9 INSTITUTIONALIZING THE NATIONAL POLICY ON THE MANAGEMENT
10 OF DEAD BODIES AND MISSING PERSONS DURING NATURAL
11 DISASTERS AND CATASTROPHE.

15 WHEREAS, it is a basic human right that every individual deserves a proper
16 and dignified management of his/her remains regardless of creed, ethnicity,
17 race and religious beliefs;

19 WHEREAS, Section 2 (j) of R.A. 10121 declares it a policy of the State to
20 ensure that disaster risk reduction and climate change measures are gender
21 responsive, sensitive to indigenous knowledge systems, and respectful of
22 “human rights;”

24 WHEREAS, each year the Philippines is beset with natural disasters some of
25 which is of such magnitude as to cause huge damages and mass deaths.
26 Oftentimes, the nation was overwhelmed by the devastation leading to
27 difficulties in handling mass casualties;

29 WHEREAS, the management of the dead is one of the most difficult part of
30 disaster management. As such, there is a need to develop a systematic
31 and universal approach in handling dead bodies from their recovery,
32 identification, transfer and final disposal in consideration of the legal
33 requisites, cultural and religious beliefs and norms which will guarantee the
34 respect for the dignity of the deceased and the rights of their respective
35 families;

37 WHEREAS, the National Disaster Risk Reduction and Management Council
38 (NDRRMC) in the exercise of its power and function of policy-making under
39 Section 6 (l) of R.A. 10121 is mandated to formulate a national institutional
40 capability building program for disaster risk reduction and management to
41 address the “specific weaknesses of various government agencies and
42 LGUs,” based on the results of a biennial baseline assessment and studies;

44 WHEREAS, the Office of Civil Defense as operating arm of the NDRRMC
45 under Section 9 of R.A. 10121 shall develop and ensure the implementation
46 of national standards in carrying out disaster risk reduction programs

47 including preparedness, mitigation, prevention, response and rehabilitation
48 works;

50 WHEREAS, a national policy framework shall be provided which shall served
51 as guide to an efficient and well coordinated action in managing the dead
52 and missing persons during emergencies and disasters, strengthen
53 coordination among various government agencies and stakeholders and
54 provide guidelines, standards, systems and procedures in the management
55 of the dead and missing persons;

58 NOW, THEREFORE I, BENIGNO SIMEON C. AQUINO III, President of the
59 Philippines, by virtue of the powers vested in me by law, do hereby order:

62 SECTION 1. Framework for MDM. The NDRRMC shall formulate a
63 national policy framework which shall provide for a comprehensive, multi-
64 sectoral, inter-agency and community-based approach to the management
65 of the dead and missing persons during disasters and national emergencies.

67 SECTION 2. National Guideline. The OCD shall develop a national
68 guideline that will be adopted by the Council which shall apply to the latter,
69 LGUs, NGOs, private organizations and all other stakeholders whose
70 activities contributes to the MDM.

72 SECTION 3. Technical Group. A technical management group is hereby
73 created as may be designated by the Council that shall assess the
74 implementation of the guidelines and shall coordinate and effectively
75 manage the national efforts on the MDM.

77 SECTION 4. Separability Clause. If any provision of this Executive
78 Order is declared invalid or unconstitutional, the other provisions not affected
79 thereby shall remain valid and subsisting.

81 SECTION 5. This order shall take effect immediately.
