The act was a special legislation for the product liability in respect of any adverse event
in smart city involving artificial intelligence and robotics.
2. The commissioner appointed under the act was vested with judicial powers and had
exclusive jurisdiction to assess the matter and hear the parties in case of any adverse
event involving artificial intelligence and robotics.
3. In the present case, the Safecargo truck was articulated intermodal truck powered by
Artificial Intelligence.
4. In the present case truck commenced its journey from Saharanpur on Amritsar- Kolkata
Industrial Corridor to reach Kanpur driven by Mr. Gulshan Singh.
5. However when the truck entered the Smart City of Greater Noida it was switched to
autonomous mode based on Artificial intelligence as per the protocol of the smart city.
6. When the accident occurred the truck was in the territory of the smart city of greater
Noida running of autonomous mode driven by AI. Which steered the truck thereby
causing the accident.
7. Since the accident happened in the smart city. Therefore, the cause of action arose in the
smart city hence, the commissioner appointed has the appropriate jurisdiction over the
matter and has the competent authority to try the matter in hand.
