CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed by and


between:

FELECIDAD R. TELEBRICO, Filipino, of legal age and


with residence at 150, 29 De Agosto St., Brgy, Salapan, San
Juan City, duly represented herein by ROWENA TABOG,
Filipino, of legal age and with residence at
_______________________, herein after referred to as LESSOR.

-and-

___________________, Filipino, of legal age and with


Residence at ___________________, herein after referred to as
the LESSEE.

WHEREAS, the LESSOR is the absolute and registered


owner of Room No. _____ situated at 296 Masinop St.,
Extension Tawiran, Santolan, Pasig City, hereinafter referred
to as the LEASED PREMISES;

WHEREAS, LESSEE has offered to lease the Leased


Premises;

NOW, THEREFORE, for and in consideration of the


foregoing and mutual covenants herein contained, the
LESSOR has let and by these presents does hereby let and
lease unto the LESSEE the Leased Premises and the LESSEE
hereby accepts the same by way of Contract of Lease
subject to the following terms and conditions:
1. TERM

This contract of lease shall be for a period of six (6)


months, commencing on ____ day ___________ and expiring on
___ day of ____________, with an option to extend on part of
the LESSOR provided that the LESSEE has informed the
LESSOR at least thrity (30) days prior to the expiration of
this Contract of Lease and the terms and conditions are
acceptable to both parties. If the LESSEE wishes not to
renew this lease, the LESSEE must inform the LESSOR at
least sixty (30) days prior to expiration of this Contract of
Lease.

2. RENT

The parties herein agree that the rental for the Leased
Premises shall be payable every ____ day of every month
until the termination thereof, without necessity of demand,
at a monthly rate of ______________________ per month,
Philippine Currency.

Upon execution of this Contract of Lease, the LESSEE


shall give to the LESSOR Two (2) months security deposit in
the amount of ___________________________ and one (1) month of
advance rental in the amount of ______________________.

Provided that the aforesaid rent shall increase at the


rate of three percent (3%) upon renewal of this Contract of
Lease.

3. SECURITY DEPOSIT
The aforesaid deposit in the amount of
____________________, Philippine currency, equivalent to two (2)
months rental rate serves as guarantee for any unpaid bills
for water, electric, telephone, cable TV and other utilities, or
for any damage to the Leased Premises and all furnishings,
aside from natural wear and tear at the termination of this
Contract of Lease. Such amounts will be deducted from this
deposit and the balance, if any, shall be refunded to the
LESSEE thirty (30) days after the temination of this Contract
of Lease. It is further understood that the deposit shall in no
case be applied as rental.

4. NUMBER OF OCCUPANTS

The number of occupants in the Leased Premises shall


not exceed five (5) persons including the LESSEE.

5. CONDUCT OF LESSEE AND HIS HOUSEHOLD WITHIN


THE LEASED PREMISES

a. Upon the execution of this Contract of Lease, the


LESSOR shall hand over to the LESSEE one (1) set of
keys to the Leased Premises. The LESSEE shall not
allow any other person aside from him and the members
of his household to have copies of said keys. The
LESSEE shall surrender all his keys to the LESSOR at
the termination of this Contract of Lease. Provided that
if said keys are lost, the LESSEE shall pay the LESSOR
the amount of three hundred pesos (P300.00).

b. The LESSEE shall always keep the gate of the building


where the Leased Premises is located.
c. The LESSEE shall not let any person aside from him and
the members of his household inside the Leased
Premises without knowledge and consent of the
LESSOR.

d. The LESSEE shall be responsible to keep clean and


habitable the Leased Premises.

e. The LESSOR shall install an area designated for drying


of laundry. The LESSEE shall not dry his clothes at any
other area aside from the afore-mentioned designated
drying place. The LESSEE shall keep in mind his CO-
LESSEES and shall remove his laundry immediately
when it is dry. The LESSOR shall not be responsible for
any loss of laundry in the said designated drying place.

f. The LESSEE shall not install cables and wires without


knowledge and prior written consent of the LESSOR.

g. Pets are strictly prohibited in the Leased Premises.

h. The LESSEE shall keep all trash and garbage inside the
Leased Premises at all times which shall adhere to the
segregation policies of the City of Pasig. The LESSEE
shall put his segregated trash and garbage inside the
designated trash receptacle every _____________ of each
week.

6. WATER, ELECTRICITY, ETC.


All expenses for water, gas, electric current, telephone,
cable TV, air-conditioner units maintenance, internet
connection and all other utilities shall be for the account of
the LESSEE;

7. RESIDENTIAL PURPOSE

The LESSEE agrees that the Leased Premises shall be


used exclusively for residential purposes. The LESSEE shall
not sublease the Leased Premises or any portion thereof
without the prior written consent of the LESSOR;

8. STRUCTURAL CHANGES, ALTERATION AND


IMPROVEMENTS

The LESSEE shall not make any structural changes,


alterations or improvements in the Leased Premises without
the prior written consent of the LESSOR. This shall include
but not be limited to installation of nails, repainting and the
change of floorings, windows and doors.

9. SANITATION AND REPAIRS

The LESSEE shall keep the Leased Premises clean and


in sanitary condition and keep them at all times in very good
condition. The LESSOR shall be responsible for all major
repairs on the water, electrical and sewage installations
caused by ordinary wear and tear, except repairs due to the
fault or negligence of the LESSEE, members of household, or
visitors;

Minor repairs shall be for the account of the LESSEE.


For purposes of clarifying these provisions, major repairs are
those repairs costing above FIVE THOUSAND PESOS
(P5,000.00) while minor repairs are those each costing equal
or less than FIVE THOUSAND PESOS (P 5,000.00);

10. FIRE HAZARD AND OBNOXIOUS SUBSTANCES

The LESSEE shall not keep, deposit, or store in the


Leased Premises any obnoxious substance or inflammable
material or substance that might constitute a fire hazard;

11. TAXES AND INSURANCE

Real Estate and Government assessments shall be for


the LESSOR’s account. The LESSEE may at his option and
interest, secure an appropriate insurance policy over their
respective insurable interest on the Leased Premises
subject of this lease and in case of occurrence of the event
insured against, either partial or total loss or damage, The
LESSOR shall not be liable for such damage or loss. The
LESSEE shall shoulder his/her own damages and shall hold
the LESSOR free from any such liability.

12. THIRD PARTY LIABILITY

The LESSEE during her occupancy of the leased


premises shall hold the LESSOR free and harmless from any
damage or liability to any person or property arising out or
as consequence of the use of the Leased Premises by the
LESSEE, members of his household and guests. When such
damage or liability is caused by fortuitous events or acts of
God, such as typhoon, earthquake, flood, etc., which are
beyond the control of the LESSEE, the latter shall not be
liable to the LESSOR;

13. INSPECTION OF PREMISES


The LESSOR has the right to maintain the premises in
good and tenantable condition and for such purpose the
LESSOR reserves the right at reasonable times and with
advance notice to enter and inspect the premises and to
make the necessary repairs, caused by ordinary wear and
tear, thereof. The LESSEE likewise agrees to cooperate with
the LESSOR in keeping the said premises in good and
tenantable condition;

14. ENCUMBRANCES OF PREMISES

In the event of sale, transfer, mortgage, or any other


encumbrances of the Leased Premises, the LESSOR shall
advise in writing the purchaser, mortgagee or encumbrancee
that all the terms and conditions of this Contract of Lease,
including any provisions for renewal thereof shall be
respected;

15. TERMINATION OF LEASE

Violation of any provision of this Lease Contract shall


entitle the LESSOR the right to terminate this Contract of
Lease and the two (2) months security deposit shall be
forfeited in favor of the LESSOR.

If the LESSEE decides to terminate this Contract of


Lease prior to the period originally agreed upon, it is
mutually understood that a notice in writing of such
termination should be sent to the LESSOR at least sixty (60)
days before the projected terminal date and, the unused
advance rentals, if any, and the two (2) months deposit shall
be forfeited in favor of the LESSOR as and by way of
liquidated damages.
16. RETURN OF PREMISES

Upon termination of this contract for any reason


whatsoever, the LESSEE shall immediately vacate the
premises and return possession thereof to the LESSOR,
unless this Contract of Lease is extended. The LESSOR may
show the premises to prospective tenants two (2) months
prior to the expiration of the Contract of Lease at reasonable
hours.

17. VENUE OF ACTION

Any dispute arising out of this Contract of Lease shall


be filed in the proper court of Pasig City to the exclusion of
other courts and venue.

Any violation of the terms provided for in this Contract


of Lease on the part of the LESSOR or the LESSEE shall be
sufficient ground for the termination of this Contract of
Lease;

these presents on the date and at the place above-
mentioned or written.

This instrument refers to a Contract of Lease consisting

thereof.
