These are the terms and conditions (the 'Terms') on which we supply the 'Postgraduate Apply'
service (the 'Service') to Applicants and Agent.

It is important that you read these Terms carefully so that you are happy you understand their
content.
As an Applicant, we will ask you to confirm your agreement by ticking a box when you submit
the application ('Application') or if you are an Agent you will be asked to confirm the Applicant's
agreement, by ticking the box when you submit the Application. By ticking this box, we will
consider that the Applicant accepts these Terms, our website terms and conditions and our
privacy policy.

We are unable to process your Application until you do so.

It is important that the Applicant has read and understood all sections of our terms of use. If
you are acting as an Agent, before submitting an Application you must:

1 have all necessary authority to complete and submit the Application on behalf of the Applicant, and

2 ensure the Applicant has sufficient time to read and understand these Terms, our website terms and
conditions and our privacy policy.

3 We have the right to cancel an Application if we determine (having carried out any necessary checks), or
have reasonable belief, that an Agent has not fully complied with these conditions.

1 About UCAS
What we do and how to contact us.

1.1 We are the Universities and Colleges Admissions Service, a company incorporated in England and
Wales with company number 02839815, whose registered office is at Rosehill, New Barn Lane,
Cheltenham, Gloucestershire, GL52 3LZ ('UCAS', 'we', 'us').

1.2 You can contact us by telephoning our customer service team on 0371 334 4 447, emailing us at
webenquiries@ucas.ac.uk or by writing to us at the above address.

1.3 Our role is to provide application services for people applying for undergraduate and postgraduate
courses.

2 Provision of Service
Details of the Service we provide to you when you make an application to an education Provider.

The service UCAS provides


UCAS sends the completed Application to the Applicant's chosen course Providers.
This section explains when this Service starts and finishes.

2.1 We will begin the provision of the Service in connection with the Application to one or more education
Providers ('Provider'), on the date we accept the Application. The estimated completion date for the
provision of the Service is the earlier of: (i) two months from the course start date; or (ii) nine months
from the date you last used the Service.

2.2 Data about Providers and course data contained in the Service are supplied to enable completion of
the Application only, and do not constitute any form of advice or recommendation relating to any
particular course or Provider.

Course information may change. It is your responsibility to be aware of any changes
which may affect your application.

2.3 Data about Providers and course data contained in the Service reflects the most current information
known to UCAS. Providers may add, amend or cancel courses at any time. You should check each
time you use the Service, to see if there have been any changes made which may affect the
Application.

2.4 We will try to process Applications and decisions efficiently and accurately. However, we are not
responsible for mistakes, delays, or any loss or damage suffered by you, due to the acts or omissions
of Providers, or which are otherwise outside of our reasonable control. If our supply of the Service is
delayed by an event outside our control then, we will contact you as soon as possible to let you know
and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for
delays caused by the event, but if there is a risk of substantial delay, you may contact us to end the
contract.

Providers

3 Use of Service
Our Service is for your personal use - this section explains how to keep your information secure.

3.1 When using the Service, you may copy material (by printing off individual pages on to paper) for
purposes of making an Application only.

Using UCAS’ Service


You must only use the Service for making an Application for a postgraduate course.

You must not use this Service to make money.

You must not give UCAS usernames, passwords, or confidential information to other
people.

3.2 You must not:

3.2.1 use the Service for any commercial purpose other than assisting an individual with making an
Application; or

3.2.2 publish or disclose to any unauthorised person, any confidential information relating to the
Service, or any passwords or user names provided to you by UCAS, to enable the use of the
Service or our website.

4 Uploading content to your application


If you upload content to the application, you need to be aware of the following rules.

4.1 When you are invited to upload content the Applicant has created ('Content') you can do this by
submitting it to us via the Application. UCAS is not liable for technical, hardware, or software failures
of any kind or lost, inconsistent or unavailable network connections that may limit or prohibit Content
being uploaded. You warrant that you are legally entitled to upload the Content.
Content you upload
Anything you upload must belong to you, or be uploaded with permission from the
owner.

4.2 By uploading Content you confirm that it is the Applicant's own work. You undertake that, prior to
uploading any Content to the Application, you have permission, including any assignments, waivers,
licences, rights, consents, and permissions ('Permissions') in respect of anyone else's rights in or to
the Content (including, without limitation, all intellectual property rights, moral rights, performance
rights (which include any music used in your Content) rights to privacy, image rights and publicity
rights). UCAS reserves the right to require proof that all necessary Permissions have been given and
you agree, on request, to provide written evidence of those Permissions (including parental consent if
necessary) and perform such acts as UCAS may reasonably require.

By uploading, the Applicant grants UCAS permission to use the content in whatever way is
necessary to provide admissions services.

4.3 You agree that you will not upload any content which is illegal, defamatory, obscene, offensive, incites
prejudice or hatred or which it is unlawful for you to possess in the country in which you are resident,
or which it would be unlawful for us to use or to hold.

You agree to not upload anything illegal, malicious, or offensive. Content will be scanned for viruses,
and may be removed if it poses a risk.

4.4 We may scan content you upload for viruses and other malicious content and, without notice to you,
delete any content that we consider may contain such malicious content. You will make all reasonable
efforts to minimise the risk that any content you upload contains viruses or other malicious content.

4.5 Any content you upload to the Application must comply with rules regarding the size, specification,
format and type of acceptable content, and any other limitations we bring to your attention by screen
and/or help text on the Application, or otherwise by other means.

4.6 You warrant that any content uploaded by you shall fully comply with these Terms, and you will be
liable to us and indemnify us for any breach of that warranty. If you are in any doubt about your
content then you should not upload it.

4.7 We shall be entitled to disclose your or the Applicant's identity to any third party who claims that any
content uploaded by you infringes their rights.

4.8 We shall not be liable for any loss, deletion or damage to content uploaded to the Application. You
should keep a copy of all content you upload.

UCAS is not responsible for any loss of content you or your Agent uploads to the application.
4.9 We may allow you to remove content that you have uploaded to the Application. If you remove
content, you acknowledge that this may adversely affect the Application. For example, a Provider may
no longer have the necessary information to consider the Application.

You may remove content after uploading it, though this may impact the Application.

5 Your application
You need to be aware of the rules for making an application, and the importance of complying
with them.

Rules of making an application


If the Applicant holds more than one place, the Applicant must let the other Provider(s)
know you will not be enrolling on their course.

5.1 Postgraduate Apply will allow an Applicant to hold and be enrolled on two or more courses
simultaneously. If an Applicant finds themself in this position, the Applicant or Agent must confirm the
Applicant's attendance with the Provider for the course the Applicant is going to attend, and notify any
other Providers that the Applicant is withdrawing the Application.

5.2 If we need to verify the Applicant's identity, we may use details in the Application in order to make
checks using official, publicly-available or commercially-available identity checking services. If any
adverse information is revealed about the Applicant, we will let the Applicant know so that gives the
Applicant the opportunity to respond.

5.3 We and/or the Provider may, at any time, ask the Applicant, Agent, referee, or employer to provide
more information about the Application. For example, we may need to see proof of the Applicant's:

The Applicant, or their referee, may be asked to provide further details, or verify their
identity.

If UCAS does not receive this information within a reasonable timeframe, the
Application may be cancelled.

5.4 If we do not receive this information within a reasonable period of time, or if the information is not
satisfactory, we may cancel the Application. If the Application is cancelled by UCAS, the Applicant will
not be able to submit another Application for entry in the same admissions cycle.

5.5 The personal statement must be completed by the Applicant and we may undertake checks to verify
that it is the Applicant's own work. If the Applicant's personal statement includes material that
appears to have been copied from another source, we may notify the Applicant's current school,
college, or other UCAS-registered adviser (where you have given permission for UCAS to share such
information) and the Providers to which the Applicant has applied, whose decision it will be to take
what action they consider appropriate.

The Applicant must write their own personal statement. UCAS checks all applications for
plagiarism. In the event plagiarism is detected, UCAS may contact the Applicant's school and/or
chosen university or college.

5.6 If we, or a Provider, have any reason to believe that the Applicant or the Applicant's referee has:

5.6.1 left out any relevant information, including qualifications the Applicant has completed,
qualifications with an unsuccessful grade, qualifications for which the Applicant is still
awaiting results, or schools or colleges that the Applicant has attended

UCAS may investigate any potentially missing and/or misleading information in the Application.

5.6.2 given false or misleading information

we may take any necessary steps to check with the Applicant and other parties, including
Providers, and examination and awarding bodies, whether the information provided is accurate
and/or complete.

5.7 If you have any reason to believe that information we hold about the Applicant is not true, complete
and/or accurate, you must tell us.

5.8 We have the right to cancel the Application if we determine (having carried out any necessary checks),
or have reasonable belief, that the Application contains false or misleading information, or that any
relevant information has been left out.

UCAS has the right to cancel applications suspected of containing false information.

6 Applicant personal information


This section describes how we use application data. We will ensure that we use the personal
information shared with us in a way that complies with the Data Protection Act 2018.
6.1 When submitting the Application, you confirm that the information you have given is complete and
accurate. When you agree to these Terms, by ticking a box to submit the Application, you will be
confirming that you (and the Applicant if applicable) understand how the Applicant's personal
information will be used, as explained in these Terms and our privacy policy

Submitting the application


By submitting the application, you are declaring the information provided is accurate
and complete.

6.2 The Applicant grants to us a licence (including the right to sub-license) to use all data, text,
information, or other materials, which you provide to us in connection with the use of the Service and
the Application ('Application Data') to:

6.2.1 process, store, and electronically reproduce the Application Data, and display the Application
Data on the Service; and

By submitting the application, you give UCAS permission to process and store it.

6.2.2 reproduce and distribute, through any media now known, or hereafter developed, excerpts of
the Application Data to Providers chosen by the Applicant as part of the Application, and any
other agreed third parties

6.3 When the Applicant applies, we may use the Applicant's personal information for the following
purposes:

As part of assessing the Application, details may be shared with:

• course Providers

• awarding bodies

• professional bodies

• UK Visas and Immigration (UKVI)

6.3.1 Managing applications to postgraduate education

a We share personal information from the Application with the universities and colleges
applied to, so that they can consider and process the Application.

b We may correspond with the Applicant's examination board or awarding organisation


about the Applicant's results and we may undertake surveys they may commission on
their behalf.

c We will, if appropriate, share information with relevant professional and regulatory bodies
in connection with enquiries relating to the Applicant's fitness to practice.

d For international Applicants, we may share personal information with UK Visas and
Immigration (UKVI) in connection with verification procedures for the Applicant's entry into
the United Kingdom for study purposes.

6.3.2 Reporting to organisations with responsibilities for higher education

a Personal information may be provided to organisations who have either statutory or


regulatory responsibilities for ensuring the effective operation of the higher education
sector or monitoring the effectiveness of government policies for higher education. We
will only supply personal information that identifies the Applicant for these purposes. If the
provision of statistical analysis is not suitable, the disclosure will not have a direct impact
on the Application and the uses of personal information provided are agreed under
contract.

The Applicant's information may also be shared with government regulatory bodies. This will not
affect the Application.

b Providing statistical analysis to the higher education sector

Anonymous information from the Application will be used to provide statistical analysis of the
higher education (HE) sector.

c We will retain a copy of the Application and use it, sometimes in combination with other
information we hold, for the purpose of producing statistical analysis and research in
respect of the admissions schemes managed by UCAS. Any statistical analysis reports
published will not allow any individual to be identified.

6.3.3 Other uses of personal information

UCAS may use the Applicant's information to prevent or detect crimes.

UCAS may use the Applicant's contact information to send you targeted messages and
surveys.

a Prevention and detection of crime — to prevent and detect crimes of any nature, we may
share personal information we hold with relevant bodies, such as government
departments, local authorities, the NHS, law enforcement agencies, student finance
bodies, examination and awarding bodies, professional bodies and other international
admissions organisations.
b Surveys — we may send the Applicant surveys to ask for opinions or to inform Applicants
about the development of UCAS' admissions services and admissions to higher education.
Survey responses will not be disclosed by UCAS to anyone else in a manner that identifies
any Applicant.

c Uses required or permitted by law — we may also share personal information we hold
where we are required or permitted to do so by law.

6.3.4 You should refer to our privacy policy for further details about how we use personal
information, including the following:

a Our use of personal information considered sensitive under Data Protection legislation,
such as ethnicity or criminal convictions

Diversity information
We use sensitive personal information to monitor equality of entry to universities.

Disability information allows universities to arrange support for any needs the
Applicant may have. These answers will not affect the Application.

7 Cancellation
You have the right to cancel the Application.

You can cancel the application if you want to.

7.1 You have the right to cancel the Application. To do this, login to your profile or contact us.

8 Offers
An offer contains important information, which is likely to form the basis of the Applicant's
contract with the education Provider ('Offer').

8.1 When you receive an Offer, the Provider which has made the Offer, should also provide, or make
available, the 'pre-contract' information which is required under consumer protection legislation. This
information should include, amongst other things, relevant information about course information and
costs, such as tuition fees and any other relevant costs, such as for field trips or specialist equipment
required for the course, arrangements for making payments to the university or college, and their
complaints handling process, including the Applicant's right to cancel their contract should they
change their mind. The Provider should also provide information about their terms, rules, and
regulations relating to student conduct, which explain the Applicant's rights and obligations to the
Provider and, likewise their obligations to the Applicant, as a student at their institution.

Offers from universities


If they make an offer, the course Provider will send the Applicant a contract.

8.2 The Applicant should read and understand this information before making a decision about an Offer,
as this is likely to form the terms and conditions of the contract between the Applicant and the
Provider if the Applicant subsequently enrol there. If the Applicant does not receive the required
information, or the Applicant wishes to make a complaint, or if the Applicant is not clear about
anything relating to the Offer and the information provided, the Applicant should contact the Provider
directly to ask for further advice.

8.3 If the Applicant becomes a student, under the contract with the Provider, they must do all they can to
provide the educational services in accordance with the contract that the Applicant has with them. If
the Provider is unable to provide these services for any reason, they should do all they can to keep the
disruption to the Applicant's education to a minimum, for example, by offering the Applicant a place
on a suitable alternative course, or providing assistance to help you find a suitable alternative place
elsewhere.

If the Applicant meets the Provider's conditions, the Provider has to honour the contract. This
section explains the Provider's obligation to provide the Applicant with educational services.

9 Termination
Details of how and when our Service terminates, and our complaints procedure.

Termination
UCAS’ Service ends after the course begins, or after a period of inactivity.

This section explains when UCAS has the right to cancel the Application.
9.1 The agreement between the Applicant and UCAS will terminate automatically on the earlier of: (i) two
months from the course start date; or (ii) nine months from the date the Applicant last used the
Service.

9.2 UCAS shall have the right to cancel the Application and terminate use of the Service immediately, if
you fail to comply with these Terms.

9.3 If for any reason we cancel the Application the Applicant has the right to appeal. Further information
on how to appeal is given at the time of cancellation. All appeals will be considered within a
reasonable time by an independent and senior member of staff not involved in the initial decision to
cancel. An appeal may be either upheld in which case the Application will be reinstated, or dismissed
in which case the Application will remain cancelled. We will let the Applicant know the outcome of the
appeal as soon as possible.

You may appeal a cancellation, and the Application may be reinstated.

9.4 The appeal process relates only to Applicants whose Application has been cancelled by us. If you are
not happy with some other aspect of our service, please follow the separate complaints procedure.
