POSITION PAPER

With all due respect to this Honorable Office.

Respondent by and through himself and to this Honorable Office, Respectfully

submits his Position Paper, as follows:

SHORT BACKROUND OF THE CASE

The instant case arose from the following factual antecedents:

In the charge sheet dated March 10 , 2020 filed by PLTCOL ARIEL M

NARBOADA, Chief, Provincial Investigation Detective Management Unit, Lanao del
Sur Police Provincial Office, accuses the respondents for “Simple Neglect of Duty”
pursuant to NAPOLCOM Memorandum Circular 2016-002, committed as follows;

“That the above-named respondent while being member of the Philippine

National Police, presently assigned at Butig Municipal Police Station and Pualas
Municipal Police Station, Lanao del Sur Police Provincial Office, and within the
jurisdiction of the Provincial Director, LSPPO, PRO BAR, did, then and there,
willfully, deliberately and unjustifiably failed to comply with the above Provision of the
NAPOLCOM.”

On February 10, 2020 C, PIDMU issued a memorandum to lower units with

death Incident Under Investigation (DIUI) particularly to the investigator and crime
registrar of Binidayan MPS, Butig MPS, Pualas MPS, and Tubaran MPS to attend
the case review scheduled on February 11, 2020.
 Said case review was intended to lift the low rating in UPER because of low
accomplishment in the crime clearance and crime solution efficiency in every police
station.

On February 11, 2020, the scheduled date for the case review Investigators
and the crime registrar of Binidayan MPS, Butig MPS, Pualas MPS failed to attend
that prompted the PLTCOL ARIEL M NARBUADA Chief PIDMU, LDSPPO to make
them explain.

On February 12, 2020, another Memorandum was issued by the Chief

PIDMU, LDSPPO to the lower units with Death Incidents under Investigation (DIUI)
to be conducted on February 18, 2020, wherein Investigators and crime registrar of
Binidayan MPS, Butig MPS, Pualas MPS and Lumbatan MPS were the participants.

On February 18, 2020, PSMS Halim S Dumagay investigator of Butig MPS

and Pat Datumanot M Sendad investigator of Pualas MPS was again failed to attend
the case review conducted by PIDMU, LDSPPO. Both the subject PNCO
disregarded a direct order twice that made them a recidivist.

Hence, this pleading.

ARGUMENTS/ DISCUSSION

Under the foregoing set of facts, the issue at bar is whether or not the
respondents are guilty of Simple Neglect of Duty.
