(Model Code of Conduct,2015)

I. Nature and Extent:

1. These Rules laid down shall be called West Bengal National University of Juridical
Sciences Model Code of Conduct.
2. These Rules are laid down to provide guidelines for conducting Student Juridical
Association elections.
3. The Rules will be applicable from the date, the call for applications are notified till the
time the result of the election, with respect to the concerned notice, is declared.

II. Permissible activities:

1. Candidates shall be permitted to make use of posters, printed pamphlets, or any other
printed material for the purpose of canvassing.
2. Candidates can only utilize hand-made posters at certain places in the campus, which
shall be notified in advance by the election commission /university authority.
3. During the election period the candidates may hold processions and / or public
meetings, provided that such processions and / or public meetings do not, in any
manner, disturb the classes and other academic and co curricular activities of the
college / university. Further, such procession /public meeting may not be held without
the prior written permission of the college / university authority.

III. Prohibited activities:

1. No candidate shall indulge in, nor shall abet, any activity, which may aggravate
existing differences or create mutual hatred or cause tension between different castes
and communities, religious or linguistic, or between any group(s) of students.
2. Criticism of other candidates, when made, shall be confined to their policies and
programs, past record and work. Candidates shall refrain from criticism of all aspects
of private life, not connected with the public activities of the other candidates or
supporters of such other candidates. Criticism of other candidates, or their supporters
based on unverified allegations or distortion shall be avoided.
3. No candidate shall be permitted to carry out processions, or public meetings, or in any
way canvass or distribute propaganda outside the university/college campus.
4. No candidate shall, nor shall his/her supporters, deface or cause any destruction to any
property of the university / college campus, for any purpose whatsoever, without the
prior written permission of the college /university authorities. All candidates shall be
held jointly and severally liable for any destruction / defacing of any university /
college property.
5. A candidate is specifically prohibited from involving any NUJS faculty or staff
member in the process of campaigning.
6. NUJS institutional email ids (of committees) or institutional resources must not be
used for campaigning purpose.

7. All candidates are strictly prohibited from holding public meetings 12 hours
immediately before the closing of the poll.
8. Candidates are not allowed to form groups near the polling booth on the day of
polling (Polling booth refers to any publicly accessible on-campus location designated
for the purpose of voting, which will be notified and announced by the EC in
advance).
9. Excepting the voters, no one without a valid pass from the Election Commission shall
enter the polling booths.
10. Candidates should ensure that their supporters do not create any tension or obstruction
in the process of campaigning of a fellow candidate.
11. A candidate is supposed to respect the privacy of the students of NUJS while
campaigning.

12. No printed/photocopied/hand written material of any sort is allowed to be distributed
by a candidate or his supporters, when the other candidates are addressing the general
body.
13. Use of muscle power, negative campaigning, and spreading false rumours, proposing
to offer any SJA nominated post in consideration of active support or campaign and
other similar unethical behaviour violating the rules of the institute or law of the land
would be considered as violation of fundamentals of campaigning.

IV. On the day of polling, student organizations and candidates shall –

1. Cooperate with the Election Commission to ensure peaceful and orderly polling and
complete freedom to the voters to exercise their franchise without being subjected to
any annoyance or obstruction is mandatory.
2. Not hand out any propaganda on the polling day.

V. Miscellaneous:

1. Every candidate shall notify his nominee to the EC at least three days prior to the day
of polling; and the nominee will be able to enter the polling booth premises to inspect
the polling process to ensure that it is conducted in a fair manner.
2. Any general body member (including a candidate) who notices any violation of the
Internal Code of Conduct by any EC member shall report the same immediately to the
Election Commissioner either in writing or in person. It is hereby assured that the
personal details of the complainant will not be revealed by the Election Commissioner
under any circumstances.

VI. Complains:

Any complaint that is based on the contravention on the above mentioned grounds will have
to be submitted to the election commission. The Election Commission will forward the
complaint to the faculty advisor. The penalty can range from a show cause to the cancellation
of an individual’s voting rights or the candidature. The faculty advisor has the final discretion

on the matter. An appeal from his decision will lie with the Vice Chancellor of the
University.

INTERNAL CODE OF CONDUCT, 2018


(FOR ELECTION COMMISSION MEMBERS ONLY)

The University Election Commission (hereinafter the EC) is an impartial and independent
body constituted to uphold the tradition of democratic decision making within the Student
body in the university. Since its inception, the office bearers of the EC have worked hard to
establish itself as a credible institution. To maintain its reputation and sanctity, it is
imperative that the members adhere to the core values of integrity, fairness and transparency
that the EC stands for, while discharging their duties. To ensure this, a resolution for an
internal code of conduct has been formulated. The proposed internal code mentions some
ethical rules to regulate the conduct of an EC member while he /she is discharging his/her
duties.

1. The EC members are required to report every instance of violation of the model code
of conduct, to the best of his/her knowledge, to all the members of the EC.

2. EC members are expected to maintain neutrality and are not permitted to display
support to any candidate contesting the elections.

3. On the date of polling, if any member of the EC comes to know the outcome of the
election prior to the official announcement of the same, he/she is not permitted to
convey the result prematurely to any member of the general body

4. The EC members are not allowed to accept or concede to any unlawful favor or
demands in either personal or public capacity till the results of elections are
announced, in the interest of the free and fair conduct of the elections.

5. The EC is a student body with limited strength but entrusted with a very serious
responsibility of conducting free and fair elections for the student body. Thus, non-
completion of any assigned electoral duty during the stipulated time by any EC
member is strongly discouraged.

6. Members are advised to state it beforehand whether they are speaking for the EC or
themselves under every situation where there is a possibility of their personal opinion
being misrepresented or passed off as opinion of the EC.

7. In case a candidate contesting election is related to or is on close terms with any of the
EC members, then that member is expected to consult the Election Commissioner
while taking decision with regard to that candidate. In case the EC member happens
to be the Election Commissioner himself, then he should consult the Co-
commissioner while taking decision.

8. The EC members are not permitted to accept any verbal request of any
voter/candidate and are permitted to take action only on written intimation through
letters or e-mails.

9. If any instance of violation of the code of conduct is found against any EC member, a
show-cause notice shall be issued to him/her and he/she may defend himself/herself in
a meeting attended by every member of EC.

10. In case the defence rendered by member accused of violating the code of conduct is
found unsatisfactory, then he/she could be removed from his/her post by a resolution
supported by two-third majority of the total strength of the EC, subject to approval of
the faculty advisor.

11. EC members are required to follow the model code of conduct strictly and take
decisions in accordance to it, regardless of his/her personal inclinations.
