FACTS

This Application is expressed in concern about the menace of water pollution faced by the
residents of Dharuhera and nearby villages due to interstate water pollution caused by
Bhiwadi and khushera industrial area of district Alwar Rajasthan. There are total eight
respondent in this case. The tribunal has directed the secretary Environment, Urban
development of both the states i.e. State of Rajasthan and State of Haryana should hold a
meeting and submit report of it to tribunal. And discuss that why effluent is being discharge
on the land of Haryana, which cause pollution of underground water as well as well has
health hazards. It is to be examine that why the state of Haryana not put up a CETP at the
mouth of the drains and ensure that release of trade effluent from CETP is as per the
prescribed standards and is recycled for agriculture and horticulture and even for industrial
purpose. Due to all this Article of the constitution of India i.e. Right to life is being violated
for the people of Rajasthan. The waste is being discharge in the river adjoining the Dhaurehra
and Bhiwadi and Khushera. The industrial waste is full of dangerous and contaminated
environment pollution containing dangerous chemicals and radioactive substances causing
serious threat to the environment and human beings in the vicinity of the area. During rainy
season , the residents are compelled to remain confined to their homes due to accumulation of
poisonous substances in and around the localities in Haryana causing people severe lung
disorder. The inspection report is submitted y the officials of the Rajasthan state pollution
Control Board, Haryana state pollution Control Board and Central pollution Control Board.
As per the inspection level of BOD and COD were exceeding the prescribed limit, which can
be brought down by installation of diffused aeration system in the secondary treatment.

JUDGEMENT

As the tribunal is not satisfied with the answers provided by the various officers, mainly
Pollution Control Board. So, the Rajasthan state pollution Control Board was directed to shut
down some industries but the action has not been taken so far. As a result the Hon’ble
tribunal direct to shut down the ten Electroplating industries located in industrial are of
Bhiwadi, identified by Central pollution Control Board be closed down forthwith.
