Grievance Description:

It is confirmed that there are no coordination among AWBI, CZA with Gujarat SPCA & CWLW,
because:
1. As per CZA record, Great Golden Circus declared 10 Common Dogs, 3 Indian Elephant, 2
Common Goat, 8 Horses and 8 Macaw.
2. As per AWBI record, Great Golden Circus applied on 1-10-2003 to grant permission for 5
Elephants, 7 Horses, 7 Dogs and 4 Macow, these performing animals as registered on 28-9-2004,
allowing 4 Horses Riding in the show, 5 Elephant Playing cricket match and football, 4 Three
minutes Perform in the show and 7 Dogs 15 minutes perform in the show.
Whereas:
On physical verification as record available, AWBI advised ban on Elephant performance in the
circuses, issued on 6-9-2016, keeping in view the decision of 43rd General Meeting, besides it 7
Horses, 7 Dogs and 4 Macow, which were allowed to perform by AWBI, have been retired due to
old age or died.
All animals within premises of Great Golden Circus are Performing animals as per definition under
Performing Animals Rules, 2001, all animals are not registered with AWBI as performing animals,
keeping in view use of Biological resources for commercial purpose, without sharing profit as per
Guidelines on Access to Biological Resources and Associated Knowledge and Benefits Sharing
Regulations, 2014 under Biological Diversity Act, 2002.
Why Elephants are being performing within the Circus after imposing Ban of AWBI, rest of animals
compelled to perform, without approval of AWBI as per Performing Animals Rules, 2001, keeping
in view five freedoms of animals, hence Scouts & Guides for Animals & Birds asked SPCA of
Gujarat to STOP animal performances, local Police to lodge FIR against the operators with
promoters as organized crime against animals, let panchnama report be prepared as ground & Police
permission is valid up to 29-2-2020.
Recording of CC TV along with all animals needs immediate confiscation for further treatment, care
& shelter.

Subject: Two Branches of Great Golden Circus performing with unregistered animals.
Greetings,
Kindly refer to the question raised by the Department of Animal Husbandry, Gujarat with AWBI as on
27-2-2020, which is reproduced as under:

With reference to your 27 Feb 2020 mail Regarding Great Golden Circus is performing in
Ahmadabad city with elephant. In your letter mention that registration of Great Golden Circus has
been suspended by the AWBI.
We have two reference letters from AWBI as per below
1) 13 January 2016 letter with subject to order of suspension of Registration Certificate Ref No.
9-14/2002-PCA dated 29.09.2004 issued to Great Golden Circus under Performing Animals
(Registration) Rules 2001 and Prevention of Cruelty to Animals Act, 1960.
2) 26th July 2017 letter with subject to Performing Animals Registration Certificate Ref No. 9-
14/2002 PCA dated 29.09.2004 issued to Great Golden Circus under Performing
Animals (Registration) Rules 2001 and Prevention of Cruelty to Animals Act, 1960.
Kindly clarified regarding Performing Animal Registration of Great Golden Circus.
AWBI replied:

After the second letter issued by the AWBI in 2017, the recognition of the Circus was withdrawn
and the authority of the circus was called for in person present before the Performing Animal
Committee. However, the Circus Authority never turned up. The Central Zoo Authority has also
cancelled their registration as the elephants are not allowed to perform. Hence, the Circus is
running their show without any approval of AWBI. On 28.02.2020, I shall provide the letters
related to this development.

Whereas AWBI also reported:

The Great Golden Circus is performing in the Ahmadabad City with elephant. As you may be
aware that the elephant cannot be used for performance because it inflict cruelty at the time of
training and performance. The performance of animals by the Circus is also prohibited s per the
law. Further, the registration of the Great Golden Circus has also been suspended by the AWBI.
As per Prevention of Cruelty to Animals (Performing Animal) Rules, the organizations using the
animals for performance need registration with the AWBI.
Therefore, it is requested to take immediate steps to stop abusing the animals like elephant to
avoid cruelty. I am forwarding the video received by the undersigned.
The mail has also been addressed to Director, AHD, Gujarat for taking action on behalf of State
Animal Welfare Board.
It would be pertinent to mention here that:

1. Biological resources are being commercially used for gain & profit as business without sharing
profit as per the Guidelines under the Biological Diversity Act, 2002.

2. Great Golden Circus performing with unregistered animals, being habitual offenders, without
approval of AWBI, concealing facts, presenting false information’s, misguided to all concerned
Authorities, cheating public because CZA reported that 10 Dog Common, 3 Elephant Indian, 2
Goat Common, 7 Horse & 8 Mcaw, were registered vide its letter dated 14-9-2012, keeping in
view above said animals either dead or not capable to perform due to old age because every
animals have age span, deep investigation required as animals replaced with another unregistered
animals, which is an offense as criminal breaching of trust, cheating enforcement agencies,
bluffing them with wrong information’s.
3. PETA India collected evidences about Great Golden Circus, report was submitted, which is
accepted by the AWBI, on the basis of PETA India reports, AWBI decided to impose ban on
elephant performances in the Circus, whereas I place question mark on the integrity of PETA
India because after collecting evidences, they never approach Police, their objections were not try
& decide by the appropriate Court of law, keeping in view AWBI had no legal rights to penalize
any one offense against laws of the land.
4. Another branch Great Bharat Circus of Great Golden Circus was also booked by the Maharashtra
Police for the violations of different sections of legislation.
5. All performing animals, which were applied by the Great Golden Circus before AWBI, had been
expired, now adopting criminal conspiracy another non registered animals are being compel to
perform tricks, which were never been allowed by the AWBI, keeping in view the age - sex -
species of the animals.

Hence, FIR may kindly be lodged against the management & promoters of the Great Golden Circus as 2 nd
offense, including owner of the circus with facilitators, for the violations of 120-B, 188, 268, 289, 406,
409, 428, 429 IPC read with section 3, 11, 22, 38 of the Prevention of Cruelty to Animals Act, 1960 all
abused animals may kindly be rescued for further rehabilitation, restoring their five freedoms.
