Subject : Notice under sub-section (1) and clause (B) of sub-section (2) of section (4) of the
public premises (eviction of unauthorized occupants) Act, 1971.

Sir,

Kindly refer to your show cause notice no. EC/108/DD/LIT/2019/T-7 dated 30.8.19
regarding alleged unauthorized occupation of public premises i.e. House no. 1 F, Type VII, Block 9,
Kidwai Nagar East, New Delhi. The date of hearing has been scheduled at 2.30 pm on 11.9.2019. I
am pained and shocked to read the contents of the show cause notice for alleged unauthorized
occupancy of residence. In this regard, I would like to submit my detailed submission for your kind
and sympathetic consideration.

1. As you may be aware, ASRB was established with the approval of the Cabinet on 1.10.1983 to
function as the recruitment agency of Indian Council of Agricultural Research, an autonomous body
under Department of Agricultural Research and Education. The Chairman and Members of the
Board were entilted to allotment of residence under General Pool Residential
Accomodation(GPRA) of the Estate office. Recently with a view to grant functional autonomy, the
Cabinet has approved the delinking of ASRB from ICAR and attached it with DARE under
Ministry of Agriculture and Farmers Welfare vide Notification No. 3158 dated 10.8.2018 issued by
DARE. In view of the notification of the DARE, the ASRB is an attached office of DARE, Ministry
of Agriculture and Farmers Welfare, Govt of India.

2. Consequent upon my appointment as chairman ASRB in April, 2019, the undersigned applied
for residential accomodation and my application was duly forwarded by DARE to Directorate of
Estates. The above mentioned residence at Kidwai Nagar was allotted on the basis of payment
normal license fee. But surprisingly, my allottment of residence was cancelled on the ground that
the office of ASRB, being an autonomous body is not an eligible office for allottment of GPRA at
Delhi vide letter dated 01/05/2019.

In response to cancellation letter dated 1.5.2019, the Secterary, DARE wrote a d.o. letter
03/05/2019 to Secretary, Ministry of Housing and Urban Affairs explaining the background of the
ASRB and to issue necessary instructions to the Dte. of Estates to review and withdraw the order of
cancellation of accomodation. In the meanwhile, DARE had also taken up the matter with the
Cabinet Secretariat seeking clarification about the status of ASRB after delinking from the ICAR.
Since, no reply was recieved from the Directorate of Estates, a reminder dated 4.6.2019 was sent
from the Secretary, DARE to the Secretary, Ministry of Housing and Urban Affairs reiterating the
request to review and withdraw the order of cancellation. In addition ,attention is also invited to a
letter dated 18/06/2019 from Deputy Sectretary to Assistant Director of Estates to allow retention of
accomodation allotted to the undersigned pending clarification from DOPT. But no reply from the
Directorate of Estates has been received till date.
 It is evident from the above mentioned facts that the undersigned had applied for the
accomodation as per the existing guidelines and the authorities of DARE have been regularily
requesting not to cancel the accomodation and withdraw the cancellation letter. But to my utter
surprise, show cause notice has been served for alleged unauthorized occupancy of the above
mentioned residence. It is also relevent to mention that the issue of status of the ASRB is between
the Estate office and the DARE. Since, the DARE has been intervening and requesting for retention
of accomodation pending clarification on the status of ASRB.

Sir, I feel that I have been harassed and humiliated on the grounds of status of ASRB which is not
under my purview. It is requested that the show cause notice may kindly be withdrawn and I may
kindly be allowed to retain the residence allotted at Kidwai Nagar on the usual payment of normal
license fee.
