Protecting nursing homes is our


number one priority.
Reinforcing New York State Nursing Homes
By law and regulation, nursing homes MUST:
1. Require PPE as well as temperature checks for staff
2. Isolate COVID residents in quarantine
3. Separate staff, transfer COVID residents within a facility, to another
long-term care facility, or to another non-certified location
4. Notify all residents and their family members within 24 hours if any
resident tests positive for COVID or any resident suffers a COVID
related death
5. Readmit COVID positive residents ONLY if they have the ability to
provide adequate level of care under DOH and CDC guidance
Reinforcing New York State Nursing Homes
The State Department of Health is partnering with
Attorney General Letitia James to investigate violations of
Executive Orders requiring communication with families
on COVID-19 test results and deaths.
Reinforcing New York State Nursing Homes
• Today, we are directing nursing homes to immediately report to
DOH actions that they have taken to comply with all DOH and
CDC directives.
• DOH will inspect the facilities that have not complied with the
DOH and CDC directives, including separation policies,
staffing policies, and inadequate PPE.
• If DOH determines that the facilities failed to comply with
directives and guidance, DOH will immediately require the
facility to submit an action plan, and facilities could be fined
$10,000 per violation or potentially lose their operating license.
