Upon negotiation and verbal discussion, both the parties have hereby agreed to carry out

construction of water tank in Godrej Garden City of Nagarpalika on the terms and conditions.

1. The contractor hereby agreed to complete this contract of constructing water tank
includes all architectural elements at Rs. 6 Lac Crore. Any civil work in construction
and in infrastructure labor work will be executed by Parikh Construction co. and will
raise bill on item rate bases.
2. Parikh Construction Co. shall manage and supervise what so ever items introduce for
site Godrej Garden City from starting of project to completion of project.

d) Design Management
e) Planning for Execution
f) Site Administration and Management
g) Implementation and adherence of good construction practice
h) Quality control at site and communication management and reporting
i) Safety Management
j) Co-ordination with architect and all other consultant
k) Co-ordination and follow up with other contract agencies such as tiling, plumbing,
electrical etc. all agencies whichever require, till completion of project.
l) Material Inventory and storage in scientific manner
m) Advance material Requisition and re conciliation
n) Final Cost Report
o) Co-ordination of handover
4. The company will provide material such as cement, sand, block/bricks, chemicals. All
the necessary arrangement for execution of work will be done by the contractor.
Power and Water supply connection will be provided by the company at one point,
contractor has to arrange whatever extension required by his own.
5. Mode of measurement:-
The measurement of work will be taken by architectural drawing measurements. Top
and bottom slab of the tank will be considered as slab area. If any changes due to
revision of rates or changes done by company after completion of activity the changes
 will be considered extra on item rate bases. Any architectural elements in floors shall
not be considered extra. Contractor has to generate bill in two different heads, one is
for civil work of building and another for supervision.
6. Payment:-
 Payment will be made 15 days after submission of bill.
 Payment receipt of service shall be provided to the company.
7. Taxes:-
Rate finalized is excluding service tax
The contractor will have full and exclusive liability of payment of taxes, duties,
royalties, etc. whichever is imposed by the State Govt/Central Govt. on material to be
used by them.
The Company will deduct Income Tax from the bill as per Income Tax Act.
8. Time Limit:-
The said construction work is to be completed within the period of three years from
the date of the agreement.
9. Workmanship:-
The workmanship shall be of highest and finest quality.
10. Security Deposit:-
The company will deduct 5% of the amount of work done from the bill as security
deposit and the same will be refunded to the contractor after 6 month form the date of
satisfactory completion of the entire work of Water tank.
11. Insurance:-
The contractor has to submit a copy of insurance within 15 days from signing of this
agreement for the labours staff at his cost and renew it from time to time till the
completion of works under contract.
The contractor shall produce Workman Compensation Policy to the company within
15 days from signing up this agreement.
12. Defect Liability:-
It is the liability of the contractor to rectify and/or repairs of all faulty work at his risk
and cost during a period as mentioned in Clause 10 above. If the contractor fails to
comply with the instruction to rectify fault in his work, company will rectify the same
from another agency & deduct the expenses for the same from the amount of security
deposit.
 Condition of Contract
1. The contractor has to co-ordinate with other agencies, which are working
simultaneously at work site to complete the project.
2. The shultering material, whatever and whenever required will be provided by
contractor.
3. The contractor should bring all tools, tackles, vibrator machine, and other equipment
which is necessary to complete the work in all respect.
4. The contractor is responsible for lifting materials required for the tank.
5. It is contractor’s responsibility for line, levels, dimensions and alignments of the
works executed by him.
6. Contractor should use machine mix concrete for construction.
7. During progress of works, the contractor will remove the defective work and repair it
at his cost, when the instruction in writing will by issued by Quality Engineer of the
company.
8. The contractor shall handle all materials very carefully to minimize breakage and
wastage of material. Any breakage and wastage of material in excess, found by the
company, the same will be deducted from the amount of bills with due notice to the
contractor.
9. The water curing for all finished work will be carried out by contractor.
10. All projection coming out from the building shall have vatta at tops so that no dirt or
dust can stick over it.
11. The contractor will keep working place clean from time to time.
12. The contractor shall appoint qualified and experienced supervisors at site & they
should personally supervise the work daily. The representative of the contractor
should always be present at site to receive the instructions from the engineer in charge
of the company.
13. The Contractor shall make their own arrangement for string their tools and tackles and
for housing labors & supervisors. However space shall be provided in and around the
building.
14. The Contractor are free to raise their problems immediately to the company.
15. The Contractor should not misbehave with any staff member of company.
16. Contractor shall generate DPE (Daily Progress Report) and submit to company
representative daily.
 17. The contractor shall be solely responsible from theft, pilferage of the material which
has been handed over to him for completion of work, till the time of completion.
18. The contractor should strictly follow all safety norms on execution of any activity out
of site. Safety belts and helmets should be provided by the contractors to the labours.
Proper barication should be done around any cutouts.
19. The Company has full right to terminate this agreement if the contractor is not
performing their work up to the satisfaction of the company as per standard norms and
violation of any terms and conditions of this contract.
20. Any disputes arising out of or in way connected with this contract agreement will be
referred to a tribunal comprising of three arbitrators. Seat and venue of Arbitration is

21. Penalty
 Debit note will be issued if we find any wastage of material or damage to
property.
