Subcontractor Identification
‘ARCO Murray, the Design Build General Contractor, isto provide the BCIA with a list of trades and scope
sizes for the construction of TOPGOLE Birmingham. Along with a list of trades and scopes, ARCO Murray
is to provide a full set of Construction Drawings to the BCIA office along with a project schedule and
geotechnical report. Both digital and hard copies are to be provided.
Ms The BCIA shall provide a list of qualified MBE/OBE Subcontractors that would be able to perform.
any port ofthe scopes provided. The BCIA and ARCO Murray has mutually agreed to forego
hosting a"*Meet and Greet” event for all BIA subcontractors due to schedule considerations. BCIA
shall provide specific subcontractor recommendations in response tothe ist of trades and scope
sizes from ARCO Murray. ARCO Murray shall contact BCIA immediately should it experience any
difficulty in contacting the submitted list of contractors
‘ARCO Murray commits to including certified minority and disadvantaged businesses for this project
in good faith to the best oftheir abilities. Current certifications must be presented by the
perspective subcontractor prior to award of a project subcontract. Acceptable disadvantaged
business certifications include: BCIA, ALDOT, any federal agency certification, i.e. USDOT, FAA, EPA,
etc. Self-certification programs shall not be accepted for this project.
‘MBE/DBE Contractor Qualification
ARCO Murray will follow the schedule as presented as a part of this inclusion plan. At the
commencement of Project Bid Out, ARCO Murray is to reach out to the provided contac from the BCIA
‘to interview the subcontractors on qualifications for the Job. A summary is to be provided per the
‘attached form and presented as part of the Inclusion Reporting, ARCO Murray is to determine if the
rpvided subcontractors are available, willing and capable of performing the work.
‘After compiling a lst of qualified subcontractors, both MBE/DBE and non-MBE/OBE subcontractors,
ARCO Murray will enforce the signature of a Non-Disclosure Agreement (NDA) prior to obtaining digital
Construction Documents and Bid Instructions.
JV Following receipt of the signed NDA, ARCO Murray is to promptly send all appropriate bidding
documents to the subcontractors for review. There is to be ongoing dialog between the ARCO Murray
project manager and the subcontractors to help with scopeftarifications, requests for information and
‘any other necessary communication to provide a full bid, Zhe subcontractors will be required to provide
initial bids detailed 11/17/16 schedule below. A full set\éf Construction Documents has been provided to
the BCIA office to improve subcontractor accessibility. Each subcontractor will be provided with full time

‘MBE/DBE Contractor Bid Evaluation
ARCO Murray isto follow up with each individual subcontractor to confirm receipt of all the bid

After initial bids have been provided, ARCO Murray is to evaluate each subcontractors bid to ensure full
coverage and understanding of the scope of work has been provided. The ARCO Murray Project
‘Manager will follow up with phone calls to walk the subcontractor through the bid and bid analysis to
confirm coverage.

Often, given the complexity of the job, there are scope gaps in the original proposals. The ARCO Murray
Project manager isto inform the subcontractors of these gaps and allow time to revise for final bid per
the schedule detailed out below.
‘Subcontractor Awarding
‘A full bid analysis of final bids will be completed by ARCO. The bid summary form will be submitted as.
part of the Inclusion Plan.
Prior to notifying subcontractors of where their bid ranked against their competition, ARCO Murray is to
have a scheduled call with
ae! Bell of the BCIA to inform him of where each individual MBE/OBE
subcontractor ranked. At that time, the BCIA and ARCO Murray are to determine the resulting numeric
percentage of participation for the project.
‘ARCO Murray shall notify BCIA prior to any changes to the list of awarded MBE/DBE subcontractors for
the project. n the unforeseen event that 2 change must be made, every effort shall be made to find a
replacement MBE/OBE contractor, so as to not reduce the established project inclusion percentage.

The Developer is making an aggressive effort to encourage ARCO Murray to utilize the participation of
MBE/DBE firms as pert ofthe local Birmingham community. While TOPGOLF remains to be a nationally
recognized brand, they strive to embed themselves within the local community to help create jobs, both

will document our efforts to identity, evaluate, and solicit bids from all subcontractors provided by the
BCIA Its the goal of ARCO Murray to achieve or exceed local goals a established for this project by
Implementing this plan, by utilizing local resources, and by utilizing our expertise and experience in
constructing Top Golf facilities across the U.S.
MANAGING AND SUPERVISING CONTRACTOR'S WORK FORCE
In order to ensure the MBE/DBE firms are legitimate, ARCO Murray has the following policy in place to
screen and verify prospective subcontractors and suppliers:
The “sharing of employees” between ARCO Murray and subcontracted MBE/DBE companies is strictly
prohibited. in addition, employees who are or have been on the ARCO Murray payroll on the same
project that the MBE/DBE has been subcontracted to work cannot be hired as part of the inclusion
plan. Similarly, employees who are or have been subcontracted to provide labor for ARCO Murray
directly cannot be a part of the inclusion participation.
All work performed by the IMBE/DBE subcontractors must be scheduled and supervised at the project
site on a weekly basis by the MBE/DBE owner or with a full time, skilled, knowledgeable foreman,
superintendent or project manager who is employed by the MBE/DBE contractor.
Under no circumstances should ARCO Murray directly supervise the employees of the MBE/DBE
‘contractor. ARCO Murray's primary points of contact and communications with the MBE/DBE
contractor for job coordination and quality control must be made to the designated onsite
‘supervisor or project manager of the MBE/DBE contractor.
‘Management and Supervision:
‘The MBE/DBE must manage the work that has been contracted to its firm. Management includes, but is
not limited to:
‘+ Scheduling work operations
* Ordering equipment and materials
* Preparing and submitting payrolls
‘* Hiring and firing employees
