The protection of such personal data is in sharp contrast to the practice in Indonesia.

In Indonesia, health record data can and has been used to discriminate against individuals living with
HIV. Some Indonesian companies choose not to employ people with these health conditions. This
happens, though, that people with HIV can live and work for "normal" life spans.

Another example of a privacy violation can be seen in the mobile phone user inbox in Indonesia. In
Indonesia, companies can easily send ads via SMS to millions of mobile phone users based on their
location.There are approximately 371.4 million phone users registered in Indonesia, exceeding the
total population of Indonesia. Advertising through these mobile phones may violate the privacy of
citizens because telecommunication service providers never ask permission to customers for their
willingness to provide their data to third parties.

Governments can also take advantage of personal data records and use the information in their
hands. Recently Indonesia has taken steps to centralize citizen data through electronic ID card (e-ID
card) or in Indonesia know as “e-KTP” by creating an electronic identification system. However, there
are no regulations governing the use of personal data of Indonesian citizens recorded on e-ID
cards(e-KTP).

Donny Budi Utoyo, Expert Staff at the Ministry of Communications and Informatics said that non-
governmental organizations and governments have tried to promote and encourage private data
protection laws. The efforts of the Institute for Community Studies & Advocacy, the Indonesian E-
Commerce Association and ICT Watch are seen.

Donny is also concerned about the loss of autonomous rights of patients with the increasing
digitization of health data records. In a public discussion, he asked whether Indonesian citizens have
the right to ask hospitals in Indonesia to move or remove their medical records if they are no longer
their patients.Donny also continued that the law for data protection of Indonesian citizens is still in
process because of the need for harmonization of other regulations of the relevant ministries.
