PROCEDURE UNDER E-TENDERING

Sub: Independent Engineer Services during Operation & Maintenance period for 6 lane
section of Ahmedabad to Vadodara NH-48 from Km. 6.400 to Km. 108.700
(LengthKm102.300) in the state of Gujarat & Ahmedabad to Vadodara Expressway NE-01
from Km.0.000 to Km. 93.302 in the state of Gujarat (Length 93.302 km) under NHDP
Phase-V on DBFOT Toll Basis.

INSTRUCTIONS
DEFINITIONS:
a) National Informatics Center (NIC): Service provider to provide the e-Tendering
Software and facilitate the process of e-tendering on Application Service Provider
(ASP) model.
b) NHAI e-Procurement Portal: An e-tendering portal of National Highways authority
of India (“NHAI”) introduced for the process of e-tendering which can be accessed on
https://etenders.gov.in
(Note: RFP stands modified to the extent required as per these instructions)

1. ACCESSING/PURCHASING OF BID DOCUMENTS:


(i) It is mandatory for all the bidders to have class-III Digital Signature Certificate (With
Both DSC Components, i.e. Signing & Encryption in the name of authorized
Signatory (who will sign the Bid))from any of the licensed Certifying Agency
(Bidders can see the list of licensed CA’s from the link (www.cca.gov.in) to
Participate in e-tendering of NHAI.
(ii) National Informatics Center (NIC) Facilitates procurement of Class III DSC’s from
e-mudhra.
(iii) Detailed tender document can be viewed from e-tender portal of NHAI
www.nhai.gov.in or https://etenders.gov.in from 09.12.2019 to 15.01.2020 (11:00
hrs). Bid due date is 15.01.2020 (15:00 hrs)
(iv) To participate in the e-bid, it is mandatory for the Applicants to get themselves
registered with the NHAI e-Tendering Portal (https://etenders.gov.in) to have a user
ID & Password through online mode only.
(v) The tender can be viewed / downloaded from NHAI e-tendering portal free of cost till
11.00 Hrs, one day prior to the Bid due date.
(vi) To participate in bidding, Applicants have to pay a sum of Rs. 5,000/- ( five thousand
only) as a cost of the RFP (non-refundable) process to “National Highways
Authority of India in the form of demand draft.
(vii) The bidders will be allowed to download the bid documents upto 15.01.2020 (1100
hrs). The downloading facility of bids on e-Tendering portal will be made available
even if the day prior to the bid due date falls on Saturday/Sunday/Holiday. Thus, the
detailed tender document can be downloaded from e-tender portal of NHAI
www.nhai.gov.in from 09.12.2019 to 15.01.2020 upto 11:00 hrs. The bidders will
not be able to pay for the cost of bid document and tender processing fee after
15.01.2020 at 15:00 hrs and will be not be able to participate. Bidder having Class-III
Digital Signature certificate will only be able to participate.
(viii) If the Applicant has already registered with the National Informatics Center (NIC)
and validity of registration has not expired, then such Applicant does not require fresh
registration.

Following may be noted –


a) Applications can be submitted only during the validity of registration with the NHAI
e Tendering Portal being managed by National Informatics Center (NIC) i.e.
https://etenders.gov.in
b) The amendments/ clarifications to the tender, if any, will be posted on the NHAI
website (www.nhai.gov.in) and NHAI e Tendering Portal (https://etenders.gov.in).

2. PREPARATION & SUBMISSION OF APPLICATIONS :


(i) Detailed RFP may be downloaded from website (https://etenders.gov.in) and the
Application may be submitted online following the instructions appearing on the
screen. A Vendor manual containing the detailed guidelines for e-tendering system
is also available on e- portal.
(ii) The following documents shall be prepared and scanned in different files (in PDF or
ZIP Format such that file size is not more than 10 MB) and uploaded during the on-
line Submission of bid. Regarding submission of documents Circular
no.9.1.11/2019 dated 06/06/2019 will be followed.
a) Cost of tender document (non refundable) in favor of NHAI of Rs 5,000/- (
Five Thousand only) shall be paid through online mode only. Henceforth
there will be no need for physical submission of Demand Draft for the same.
b) Power of Attorney for signing of Bid in the format at Appendix-III;
“Digital Signature of both the person i.e Person granting Power of
Attorney and the personal holding Power of Attorney shall be treated as
valid and , the bid shall be considered as responsive. ”.
c) If applicable, the Power of Attorney for Lead Member of Consortium in the
format at Appendix-IV; and
d) An Undertaking from the person having PoA referred to in Sub. Cl. (d) above
that they agree and abide by the Bid documents uploaded by NHAI and
amendments uploaded, if any.
(iii) The bid (Price bid) should be submitted online only in the prescribed format given in
the website. No other mode of submission is accepted.
(iv) Appendix-1 of the Bid shall be digitally signed by the Authorized Signatory of the
bidder & submitted “on-line” only. No hard copy of Appendix-1 is required to be
submitted.
(v) It may be noted that scan copies can be prepared in different file format (PDF, ZIP).
(vi) It may also be noted that bidders can upload a single file of size of 10 MB only but
you can upload multiple files.
3. Modification / Substitution/ Withdrawal of bids:
(i) The Bidder may modify, substitute or withdraw its e-bid after submission. Prior
to the Bid Due Date. No Bid shall be modified, substituted or withdrawn by the
Bidder on or after the Bid Due Date.
(ii) Any alteration/ modification in the Bid or additional information supplied
subsequent to the Bid Due Date, unless the same has been expressly sought for
by the Authority, shall be disregarded.
(iii)For modification of e-bid, bidder has to detach its old bid from e-tendering
portal and upload / resubmit digitally signed modified bid.
(iv) For withdrawal of bid, bidder has to click on withdrawal icon at e-tendering
portal and can withdraw its e-bid.
(v) Before withdrawal of a bid, it may specifically be noted that after
withdrawal of a bid for any reason, bidder cannot re-submit e-bid again

4. OPENING AND EVALUATION OF APPLICATIONS:


(i) Opening and evaluation of bids (financial) will be done through online process.
(ii) The Authority shall open technical bids on 16.01.2020 at 15:30 hours in the presence
of the bidders who choose to attend. The Authority will subsequently examine and
evaluate the bids in accordance with the provisions set out.
(iii) Prior to evaluation of Bids, the Authority shall determine whether each Bid is
responsive to the requirements of this RFP.
(iv) Financial Bid of non-responsive bidders shall not be opened.
(v) The technical bid shall be opened of those bidders only who submit documents in
original as requested in bid document.
The bid submitted on-line shall not be opened and rejected, if it contains additional
Documents other than those mentioned above.
