Joaquin, Macrohon, Southern Leyte, after having been duly sworn
to in accordance with law, do hereby state:

1. That I am one of the heirs of the lot with Tax Declaration No. 07-08-017-
00056 declared under the name of Heirs of Monico Demeterio, located
at , Molopolo, Southern Leyte, with an area of 5,264 square meters;

2. That I personally know Manuel Mantilla, as he was a tenant of the said

lot for around ten years, since 2010;

3. That on January 5, 2017, Nestor Maturan, a neighbor of Manuel

Mantilla, approached and informed me that on December 19, 2016,
Manuel Mantilla hired Alejandro Bisaya to cut one (1) Gmelina tree
within the above-mentioned lot, without my knowledge and consent;

4. That on January 10, 2018, we went to the Lupon ng Tagapamayapa to

settle, but no settlement was reached, thus, a Certificate to File Action
was issued, such Certificate is hereto attached;

5. That I am executing this affidavit to attest the veracity of the foregoing

facts and for whatever legal purpose this may serve thereby.
