JOINT AFFIDAVIT OF APPREHENSION

We, PCpl Antonio Santos and PCpl Eduardo Perez of Gandara PCP, of legal ages
bona fide members of the Philippine National Police presently assigned as Beat Patroller
of Binondo Police Station 11 (PS-11) manila Police District, with office address at Felipe
St., Cor. Meisic St., Binondo, Manila, after having duly sworn to in accordance with the
law. Do hereby depose and state THAT:

1. At about 1 o’clock in the morning of August 17, 2019, along Tambacan St.,
Binondo, Manila, Brgy. 298, Zone 29, we arrested HENRY MANLAPAZ y DIMAGIBA
Alias KANO and FERDINAND PAPA y SAN MATEO Alias PAPA for violation of P.D.
1602 or Illegal gambling (Cara Y Cruz), to wit:

R1 or Respondent 1 – HENRY MANLAPAZ y DIMAGIBA Alias KANO,


male, Filipino, of legal age, single, residing at 725 Interior 44 Laong Nasa St., Brgy.
155 Tondo, Manila.

R2 or Respondent 2 – FERDINAND PAPA y SAN MATEO Alias PAPA,


male, Filipino, of legal age, single, residing at 800 Pilapil St., Brgy 51, Tondo,
Manila.

(BOTH UNDER CUSTODY)

2. Prior to the apprehension of the above-named persons, the undersigned were


conducting motorized patrol along Tambacan St., when we noticed three (3) male
persons sitting on the pavement in a circling position. We drive near them and when we
were about to approach the respondents we saw and observed that one of the male
persons (later identified as R1 – HENRY) is tossing three (3) pieces of coins in the air
while the two other persons (later identified as R2 – FERDINAND and One (1) Alyas
BADONG – At Large) are placing their bets in front of them. We alighted from our motor
vehicle and carefully observed from a distance the trio, and noticed that said persons
were playing (Cara Y Cruz) a game of chance which is contrary to law. This prompted us
to move cautiously to their back and when we were about to approach the trio, suddenly
Alyas BADONG who was facing towards the undersigned, immediately grabbed pieces
of bet money (undetermined amount) on the pavement and shouted verbally “PARAK
PARE TAKBO!” and ran towards Ongpin St. I, (PCpl Santos) instead of chasing the
fleeting respondent (BADONG) shouted verbally “WALANG TATAKBO” and immediately
ran and hold (R1 – HENRY) from his right shoulder while reaching his left arm and
effected his arrest while, I, (PCpl Perez) ran and grabbed the right arm of R2 –
FERDINAND who was attempting to run. Due to the fact that the undersigned were
outnumbered, respondent Alyas BADONG managed to escape. Thereafter, I, (PCpl
Perez) recovered from the pavement in front of the respondents were: three (3) pieces of
One Peso coin used as flippers later marked as CARA with signature and 8-17-19; and
pieces of bet money amounting to Sixty Pesos (Php60.00) in Twenty Peso Bill
denominations (later marked as CARA1, CARA2, CARA3 with signature and 8-17-19).
Meanwhile, I, (PCpl Santos) while holding R1 – HENRY instructed the same to stood up.
I, visibly noticed a bulge on the right waist of R1 – HENRY. I, (PCpl Santos), felt a hard
handle like tucked and then slowly frisk the bulge part. I, (PCpl Santos), then slowly lift
his shirt and discovered a firearm tucked inside R1 – HENRY’s right waist. I, (PCpl
Santos) then handcuffed R1 – HENRY and confiscate a Caliber 9mm Pistol Made in
China by NORINCO Model 213 with serial number 49102255 (later marked as HM). After
carefully examining the said firearm, I, (PCpl Santos) released the magazine (later
marked as HM2) containing two (2) pieces of cal. 9mm live ammunition (later marked as
HM3 and HM4) from the firearm discovered that the firearm was chamber loaded with
one (1) piece of cal. 9mm live ammunition (later marked as HM1). At that moment, I, (PCpl
Perez) decided to recovered the pieces of bet money respondents’ R1 – HENRY and R2
– FERDINAND were holding. I, (PCpl Perez) recovered from R1 – HENRY were: One (1)
piece of One Hundred Peso Bill (later marked as HM5 with signature and 8-17-19) and
one (1) piece of Fifty Peso Bill (later marked as HM6 with signature and 8-17-19). I,
(PCpl Perez) also recovered from R2 – FERDINAND was a One Hundred Peso Bill (later
marked as FP with signature and 8/17/19).

3. As a Standard Operating Procedure, we informed the respondents of their


Miranda rights and their violation. We performed frisking to search again for any sharp
objects or any deadly weapon we might confiscate. The undersigned later asked the
respondents to empty all pockets of their short pants for safety reason which they
voluntarily complied. I, (PCpl Perez) recovered from the right hand of R1 – HENRY a
piece of small heated-sealed transparent plastic sachet containing white crystalline
substance believed to be Methamphetamine Chloride or “Shabu” (later marked as HM7
with signature and 8-17-19) coming out from his short pants right front pocket. Also, I,
(PCpl Perez) recovered from the right hand of R2 – FERDINAND was a piece of small
heat-sealed transparent plastic sachet containing white crystalline substance believed to
be shabu (later marked as FP1 with signature and 8-17-19) coming out from his short
pants right front pocket. Thereafter, respondents were apprised of their Constitutional
Rights in TAGALOG (A language known by them) and the nature of the charges being
imputed against them but they opted to remain silent.

4. In compliance with the requirements of Section 21(1) of RA 9165, as amended


and its IRR, the undersigned immediately call the attention of the Barangay Officials in
the area and a media representative to witness the markings of the recovered evidence.
We also notify the Duty Investigator (PCpl Allan Nakita) of the incident. The markings,
inventory and taking of photographs were conducted by the undersigned in the area were
the respondents were apprehended and were witnessed by Mr. Danny Lopez, a media
practitioner and Ms. Elizabeth Sy, Brgy Kagawad of Manila, Mr.Francisco Landicho,
representative from Manila City Hall and Atty. Lorenz Carpio, DOJ representative, in the
presence of the undersigned, PCpl Antonio Santos and PCpl Eduardo Perez of Gandara
PCP, and above named arrested respondents. (We later provided the four (4) witnesses
a photocopy of the inventory). Thereafter, I, (PCpl Perez) inserted the pieces of drug
evidence confiscated from the respondents in to my (PCpl Perez) right front pocket of my
upper garment uniform. While, I, (PCpl Santos) inserted the recovered firearm and
ammunition into the compartment of the police patrol car with plate number DRG 9165.
We then proceeded to Police Station 11 at Gandara, Binondo Manila together with the
arrested persons for investigation and preparation of documents. The confiscated pieces
of drug and non-drug evidence were turned over by the undersigned, (PCpl Perez and
PCpl Santos) to Duty Investigator for documentation and investigation. Thereafter, the
confiscated pieces of drug evidence were tuned over to me (PCpl Perez) by the duty
investigator along with the confiscated pieces of bet money. While, I, (PCpl Santos)
received from the duty investigator the confiscated firearm and ammunition after
investigation.

5. I, (PCpl Perez) inserted the pieces of confiscated drug evidence into my right
front pocket upper garment uniform and submitted the same to Manila Police District
Crime Laboratory Office or MPDCLO for forensic chemical laboratory examination.
Further, arrested respondents were also conveyed to MPDCLO for drug test examination
and in addition the confiscated firearm and ammunition were submitted also to MPDCLO
for Ballistic Examination. Respondents were later conveyed to Justice Jose Abad Santos
General Hospital for their physical examination. Arrested respondents are now at this
Station, Police Station 11 at Gandara Binondo, Manila Custodial Facility.

We are executing this Joint Affidavit of Apprehension to attest the truthfulness of


the foregoing facts this 17th day of August 2019 in the City of Manila.
