The matter was argued and submitted, and good cause appearing therefore,

IT IS HEREBY ORDERED THAT:


Oral motion by Respondent to continue the hearing is denied.

Oral motion by Respondent to bifurcate issues 1s denied.

Petition for Writ of Mandate is Granted and a Writ will issue.

The court ordered that the election at issue in the case is vacated and set aside and that a writ will issue
compelling a new election on all four positions to be conducted and completed within 60 days.

The court ordered that the disqualifications of the four candidates whofiled nomination papersare
vacated, that those candidates did submit sufficient nominating signatures to qualify to be candidates
and that the respondents’basis to "disqualify" those candidates was arbitrary, capricious and without
merit.

The court ordered that the election be conducted by the State Conciliation and Mediation Services and
that ACMEAberesponsible for the cost of conductingthe election.

The court ordered that all persons who are currently employed and represented by ACMEAand who
were dues paying members at any point in time between October 31, 2019 and December 31, 2019 may
vote in the election and that the parties to this case must cooperate in in trying to resolve any disputes of
whether any individualis an elector 1n the election.

The court ordered that the expulsion of petitioner Wallace from ACMEAis vacated and his membership
is reinstated without any lapse in time.

The court will retain jurisdiction to enforce the court's Writ of Mandate.

The court directed petitioners’ counsel to prepare an Order and a Writ for the court's consideration and
signature.
