OF ESTATE OF THE LATE HONORATO A. SANTOS

WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH WAIVER OF

RIGHTS made and executed this _______________ 2019 by and between:

_______________, of legal age, Filipino, widow and a resident of _________________;

_______________, of legal age, Filipino, widow and a resident of _________________;

_____________, of legal age, Filipino, married to _____________ and a resident of

______________;

Together, they are referred to herein as PARTIES.

WITNESSETH: THAT –

WHEREAS, on ____________, _________________ (hereinafter “the Decedent”), died

intestate at ______________________;

WHEREAS, the above-named Parties, ______________, _______________, and

_________________, are the legitimate, primary and compulsory heirs of the Decedent;

WHEREAS, the Decedent at the time of his death left TCT No. ___________ under his name
and CCT No. _____ under the name of his surviving spouse acquired during their marriage, herein
described as follows:

1. Transfer Certificate of Title No. ______ of the Registry of Deeds for the Province
of __________, registered under the name of __________, married to ___________,
more particularly described as follows:

“A parcel of land (Lot _____ of the subd. Plan (LRC) Psd-_________being a portion
xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx

2. Condominium Certificate of Title No. _______ of the Registry of Deeds for

Makati, Metro Manila, registered under the name of _______________, married to
_________________, more particularly described as follows:

WHEREAS, to the best information and knowledge of the Parties hereto, the Decedent left no
will;

NOW, THEREFORE, pursuant to the provisions of Section 1, Rule 74 of the Rules of Court of
the Philippines, the Parties hereto, being of legal ages and with full civil capacity to contract, agree to
adjudicate among themselves one-half (1/2) share of the Decedent in the subject properties, in equal
shares. The surviving spouse and heir, ____________________, voluntarily renounces all her interests,
rights and claims over her share of the Decedent’s properties in favor of her children, herein all the other
Parties, distributed equally;

FURTHER, contingent liabilities to creditors, heirs or other persons who might have been
deprived of lawful participation in the estate of the Decedent for a period of two (2) years from and after
settlement and distribution thereof shall be settled, in accordance with the provisions of Section 4, Rule 74
of the Rules of Court;
 The heirs, _____________ and _____________, executed a Special Power of Attorney in favor of
their siblings and co-heirs ___________________ and _________________, to be their Attorneys-in-Fact
and to act on their behalf in the execution and registration of this Extrajudicial Settlement of the Estate of
the Decedent with Waiver of Rights, over the properties described above. A copy of the Special Power of
Attorney is hereto attached as Annex “A” to form an integral part hereof;

The notice of this Deed will be published once a week for three (3) consecutive weeks in a
newspaper of general circulation;

The Parties hereby warrant valid title to and peaceful possessions of the subject properties
conveyed herein;

IN WITNESS WHEREOF, the Parties hereto have hereunto set their hands on this
