In light of the recommendations of the Coordination Committee in its 8" meeting held on 7" November, 2017, Chairman & MD in consultation with the Director (Finance) has been pleased to adopt, mutatis mutandis, the pay scales revised by the Government of Rajasthan vide Notification No.F.15(1)FD/Rules/2017 dated 30” October, 2017 (Annexure-‘A’) and memorandum No. F.15(1)FD(Rules)/2017 dated 30" October, 2017 (Annexure-‘B’), read with notification No.F.15(1)FD(Rules)/2017 dated 9!" December, 2017 (Annexure-C’) w.e f. 01.01.2016 for Nigam's employees on scale to scale basis (1) The rules and procedure prescribed under Rajasthan Civil Services (Revised Pay) Rules, 2017 appended to this order will be followed, as it is, for fixation of pay, option to elect the existing pay scale or the revised pay scale, date of increment, removal of anomalies, pay of employees appointed on or after 1.1.2016 and application of Assured Career Progression (ACP) scheme etc, The fixation shall be made in the corresponding Pay Matrix. ACP shall be granted as per the detailed guidelines enclosed with the said Rules, 2017. (2) The procedure of fixation in the Revised Pay Scales, 2017, as adopted by the Nigam herein above, shall be done as prescribed in Government of Rajasthan’s Memorandum No.F.15(1)FD (Rules)/2017 dated 30.10.2017 (Annexure-'B'), For the purpose of fixation, the employee shall exercise option in the proforma enclosed at Annexure-‘D’ in writing, to be furnished to the respective Head of Office within a period of three (3) months from the date of issue of this order. In the event of not exercising option within the stipulated three months’ period, such employee shall be deemed to have elected to draw pay under the above Revised Pay Rules, 2017 wef 01.01.2016. Xe © Notwithstanding anything contained in this order and in the Rajasthan Civil Services (Revised Pay) Rules, 2017, no arrear of pay and allowances thereon whatsoever on any account, shall accrue to any employee, whether existing or appointed between 1.1.2016 to 31.12.2016 (both days inclusive) for the period upto 31.12.2016. The amount of arrears for the period from 01.01.2017 to 31.12.2017 accruing as a result of adoption of the above Rajasthan Civil Services (Revised Pay) Rules, 2017 shall be payable as under- i) Arrear for the period from 01.01.2017 to 31.12.2017 shall be payable in cash during the financial year 2018-19 in three installments in the ratio 30:30:40 as under:~ (a) First installment Payable in April, 2018 (b) Second installment Payable in July, 2018 (c) Third Installment Payable in October, 2018 Note :- The payment of arrears shall be subject to TDS on account of income tax and deduction for CPF (in respect of CPF holders) as per rules applicable at the time of payment. ii) The amount of recovery of rent of Nigam’s/ Govt. accommodation w.e.f. 1.1.2017 shall be adjusted from the arrears, Pay and allowances at the revised rates shall be subject to all deductions as may be necessary as per rules/ regulations/ orders in force or amended from time to time. Amount of fixed remuneration for a Probationer-Trainee ~ A Probationer Trainee shall draw fixed remuneration during the period of Probation Training. Only on successful completion of the period of probation- training, he will be allowed minimum of Level (first Cell) in the Pay Matrix without any initial higher start. These provisions shall be applicable to the existing ‘probationer trainees’ as well as new recruits. Piriincaric, A" GOVERNMENT OF RAJASTHAN FINANCE DEPARTMENT (RULES DIVISION) NOTIFICATION No, F. 15(1)FO/Rules/2017 Jaipur, Dated : 30” October, 2017 In exercise of the powers conferred by the proviso fo Article 309 of Gonstitulion, the Governor in pleased to make the following rules, praseribing revised pay structure and principles governing fixation of pay in the revised pay structure, namely:- Rajasthan Givil Services (Revised Pay] Rules, 2017 Short title, extent and commencement. — {) These rutes may be called the Rajasthan Civil Services (Revised Pay) Rules. 2017, (i) They shall come into force with effect fram 1% October, 2017, 2 () — Categor of Government servants to whom the rules apply.- Thess rules shall apply to persons other than members of All India services appointed to Civil Services and posts in connection with the affairs of the State and whose pay is debitable to the Consolidated Fund of the Stata. (i) These rules shall not apply to- fa} () (©) (a) (e) 6 (9) «ny persons nat in whole time employment of the Government; persons paid out of contingencies; persons employed on contract Government servants who after their ratiement, whether on aliaining the age of superannuation oF othenwise were reemployed by the Government and were in service on 1% October, 2017, persons employed on work-charged basis including thase who are governed by the Rajasthan Public Works Department (Building & Roads) including Gardens, Water Resources, Land Development (Programme), Circle CAD. Power of Interpratation. - If any question arises ralating 10 the Interpretation of these rules. it shall be referred to the Government jn the Finance Department whose decision thereon shall be final. Definitions. - In these rules, unless there Is anything repugnant in the subject or context. () “existing basic pay’ means pay drawn in tho presoribed existing Running Pay Band and Grede Pay but does not inciude any other type of pay such as special pay, personal pay. iFany. ete, (i) Sexisting running Pay Band and Grade Pay’ means the Running Pay Gand and the Grade Pay applicable fo the post held by the Government servant as an 01.10.2017 whether in a sutstantve capscity or in officiating capacity white retaining lion on a permanent post or in a temporary capaclty; Explanation.- (a) In the case of a Government setvant on deputation out of India or on Isave of on foreign service or one who would have officiated in one or more lower posts but for his officiating in a higher post, “Existing Running Pay Band and Grade Pay ” includes the scale applicable to the post which he would have held tut for his being on deputation out of India or on leave oF on foreign servis or officiating in @ higher post. () In case of a Government servant drawing pay on $0.09 2017 in 2 scale other than the Rasthan Civil Servicen (Revised Pay) Rules, 2008, as amended from fime 10 time, his fixation of pay in the Rajasthan Civil Services (Revised Pay} Ruias 2017 shall be made only afier his pay has first boen fixed in the Rajasthan Civil Services (Revised Pay) Rules, 2008, as amended ftom time to time, in respect of post held by him on 30.08.2017, i) “existing pay structure * means the present system of Running Pay Band and Grede Pay applicable to the post held by the existing Government servant as on 01.10.2017 whether in @ substantve or offiexting capacity winie retaining flen on a permanent pos! orn a temporary capacity, (iv) “existing emoluments" mean the sum of (i) existing baste pay (ll) Personel Pay, if any and (jl) existing deerness allowance al index average as on 1* day of January 2016 ie. @ 125% (v) “Level” in the Pay Matrix shall mean the Level cortespending to the extsting Running Pay Band and Grate Aay specified in Part A’ of the Schedula-I; {¥) "Pay Matrix" moans Malrix spevified in Part ‘B' of the Schedule-I, with Levels of pay arsanged in vertical Cells as assigned to corresponding existing Running Pay Band and Grade Pay: o® (wi) Spay in the Levelt means pay drawn in the appropriate Cell of the Level as spectiied in Part'B' of the Schedule-I; (vit) “revleed pay structure’ means the Pay Matrix and the Levels specified therein corresponding to the existing Running Pay Band and Grede Pay of the post unless a different revised Level is noted separately for that po (ix) “basic pay’ in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix; () “revised emoluments” means the pay in the Level of a Government-servant in the revised pay structure; Od) “Schedule” means the Schedules appended to these rules (xi) “Existing Goverament Servant" means a Government setvant who Is in service on 1* October, 2017 and drawing pay in an existing running pay band end grade pay. Explanation - Government servants, who were appointed on or after 1" October. 2017 in the Levels of the Pay Matrix under the Rejasthan Civil Servicas (Revised Pay) Rules. 2017 are not ‘existing Government servants’. Thay will draw pay in the Levels of the Pay Matrix applicable to their posts under the Rajasthan Civil Services (Revised Pay) Rules. 2017 as a result of retrospsctive operation of these rules Pay of such employses in reapect of post held by them on 1" October, 2017 of on the date of appointment subsequent to 1" October. 2017, whichever is later, shall be fixed at the minimum of the Levels (fist Cell) of the Pay Matrix as par Schedule-! Part ‘B' only afier successful completion of the prabation period as per provisions of relevant service rules (xii) “Regular Service" means and includes satvice rendered by a Government servant on his appointment after regular selection in accordance with the provisions contamed in the relevant recrustiment rules for that post. The period of service rendered on ad-hoc basis / urgent temporary basis shalt not he courted 48 the regular service In other words the period of service whici Is countable for sextiority shall only be vaunted as regular service. Level of posts.— As from commencement of these rules the Level of posis shall be determined in accordance with the various Levels as assigned {o the corresponding existing Running Pay Band and Grade Pay as specilied in the Pay Matrx and as indicated in column 7 of Section ‘A’ *B! and 'C' of Schedule-Il Drawal of pay in the revised pay structure (i) Save as atherwise provided in these rules. a Government servant shall draw pay in the Level in the revised pay structure applicable to the post which he is helding as on 04.10.201? or to which he is appointed an or efter 1* October, 2017 (i) in respect of any service! cadre or class of pasts for which no rules reguiating recrultment and conditions of service have been framed Under proviso Io Aricie 300 of the Constitution or where a post! posts have not bean included In the Schedule appended to the rules regulating recruitment and conditions of service, the academic qualifications ard experience as prescribed by ot wth the concurrence of the Finance. (1) The Level of pasts in the Pay Matrix shell apoly to every existing Government servant provided that = Government servent may elect to continue fa draw pay im the: existing pay structure until the date on which he earns his nex! or any subsequent Increment in the existing pay structure or until he vacates his post or ceases ta draw pay in the existing pay structure: Provided further that in cases where @ Government servent has been wiaced in 2 higher grade pay between 1" October, 2017 and the dale of notfication of these tules on account of promotion oF upgradation or ACP. the Government servant may elect to switch over to tho revised pay structure from the date of such promotion or upgradation or ACP, as the case may be (2) Am existing Government servant may exercise option to retain existing Running Pay Bend and Grade Pay under provisa fo sub-rule (1) in any of the following circumstances: - (a) while folding a permanent posi in substantive capacity, but not officiating on a higher post; (b) while holding @ permanent or temporary post in @ temporary capacity without having any len on any pest (©) while officiating on a higher post, whether permanent or temporary, retaining lien on @ permanent post or where he would have officiated in one or more posts but for his being on leave or on foreign servics, provided that — (the opifon in such cases shall be admissible in respect of existing Funning pay band and grade pay attached either to the post held by him in officiating capacity or to his substantive post and not for both tha existing running pay band and grade pay: and if such a Govamment servant exercisas option to retain existing running pay band and grade pay in respect of the post field by him in officiating capacity, his pay, In the event of his reversion ta the lower pos! held in substantive capacity shall be flxed under these rules only; and {the option to retain existing wunning pay bend and grade pay in Tospect of the post held in officiating capacity shall not be allowed to & Governmant servant who was noi qualified to hold the higher post; oF who was fortukously appointed on puraly temporary basis, for example against leave vacancy or agains a short term vacancy ‘caused by deputation of the senior person for training within Inata or ‘abroad ot deputation to foreign service ete. Explanation - The aforesaid option shall not be admissible to any perscn appointed to a post on or after the 1" October, 2017, whether far the first time in Government service or by transfer from another post and he shall be allowed pay only in the Level in the Pay Matrix 9. Government servant holding post on 1* October, 2017 for which no Level has been Prescribed for any reason, whatsosver or where the Level or conditions attached to the drawal of pay under thase rules are subsequently changed, amended or revised, shall exercise option / re-ontion under this rule within a period of three months of the date of notification of revised pay structure ar ‘any other change related to the Level of the post ‘The option once exercisad shall be final Special Pay. ~ The rates of Special Pay, which shall be drawn with the revised pay siructure, a°e Given in Schedule - IIl appended to these rules. 6 1 1. Fixation of pay in the reviaed pay structure. A Government servant who is on study teave on the 1" October, 2017 shall be ‘entitled to the pay in the revised pay structure from 1* October, 2017 or the dale of option. A Government servant under suspension, shall continue to draw subsistence allowance based on existing pay structure and his pay in the revised pay structure Shall ba subject to the final order on the pending disciplinary proceedings. Where 2 Government servant holding @ permanent post and is officiting in a higher post on reguler basis and the pay structure applicable to these twa posts are merged into one Level. the pay shall be fixed under sub-rule (1) with reference {o the officiating post only and the pay sa fixed shall be treatad as substantive pay. Where the existing emaluments exceed the revised emoluments in the case of any Government servant the diffarence shall be allowed ss personal pay to be absorbed in fulure increases in pay, Where in the fixation of pey under sub-rule (1), the pay of a Government servent, who, in the existing pay siruoture, was drawing immediately bafore the 4% October, 2017 more pay than another Government servant junior to him in the same cadre, gels fixed in the revised pay structure in 2 Cell lower than thet of such jurtior, his pay shall be stepped up to the same Cell in the revised pay structure as that of the jurior, Where a Government servant is in receipt of personal pay immecistely before the date of noification of those rules, which together with his existing emoluments exceed the revised emoluments, then the difference representing such excess shall b¢ allowed to such Government servant as personal pay fo be absorbed in fulure increases in pay. Employees completing 6 months and above in any Level as on 4st of July will be eligible (o be granted the increment. (2) Every new recruit on completion of probation period successtully shall be allowed first annual increment on 1" July, which Immediately follows the data of completion of pronation period, Scheme of Assured Career Progression (ACB). Existing Government sorvants who have already availed thras benefits of financial upgradation will not be eligible for the grant of ACP. Thase Government servants who have availed benefit of one ACP f one promotion will be eligible for second and thied ACP on completion of 18 and 27 yeers of regular service respectively Similarly those Government servants who have availed benefit of vio ACP's / two promotions / one promotion and one ACP, as the case may be, will be eligible for thiré ACP on completion of 27 years of regular service. The authority compeieni to make appointment on the post held by the Government servent shalt be competent to grant ACP. ‘The detailed guidelines for granl of Assured Career Progressions (ACP) shall be as contained ln Schedule-Vi appended to these rules. The fixed remuneration shall be as indicated in Schedule - JV appended to these rules, Fixation of pey in the revised pay structure of a Probatloner-trainas completing probation training period successfully on or after 01.10.2017 = A Piobationet-trainee on successful completion of probation training period will be allowed pay in the revised pay structure as per Schedule-| Pact 'B' applicable to the post ta which such employee is appointed af minimum of Level (frst Gell) in the Pay Mattie, Provided that a Government servant who 1s already in regular service of the State Government, if appointed on another post as a Probationer-trainee and has opted to draw pay In Running Pay Bend and Grade Pay of tho previous post, on successful completion of probation period his pay will be fixed fn the relevant Level of the new poet at tha equal stage with reference to the pay of the previous post. Provided further thet if a Goverment servant is appointed on another post as a Probationer - trainee on new higher post after fixation of pay under these rules, the pay drawn by him on the previous post shall be allowed during the period of probation training including lnerement and on successful completion of probation training period, his pay on the higher ost shall be fixed with reference fo his pay on the lower post at an equal Cell of the higher ost and if there is no such equal Gell than in the next Cell af the new past. Advanca Increment- A Government servent shall be entitled to advance increment wath the revised pay siructure, as provided In Schedule-V appended to these rulas. Fixation of pay in the revised pay structure. subeequent to the 1" October, 2017. Method of fixation of pay in the Level further revised after 01.10.2017: The inilial pay of a Government servant who elects or deemed to have eleoted Level of the post further revised after 01.10.2017 shall he fixed at an equal Cell of thet post, IF no such Cell is available in the applicable Lavel, the pay shall be fixad at the immediate next higher Cell in that applicable Level in the Pay Matrix. In case the pay last drawn in the previous Level is fesa than the minimum of first Cell of the further revised Level of that post, he shall be fixed al first Cell of further revised Level in the Pay Matrix.
