OMtice of the President of the Philippines PRESIDENTIAL MANAGEMENT STAFF Malacafiang PMS BIDS AND AWARDS COMMITTEE Resolution No. 103, Series of 2017 RECOMMENDING THE EXTENSION OF THE LEASE CONTRACT BETWEEN THE PRESIDENTIAL MANAGEMENT STAFF AND MR. MARCON Y. CHU ON A MONTH-TO-MONTH BASIS UNTIL THE COMPLETION OF THE PROCUREMENT PROCESS THEREFOR WHEREAS, pursuant to Presidential Management Staff (PMS)-Bids and Awards Committee (BAC) Resolution No. 44, s. 2016' (Annex A), the PMS awarded to Mr. Marcon Y. Chu a one-year contract for the lease of office space located at the Marcon Bldg., Capitol Drive, Butuan, City for the PMS-Regional Field Unit (RFU) XIII in the amount of P300,000.00, to expire on 31 December 2017 (Annex B); WHEREAS, through a Memorandum addressed to the PMS-BAC dated 18 December 2017, and which was received on 21 December 2017, the Officer-in- Charge, Office of the Team Leader, RFU Xill, requested for an extension of the above lease contract for three (3) months or from 01 January 2018 to 31 March 2018 (Annex Cc); WHEREAS, pursuant to the 2016 Revised Implementing Rules and Regulations of Republic Act No. 9184, the earliest possible time for procurement of services, which includes lease, is twenty-six (26) days? (Annex D); WHEREAS, to ensure the continuity of the operations of the PMS-RFU Xill, there is an imperative need to extend the lease contract between the PMS and Mr. Chu; WHEREAS, the Government Procurement Policy Board (GPPB) issued Resolution No. 023-2007, entitled “Approving and Adopting the Revised Guidelines on the Extension of Contracts for General Support Services’. Item no. 4.0 thereof reads in pertinent part: “4.0 GENERAL CONDITIONS FOR EXTENSION Procuring entities may extend the duration or effectivity of an ongoing contract about to expire, under the following conditions: 41 xxxx 4.2 The original contract subject of the extension was awarded in accordance with the provisions of Republic Act 9184 (R.A. 9184) and its Implementing Rules and Regulations Part A (IRR- A). Entitled “Recommending the Award of Contract to Mr. Marcon Y. Chu for the Lease of Office Space for the PMS Regional Field Unit XIll for one (1) year. 2 Notably, the 26-calendar day period excludes the preparation of bid documents to be issued to prospective lessors. In contrast, it includes weekends and holidays 43 XKXK 44 XxKxKx 4.5 The contemplated extension is merely an emergency measure to maintain status quo in the operations of the Procuring Entity and to avoid interruption of service. 4.6 The current service provider has not violated any of the provisions of the original contract. 4.7 The terms and conditions of the original contract shall not be changed or modified, except when changes or modifications will redound to the advantage of the government at no additional cost to the Procuring Entity.” (Emphasis supplied) WHEREAS, the contemplated extension is merely an emergency measure to maintain status quo and avert hiatus in the delivery of the PMS-RFU XIll's outputs for the Presidency; and WHEREAS, all contract extensions shall be subject to the prior approval of the Head of the Procuring Entity or his/her duly authorized representative upon recommendation of the BAC. NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the PMS-BAC, hereby RECOMMEND to the Assistant Secretary for Administrative Support pursuant to Office Order No. 2016-173, the extension of the lease contract between the PMS and Mr. Chu on a month-to-month basis, not to exceed six (6) months, until the completion of the procurement process therefor.
