‘Who are you calling barbaric?!

In 2015, State X announces that it will organize a conference on the topic of Violence against
Women, to be held in X’ capital in February 2016. The international community’s response to
this announcement is far from enthusiastic, considering the fact that State X does not have a
great reputation when it comes to women’s rights. Nonetheless, many States and several
international organizations decide to send representatives to the conference, including the
United Nations (UN), which sends its Assistant Secretary-General for Human Rights, Mrs. A,
as its representative.

During the first conference day, Mrs. A gives a short speech and takes part in a panel
discussion, without any negative reactions. However, during a social event in the early
evening, Mrs. A is overheard making very negative statements about State X, calling its
treatment of women and women’s rights ‘barbaric and medieval’. State X, which is outraged
and beyond insulted, decides to take action by starting two lawsuits before X’ civil court: one
against Mrs. A, and one against the UN. Mrs. A and the UN both claim that State X’ civil
court lacks jurisdiction, State X claims this is not a problem.

Whose claims do you consider to be correct? Make sure to evaluate both lawsuits.
