The complainant has adduced the evidence to substantiate the averments of Complaints.

The
accuse had taken a specific defence that he had borrowed a sum of Rs___________ each from
one(name) as surely for repayment of loan and issued two signed blank cheques in favour of
said(name).Unfortunately , the said (name) die due to renal failure. The complainant had
clandestinely removed the above cheques from the house of said late (name) and initiated the
instant complaint.

The accused has not disputed that cheques were drawn by him. The accused pleaded the above
special circumstance to prove there was no legally recoverable debt.

The accused taking advantage of the fact that brother of said (name) was in his favour, has set up
this theory disown his liability under dishonour cheques.

The defence put forth by accused is totally untenable.

The court below have not committed any glaring errors in appreciation of evidence.
