PROPERTY DESCRIPTION:
Flat No. 401, 4th floor, A-Wing, admeasuring area about- 37.617 Sq. Meters built-up
+ 2.13 Sq. Meters. Front Balcony and 4.450 Sq. Meters. Terrace , in the Society
known as “SHAH CORNER” Co-Operative Housing Society Limited, Plot Number-
8A, Sector– 06, Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad, Pin-
410210.

executed on …………day of June- 2019,

MRS. HANSA INDER LALA, (Pan No. ACFPL6978D), (Aadhar No. 837922049211),
Aged 79 years, residing at- 102,Ashok Kumar, Towers, Plot no.47,Union Park, Sion,
Trombay Road Chembur,Mumbai-400071., herein after called “the DONOR” (which
expression shall unless repugnant to the context shall mean and include her
representatives heirs, successors, executors, administrators, trustees, legal
representatives and assigns) of the One Part.

AND
In favour of DR. ARUNA VIJAY RAJPAL, (Pan no. AGKPR1034P), (Aadhar no.
777529540784), aged- 54 years, residing at- Flat no. 604, Xarad Residences Union
Park, Chembur, Mumbai, Pin- 400071, herein referred to as “the DONEE” (which
expression shall unless repugnant to the context shall mean and include her
representatives heirs, successors, executors, administrators, trustees, legal
representatives and assigns) of the Other Part.

1. WHEREAS the CITY AND INDUSTRIAL DEVELOPMENT CORPRATION OF


MAHARASHTRA LTD. (CIDCO) is a Government company within the meaning of the
Companies Act 1956 (hereinafter referred to as the corporation) having its registered
office at Nirmal, 2nd floor, Nariman Point, Bombay 400021. The Corporation has been
declared as a New Town Development Authority under the provision of Sub-section (3-
A) of Section 113 of Maharashtra Regional and Town Planning Act 1966, (Maharashtra
Act no. XXXVIII of 1966 hereinafter referred to as the said Act), for the New Town of
Navi Mumbai. The area designated as site for New Town under Sub-Sec. (1) and (3-A)
of section 113 of the said Act.

2. AND WHEREAS the State Government has been acquiring lands pursuant to
section113– A, of the said Act and has vested such lands in Corporation for its
development and disposal, on such time , conditions, stipulations , covenants , and for a
consideration as the corporation may decide time to time.

3. AND WHEREAS latter on the Developer has submitted the building plans to the
CIDCO Ltd. For its sanction and approval and the Cidco Ltd., has sanctioned the said
building plans, specifications and designs, submitted by the developer and granted the
Development Permission to construct Residential Cum Commercial Building known as
‘SHAH CORNER’ and issued Commencement Certificate vide its letter bearing no.
CIDCO/ATPO/1582, Dated- 29/11/2005. (A copy enclosed).

4. AND WHEREAS after completion of building Known as ‘SHAH CORNER’ as per
Approved Plan, CIDCO Ltd., has issued Occupancy Certificate under Reference
bearing No. CIDCO/BP/ATPO/3187, Dated- 19/09/2008. (A copy enclosed).

5. AND WHEREAS MR. KRISHNA DATTARAM MALEWADKAR, (therein referred to


as the first purchaser in the agreement from the Builder herein referred), had purchased
Flat No. 401, 4th floor, A-Wing, admeasuring area about- 37.617 Sq. Meters built-up
+ 2.13 Sq. Meters. Front Balcony and 4.450 Sq. Meters Terrace, in the Society
known as “SHAH CORNER” Co-Operative Housing Society Limited, Plot Number-
8A, Sector– 06, Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad, Pin-
410210. (Herein after referred to as the said Flat / Premises), from M/s. SHAH
BUILDERS AND DEVELOPERS, vide Agreement for Sale dated- 21/07/2006, and
registered at Sub-Registrar Office Panvel-3, under document no. 05306-2006, dated-
21-07-2006.

6. AND WHEREAS further MR. KRISHNA DATTARAM MALEWADKAR had sold Flat
No. 401, 4th floor, A-Wing, admeasuring area about- 37.617 Sq. Meters built-up + 2.13
Sq. Meters. Front Balcony and 4.450 Sq. Meters Terrace, in the Society known as
SHAH CORNER Co-Operative Housing Society Limited, Plot Number- 8A, Sector– 06,
Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad, Pin- 410210. (Herein after
referred to as the said Flat / Premises), to MRS. HANSA INDER LALA vide ‘Agreement
for Sale’ dated- 07/04/2010, and registered at Sub-Registrar Office Panvel-1, under
document no. PVL1-04330-2010, receipt no. 4747, dated- 07/04/2010.

7. AND WHEREAS The ‘Donor’ MRS. HANSA INDER LALA is the owner of Flat No.
401, 4th floor, A-Wing, admeasuring area about- 37.617 Sq. Meters built-up + 2.13 Sq.
Meters. Front Balcony and 4.450 Sq. Meters Terrace, in the Society known as SHAH
CORNER Co-Operative Housing Society Limited, Plot Number- 8A, Sector– 06,
Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad, Pin- 410210, and absolutely
seized and possessed of or otherwise well and sufficiently entitled to the said flat.

8. AND WHEREAS now cut of natural love and affection for her ‘Mother’ MRS. HANSA
INDER LALA, the DONOR is desirous of making a Gift of her Shares, rights, title,
interest and benefit in respect of the Flat No. 401, 4th floor, A-Wing, admeasuring area
about- 37.617 Sq. Meters built-up + 2.13 Sq. Meters. Front Balcony and 4.450 Sq.
Meters Terrace, in the Society known as SHAH CORNER Co-Operative Housing
Society Limited, Plot Number- 8A, Sector– 06, Kharghar, Navi Mumbai, Taluka– Panvel,
District– Raigad, Pin- 410210, to DR. ARUNA VIJAY RAJPAL without any
consideration.

9. AND WHEREAS the ‘Donee’ DR. ARUNA VIJAY RAJPAL has accepted the gift of
the said flat from her Mother MRS. HANSA INDER LALA without any consideration.

10. AND WHEREAS hereinafter DR. ARUNA VIJAY RAJPAL i.e. the ‘Donee’ shall be
the owner of Flat No. 401, 4th floor, A-Wing, admeasuring area about- 37.617 Sq.
Meters built-up + 2.13 Sq. Meters. Front Balcony and 4.450 Sq. Meters Terrace, in the
Society known as “SHAH CORNER” Co-Operative Housing Society Limited, Plot
Number- 8A, Sector– 06, Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad,
Pin- 410210.

11. AND WHEREAS the ‘Donor’ has paid all the dues, water and electricity charges,
association charge in respect of the said flat to their authorities up to date.

12. AND WHEREAS the peaceful vacant, physical possession of the said flat is given to
the Donee on execution of this Deed of Gift and the Donee admits of having received
the same from the Donor.

NOW THIS GIFT DEED WITNESSETH as follows:

13. That without any monetary on account of ‘Natural Love and Affection’ for her
‘daughter’ DR. ARUNA VIJAY RAJPAL, the ‘DONOR’ i.e. MRS. HANSA INDER LALA
hereby voluntarily gifts, assigns, without any encumbrances, their shares, rights, titles,
interests and benefits in the said flat and which is more particularly described in the
schedule hereunder written.

14. To hold the said flat hereby granted, conveyed and assigned unto the Donee as
heritable, transferable and immovable property within the meaning of any law for the
time being in force.

15. The Donor have in herself good right, full power, and absolute authorities grant,
convey, assure and her rights, title, benefits in the said flat hereinabove expressed
granted, conveyed, assured and assigned unto and to the use of the Donee, her
successors, executors, administration and assigns and it shall be lawful to the Donee at
all times, hereafter, peaceably and quietly to enter into and hold, possess and enjoy the
said flat exclusively and receive rents and profits there from and every part thereof
subject as aforesaid without any interruption or hindrance by the DONOR, her heirs,
executors, administrators and assigns or any person claiming under the DONOR or in
trust for her and clearly and absolutely released and forever discharged, well and
sufficiently saved, defended and kept harmless and indemnified of, from and against all
estates, titles, charges, encumbrances, claims and demands created, occasioned,
made by the DONOR or any person or persons lawfully or equitably claiming by, from,

through under or in trust for her and that the DONOR will at all times hereafter at the
request of the DONEE or any other persons authorized by the DONEE in that behalf to
do on cause to be done, execute or cause to be executed all such further in lawful and
reasonable acts, deeds, things, conveyances and the assurances in the law whatsoever
for the better the further granting, conveying, assigning their shares, rights part thereof
unto the cause of in respect of the said flat and every time Donee as shall or may
reasonably be required by the DONEE.

16. The Donor shall not sell, assign, mortgage, underlet or otherwise transfer wholly or
partly the demised premises or her interest therein or part wholly with the possession of
the demised premises or permit the use wholly or partly the premises provided that
nothing contained herein shall apply if the donor shall perform to the satisfaction of the
corporation the following conditions.

17. In the instrument by which the Donee shall transfer her share the demised premises
the Donee shall impose upon the person to whom the premises are so transferred to
perform and observe to the corporation all the conditions and covenants of the lease to
him including this covenant.

18. A true certified copy of the instrument of transfer apartment executed between the
Donor and the Donee is deposited with the estate officer of the Cidco Ltd. / Corporation
within Seven days from its execution.

19. Donee shall obtained necessary permission as may be required from any other
competent authority.

floor, A-Wing, admeasuring area about- 37.617 Sq. Meters built-up + 2.13 Sq.
Meters. Front Balcony and 4.450 Sq. Meters. Terrace , in the Society known as
“SHAH CORNER” Co-Operative Housing Society Limited, Plot Number- 8A,
Sector– 06, Kharghar, Navi Mumbai, Taluka– Panvel, District– Raigad, Pin-
410210.

IN WITNESS WHEREOF the Donor as well as the Donee (by way of acceptance of the
said gift) has put their respective hands the day and year first herein above written.
