NCLAT was constituted under Sec 410 of the Companies Act, 2013 for hearing appeals against the
orders of NCLTs, with effect from 1st June, 2016.

It is the Appellate Tribunal to hear and dispose of appeals against any direction issued or decision made
or order passed by the Competition Commission of India (CCI) – as per the amendment brought to Sec
410 of the Companies Act, 2013 by Sec 172 of the Finance Act, 2017.

NCLAT is also the Appellate Tribunal for hearing appeals against the orders passed by NCLT(s) under Sec
61 of the Insolvency and Bankruptcy Code, 2016 (IBC), with effect from 1st Dec, 2016.

The NCLT has the power under the Companies Act to adjudicate proceedings

Industrial Tripartite Committees


The decision to constitute these ITCs was the outcome of tripartite deliberation at the Indian Labour
Conference in 1944 over demarcation of general subjects discussed at the ILC and their relevance to
different industries.

Following the procedure adopted by the ILO, the GoI set up Industrial Tripartite Committees for
different industries

Seven industrial tripartite committees have been constituted with the view to promote the spirit of
tripartism.

These tripartite bodies aim at solving the industry specific problems related to workers in: -

1. Sugar industry,

2. Cotton Textile industry,


3. Electricity Generation & Distribution,

4. Jute industry,

5. Road transport,

6. Engineering industry

7. Chemical industry.

In addition a

SPECIAL TRIPARTITE COMMITTEE

has been constituted to discuss general matters pertaining to Govt reforms policies & their impact on
workers.

Their functions, in general, are to study and discuss problems in the Labour field specific to the
industry concerned with a view to bring about better understanding between the parties and to
advising the Government in solving these problems and reach a workable formula agreeable to the
parties concerned.

INTERNATIONAL VISION ZERO CONFERENCE


MoLE has started VISION ZERO conference and its relevance to Occupational Safety and Health.

Objectives

• The concept of ‘Vision Zero’ is fast gaining international acceptance and is expected to leverage the
efforts of the GoI to raise the occupational safety and health standards so as to improve the
occupational safety and health situation.

The concept of Vision Zero is based on 4 fundamental principles viz.

• Life is non-negotiable,

• Humans are fallible,


• Tolerable limits are defined by human physical resistance, and

• People are entitled to safe transport and safe workplaces.

The Vision is based on principles of Controlling Risks, Ensuring Safety and Health in Machines,
Equipment and Workplaces and Skill Upgradation of Workforce.
