AFFIDAVIT
I, ________________________, married, Filipino, with residence address at
_______________________, after having been sworn to in accordance with law hereby
depose and state that:

1. I am offering to purchase from __________________ (“Company”) a house


and lot located at ______________________/condominium unit at
___________________(“Subject Property”).

2. In connection with the foregoing, I acknowledge that the Company fully


informed me that the consent of my spouse is a legal requirement for the purchase of
the Subject Property, or in the absence thereof, a judicial authorization to purchase or
judicial declaration of annulment of marriage or separation of property/ies.

3. I likewise acknowledge that the Company fully informed me that the


appropriate Registry of Deeds may not allow the transfer and registration of title to the
Subject Property in my name without the (i) express consent of my spouse to the
purchase of the Subject Property, or (ii) judicial authorization to purchase; or (iii) judicial
declaration of annulment of marriage or separation of property/ies.

4. In this regard, I hereby undertake to secure my spouse’s consent or, in the


absence thereof, secure a judicial authorization for the purpose, or judicial declaration
of annulment of marriage or separation of property/ies, and submit the same to the
Company at any time prior to the full payment of the purchase price of the Subject
Property.

5. In case of my failure to perform the foregoing undertaking, I remise,


release and forever discharge the Company, its officers, employees, stockholders,
directors and representatives, from any and all liabilities, suits or actions, including those
filed and claimed by my spouse, arising from or in connection with the purchase or
transaction due to the lack of such consent or judicial authorization, and I hereby hold
the Company its officers, employees, stockholders, directors and representatives, free
and harmless from any and all such suits, actions, claims or liabilities.

6. I acknowledge and agree that the Company shall, upon full payment of
the purchase price of the Subject Property, turn-over to me the title to the Subject
Property and all documents related to my purchase of the Subject Property, and it shall
be my responsibility to process, or cause the processing of, the transfer of the title to the
Subject Property from the Company in my name at my sole cost and expense. In which
case, the Company shall be deemed to have complied with all its obligations under all
contracts, agreements and documents related to my purchase of the Subject Property.

7. I likewise remise, release and forever discharge the Company its officers,
employees, stockholders, directors and representatives from all liabilities and obligations
should the title to the Subject Property is not, or cannot be, transferred in my name due
to the lack of such consent or judicial authorization/declaration.

8. In case the contract covering the said purchase is declared void,


cancelled or annulled by a court of competent authority by reason of the lack of such
consent or judicial authorization/declaration, I hereby waive my right to be reimbursed of
all payments made, inclusive of its interests and fruits, if any, and grant to the Company
the right to forfeit in its favor all payments made in connection with the said purchase.
Further, in the event that possession over the Subject Property is transferred to me, I
undertake to return to the Company full, actual, physical possession and/or ownership
over the Subject Property free from occupants, if any, and all kinds of liens and
encumbrances, without need of demand;

9. I manifest and acknowledge that the Company agreed to the purchase


and sale of the Subject Property in reliance to my representation and undertaking that
the required (i) express consent of my spouse to the purchase of the Subject Property, or
(ii) judicial authorization to purchase; or (iii) judicial declaration of annulment of marriage
or separation of property/ies; will be obtained prior to the full payment of the purchase
price of the Subject Property.
10. I finally declare that I have read and fully understand this Affidavit and is
hereby executed willingly and voluntarily, with full knowledge of my rights under the law.
