STATEMENT OF FACTS

1. Respondent Don Gervacio Emission Center is a grantee of a Certificate of

Authorization to operate a Private Emission Testing Center (PETC) while
Respondents Marjun B Torres and Rey Clifford Hingpit are the PETC’s Motor
Vehicle Emission Control Technicians (MVECT)

2. Sometime in April 2019, the Franchise Review Staff (FRS) of this Honorable
Office issued a Show-Cause Order to the herein Respondents, per
recommendation of the Investigation, Security and Law Enforcement Staff
(ISLES). The ISLES accordingly has found substantial evidence that herein
Respondents “uploaded images of motor vehicles which are faked, altered or
manipulated to make it appear that motor vehicles subject for inspection/registration
underwent actual tests”

4. Whether or not uploaded images of disconnected test probe is substantial
evidence, warranting the cancellation of the Certificate of Authorization of the
Respondents.
