Chapter 1

Introduction

Overtime is the amount of time someone works beyond normal working hours.


The term is also used for the pay received for this time. On many occasions
employers require employees to work overtime due to an increase in production, to
meet order deadlines, or due to various other operational requirements.

According to DepEd Memorandum Public school teachers shall render at


most six hours of actual classroom teaching then the remaining two hours of work
within or outside the school premises to comply with the eight-hour workday by
engaging in the following teaching-related activities and duties such a preparation of
lesson plans, checking of exercises or recording of academic performances. Thus,
as a general rule, employees may not be compelled to work in excess of eight hours
on any given day against his or her will.

Teachers should focus on teaching but still they have many other
administrative tasks. Like the teachers performance evaluation. There are so many
indicators that try to measure the work to be done. Some teachers are already
conscious about this, which tends them to get busy accomplishing reports which
must be supported by corresponding papers. Moreover, there are required tasks to
the teachers, which is even if it’s not related to official duty of a teacher because it
needs to be submitted the same day which they also announced, teachers leave no
choice to just render their overtime service even if its weekdays which is supposed to
be 6 hours duty only. This is because of the nature of the profession, by which
teachers are supposed to be precious. Teachers professional growth must be a
priority however, the education system in our country does not give full support for
the professional growth of the teachers.

Under the circumstances teachers should have the option to refuse to render
the so-called “mandatory overtime service”. Once a teacher spends additional time
or day for work puts in more physical and mental effort and deprives himself or
herself time to spend with family and enjoy the comforts of home. By which the law
discourages employees to work during their rest days just to compel teachers to
render work on their rest day. Overtime is voluntary and teachers have the right to
refuse.
To promote better understanding about the refusal to render overtime service
thorough evaluation must be conducted. This research is guided by this objective.
Perhaps, this research will help them teachers would be knowledgeable enough to
know their rights.

Statement of the Problem

This study was primarily design to address the Refusal to Render


Habitual Mandatory overtime service practice. Specifically, it sought to answer the
following question:

1. Does the teacher have the right to refuse in rendering overtime service?
2. What can an employer do when teachers refuse to work overtime?
3. Does one’s failure to render overtime work despite the presence of a lawful
and valid order constitute willful disobedience?

Significance of the study

This study would be valuable to the teachers of Union Elementary School.

1. Teachers. The given data would guide the teachers on what is their rights
2. Department of Education. Like the teachers, the Department of Education too
will benefit hence, they will be guided as well about the rights of the teachers
to refuse in rendering overtime service, through the given data.

Scope and delimitations

This study was primarily designed to Address the Refusal to Render Overtime
Service of Union Elementary School Teachers in the municipality of Lingig, Surigao
del Sur. This research will confined within this current school year (2018-2019).

What is overtime service? Difference between over- hours and
overtime. ETH Zurich differentiates between “Over-hours” and “overtime”. Over-
hours are defined as hours worked on the order of the employee’s superior or head
that are in excess of the set weekly number of hours for full-time or part-time
employees, but do not exceed the legal maximum of 45 hours a week. Meanwhile
“overtime” is defined as time worked excess of the legal maximum working week of

Research Methodology

Research Design
This study seeks to collect and gather information based on systematic
production by addressing the Refusal to Render Overtime Service of Union
Elementary School Teachers. This study used descriptive research since the method
of collecting and describing the data are usually some categorical scheme also
known as descriptive categories. A survey is conducted by using a questionnaire and
observation instrument in collecting data that would be able to collect valid response
and fill into presenting results that could offer conclusion and recommendation for
the study.
Research locale
The study was conducted in Union Elementary School, Lingig Surigao del Sur
where the researcher is assigned. It is headed by their Principal I, Mrs. Carmelita B.
Losentes

Respondents of the Study


The respondents of the study was the teachers of Union Elementary School
in the municipality of Lingig, Surigao del Sur.

Research Instrument
The researcher used researcher made questionnaire containing the strategy
of gathering the profile of the respondents involved. A space that is provided for the
specified comments and suggestions of the respondents in relation to the study was
seen at the end of the table of in Part I. they were asked to affix their signatures to
the instrument to attest the reliability of the content of such feedback form.
Aside from using the checklist in gathering the needed data hence the study is
utilized descriptive research, the instrument used likert scale that contains
descriptive interpretation for the scaling presented as follows:
