WHEREAS, on March 11, 2019, the President of the Republic of the

Philippines approved Republic Act No. 11243 (RA 11243), entitled “An Act
Reapportioning the First Legislative District of the Province of South
Cotabato Thereby Creating the Lone Legislative District of General Santos
City”

WHEREAS, Section 3 of R.A. No. 11243 also states that the Commission on
Elections (Commission) shall issue the necessary rules and regulations to
implement the law within thirty (30) days after its effectivity.

WHEREAS, Article VI, Section 9 of 1987 Philippine Constitution states that

“In case of vacancy in the Senate or in the House of Representatives, a
special election may be called to fill such vacancy in the manner prescribed
by law, but the Senator or Member of the House of Representatives thus
elected shall serve only for the unexpired term.”

WHEREAS, Commission on Election Resolution No. 10542 Section 3 (a)

suspends the election of Representatives for the First Legislative District,
including General Santos City, in the Province of South Cotabato, scheduled
on May 13, 2019. In case the position for Member, House of Representatives
in the First District, including General Santos City, is voted upon in May 13,
2019 elections, all votes for the said position shall be considered stray.

WHEREAS, Section 3 (b) of the same Commission Resolution sets the first
regular election for the new Representatives of the First and Third Legislative
Districts of the Province of South Cotabato, within six (6) months from May
13, 2019.

WHEREAS, there is need of representation of Legislative District of General

Santos City in the House Representative to provisionally fill its vacancy till
the new representative will be elected within six (6) months from May 13,
2019 election.

WHEREAS, the Sangguniang Panlungsod of General Santos City requesting

the House of Representative to appoint Honorable Rogelio Pacquiao, a
former ex-officio member of the Council of General Santos from 2014-2016,
as interim caretaker of General Santos City to embody the voice of Generals
in the Congress.
