GENERAL TERMS AND CONDITION

1. Any changes to the quotation shall be charged accordingly.

2. Prices are subject to change without prior notice.

3. Kima Glass shall not be liable for any delays in the project when the customer site is not ready for installation or due
to unavoidable and unforeseen circumstances not attributed to any fault of Kima Glass. Furthermore, Kima Glass
reserved the right to withhold installation or delivery when by its judgement, the site is not deemed fit for delivery and
installation. Such delays will be held against Kima Glass.

4. Kima Glass retains ownership of the materials delivered and/or installed unless the final billing is paid in full.

5. In case of non-payment by the customer, Kima Glass has the right to remove and withdraw the materials (delivered
and/or installed) from the customer site without demand unless the final billing is paid in full.

6. Twelve percent (12%) interest per annum will be charged on all overdue accounts plus twenty-five percent (25%) of
said amount for attorney’s fee and cost of collection in case of suit. Parties submit themselves to any court of Cebu,
Philippines should any legal action arise out of this transaction.

7. Shipment of goods is at customer risk and cost. Delivery outside the following city limits (Cebu, Mandaue, Talisay
and Lapu-lapu) will be charge accordingly.

8. Kima Glass shall not to be responsible for any loss and/or damage to materials furnished by others.

9. Customer or his authorized representative shall be responsible for the safekeeping and preservation of delivered and
installed during off-hours in the installation period.

10. keys to the locks of all units will be surrendered only upon full payment.

11. Masonry and carpentry works are not included in our scope of work. Customer or his/her general contract shall
provide Kima Glass with a finished opening that must be plumb, square and level.

12. The Customer without charge shall provide scaffoldings and access to electrical outlets.

PAYMENT TERMS AND CONDITIONS

1. A 50% deposit of the total contract amount is required upon acceptance and signing of contract. An additional
20% progress payment is required upon payment is required PRIOR to FIRST delivery and the balance of 30%
shall be billed upon completion or for further progress billing whichever is applicable.
2. For Job Orders worth P 100,000.00 and below, a deposit of 70% of the total contract amount is required and
the balance of 30% shall be billed upon completion.
3. For out of town Job Orders, full payment prior to shipment is required. Job Orders are considered out of town
when the location of the project is outside Cebu province.
4. This payment terms and conditions is not applicable to repair services.
WARRANTY
1. Kima Glass warrants to the customer a six (6) months on labor and materials from the date of that under
normal use these products will be free from defects in workmanship and quality. The warranty will cover any
adjustment, alignment or replacement as result of improper installation or product defect.
2. All warranty claims are subject to inspection by Kima Glass. Tarnishing and fading are considered to be
products of normal use and wear and hence they are not covered in the warranty.
3. Warranty does not cover silvering defects, discoloration, black spots or clouding of the silver film for mirrors.
Such is the natural property of mirrors when exposed to moisture.
4. Warranty does not cover silicone sealant that has been stained in any fashion, as this situation is not due to
the products nor application, but an environmental and external factor that cannot be controlled by anyone
other than the user. If seal is broken due to misuse, gouging or other environmentally or externally related
abuse, the warranty will be voided.
5. No warranty herein covers broken glass and other damages and/or defects resulting from abuse, negligence
abnormal or unreasonable use (including failure to provide reasonable and necessary maintenance), fire or
lighting windstorms, earthquakes, other acts of God or others caused beyond the control of Kima Glass except
as warranted.
6. This warranty does not cover repair services.
