CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract made and entered by and between:

Department of Environment and Natural Resources– Provincial Environment and Natural

Resources(PENRO) Davao del Norte, a national government agency with office address at Km.
55, National Highway, Tagum City, Davao del Norte represented herein by OIC, PENR Officer
VICTOR T. BILLONES, herein referred to as the First Party;

- and -

ATTY. JONATHAN P. UYof legal age, Filipino and with residence address at Tagum
City, Davao del Norte, herein referred to as “Second Party”

WITNESSETH:

WHEREAS, the First Party is in need of the services of the Second Party who shall
render work not performed by the regular personnel of the First Party;

WHEREAS, the Second Party possesses the education, experience, and skills required to
render the services needed by the latter;

WHEREAS, the Second Party has signified his intention to which the First Party has
accepted, to provide the services needed by the latter;

WHEREAS, the Second Party hereby attests that he is not related within the third degree
of consanguinity or affinity to the: 1) hiring authority and/or 2) representative of the First Party;
that he has not been previously dismissed from government service by reason of an
administrative offense;

WHEREAS, it is understood that this Contract does not create an employer-employee

relationship between the First Party and the Second Party; that the service rendered hereunder are
not considered and will not be accredited as government service, and that the latter is not entitled
to benefits enjoyed by the regular personnel of the First Party;

WHEREAS, the Second Party shall perform work at a time and scheduled to be agreed
upon by both parties;

NOW, THEREFORE, both parties agree to the following:

Section 1. This Contract shall cover a period of five (5) months, that is, January 2, 2019
to June 30, 2019 and to be reckoned on the day of approval of acquiescence of Office of the
Solicitor General (OSG)

Section 2. The Second Party is hereby contracted as LAWYER and shall perform the
following :

a. Represent the PENR or CENR Offices(DENR) at hearings in the Court involving

DENR and its officials, in the performance of its functions;
b. Collaborate and assist the public prosecutors in the prosecution of criminal cases which
involved violations of laws on forestry, land, protected areas, biodiversity,
environment, mining, solid waste, and other environmental laws, rules and regulations;
c. Represent the PENR or the CENR Office and/or DENR officials and employees who
are respondents on certiorari mandamus, or prohibition proceedings;
d. Prepare pleading for and in behalf of the PENR or CENR Office;
 e. Examine the sufficiency of evidence and determine issues and legal course/s of action
to be taken, and assist the PENRO or CENRO in filing cases;
f. Provide legal and technical advice to PENR or CENR officers on official matters, and
assist the hearing officers on administrative proceedings handled by the DENR;
g. Take accountability on all documents, equipment and information received by him,
and maintain confidentiality of information and documents handled in the performance
of the herein tasks;
h. Avoid handling cases with conflict of interest; and
i. Perform such other related work that may be assigned by his immediate supervisor.

Section 3. For services rendered under this Contract, the Second Party shall be paid a
daily salary in the amount of Two Thousand One Hundred Seventy-One Pesos and Seventy-
Seven Centavo (P2,171.77), inclusive of tax, to be paid on monthly basis chargeable against
DENR Funds

For the purpose of payment for services rendered, the Second Party shall submit the
following to the PENR Officer:

a. Proof/Certification of services rendered

b. Detailed Accomplishment Report and
b. Certified true copy of Contract

Section 4.In view of the nature as well as the necessity of his tasks, the Second Party
shall be entitled to attendance to seminars, and actual transportation expenses chargeable to
DENR Funds, subject to the usual accounting and auditing rules and regulations.

Section 5. Supplemental guidelines will be provided through a memorandum issued by

the DENR Secretary.

Section 6. This Contract may be terminated by either party for any reason as may be
deemed appropriate before the expiration of the period indicated in Section 1 hereof, giving the
other party prior written notice not less than fifteen (15) days before the intended date of
termination.

IN WITNESS WHEREOF, both parties have hereunto set their hands this day of June
19, 2018, in Tagum City, Davao del Norte, Philippines.
