U/s 70(2) of CrPc, the accused above named begs to state as

follows:

1. The above named accused had obtained Anticipatory bail in C.Mis.

No 2270, CCH-1, and matter was disposed as to call after final report.

2. The above accused had met with an accident about two years back

on 31.12.2016 and his right hand ulna was fractured and he got it

operated and plates were fixed. It is submitted subsequently i.e.

during the month of July the above accused suffered pain has the

plates were not removed and the he got treated at _____________

Hospital _______________, _______________, ______________ District and

the Doctor advised for operation and he got admitted to Hospital on

___________ and surgery was done & plates were removed on

____________ and he took treatment in the said hospital as an

inpatient till 12/06/2018 and got discharged. The Doctor had advised

for bed rest for a period of one month.

3. It is respectfully submitted that the Respondent police have filed

charge against the accused on 14/06/2018. This Hon’ble court was

pleased to issue summons. Due to the ill health and being

hospitalized the accused was not served with summons. On

25.06.2018, this court was pleased to issue NBW.

4. It is respectfully submitted that, on the three previous hearing

dates due to the absence of this accused this court was pleased to

issue NBW. THIS VERY FACT WAS NOT WITHIN THE KNOWLEDGE

OF THE ACCUSED, for the reasons stated above. It is further

submitted that, accused was never contacted by any police officials

with regard to issue of summons till date. Yesterday when he

contacted his advocate to know the fate of the case filed against him

he came to know about issue of NBW

4. The absence of the accused on the last several dates of hearing is

bonafide and not with any intention. The above accused undertakes

to appear before this Hon’ble court hereafter regularly on all the dates

of hearing without fail.

WHEREFORE, it is prayed this Hon’ble court may kindly be

pleased to recall the NBW issued on 25.06.2018 against the above

accused by allowing the same in the interest of justice.
