enforcement officer personally came Howard A Saunders, who, being duly sworn deposes and says that
he/she has reason to believe and does believe that one Telvin Trishaun Smith, described as follows: Last
known address: 782 Shipwatch DR E, Jacksonville, FL 32225; Race: BLACK; Sex: MALE; DOB:
04/11/1991; Ht: 6' 04"; Wt: 215; Hair: BLACK; Eyes: BROWN; Scars, Marks: ; did in Duval County, Florida,
between August 31, 2019 and September 01, 2019, commit the below listed offense(s), contrary to the
provisions of Florida Statutes:
1) 794.05, UNLAWFUL SEXUAL ACTIVITY WITH CERTAIN MINORS; F2

Affiant's reasons for so believing are as follows:

Your affiant is a member of the Jacksonville Sheriff's Office and has been so employed for five (5)
years. Your affiant is currently assigned to the Special Assault Unit.

On November 12, 2019, Affiant interviewed, Vic Abuse Sex Off Victim who stated that she met
Telvin Smith Smith at her place of employment in the Vic Abuse Sex Off on August 27, 2019.
Victim and Smith took several photographs together. Affiant viewed these photographs and
confirmed that they show Victim and Smith together. During the meeting, Victim told Smith that she
was years old and had just celebrated her birthday. Additionally, Affiant spoke to a co-worker of
Victim at the Vic Abuse Sex Off , who witnessed the meeting between Victim and Smith. The co-worker
confirmed that it was made clear to Smith that Victim was under the age of 18.

After the initial meeting, Victim said that she and Smith had several communications on social media
and on the telephone. Victim agreed to meet Smith in person on the night of August 31, 2019. Victim
drove from her home and met Smith in the open parking lot of a shopping center located southwest
of the intersection of Beach Boulevard and Hodges Boulevard. Smith directed Victim to get inside his
vehicle, a black Cadillac Escalade, and he drove her to his residence located at 782 Shipwatch Drive
East, Jacksonville, Florida 32225.

At Smith s residence, Victim stated that Smith engaged in oral sex with her in the home-cinema of his
residence by placing his penis in Victim s mouth and by Smith placing his mouth on Victim s vagina.
Smith then carried Victim to a bedroom. Once in the bedroom, Smith engaged in penile-vaginal
intercourse with Victim. Victim stated that she and Smith then returned to the home-cinema room.
Smith again engaged in oral and penile-vaginal sex with Victim while in the home-cinema room.

Smith then drove Victim back to her vehicle, which had been left at the shopping center parking lot.
Smith then offered Victim $200 in U.S. currency. Victim declined to take the money. Smith then
pressured Victim to take the money and she ultimately agreed to take a $100 bill. Smith told Victim to
not tell anyone about this incident as he could go to jail. Smith told Victim that if anyone raised
concerns about them speaking, to say that Smith was serving as a mentor to her.

From the shopping center, Victim drove her vehicle home. While en route, Victim disclosed the
incident to a friend over the telephone. When Victim returned home, she disclosed the incident to a
family member. Victim said that she asked the family member about obtaining birth control.

Victim stated that the above-described activities occurred during the late evening hours of August
31, 2019 and into the early morning hours of September 1, 2019. Victim stated that the above
described sexual activity occurred in Smith s residence, located in Duval County. Victim reported
that Smith contacted her several days after they had sex at his residence.

At the time of the above-described sexual activity, Victim was years old and Smith was 28 years
old.

After the above-described incident, during the month of September, Smith contacted Victim and
asked her to meet at the Vic Abuse Sex Off Victim arrived at the mall and observed Smith driving his
black Cadillac Escalade. Victim got into Smith s vehicle. Smith drove the vehicle to a nearby parking
lot, in Clay County, where they engaged in oral and penile-vaginal sex in the black Cadillac Escalade.

On November 27, 2019, Affiant, along with other members of the Jacksonville Sheriff s Office,
executed a search warrant on Smith s residence. A black Cadillac Escalade that was registered to
Smith was seized as evidence and towed to the Jacksonville Sheriff s Office vehicle warehouse.

On December 19, 2019, Affiant, along with other members of the Jacksonville Sheriff s Office,
executed a search warrant on Smith s vehicle. During the execution of the search warrant, a swab
was collected from the third row of a black Cadillac Escalade that was registered to Smith and
located at the Smith s residence. This swab was processed for DNA and found to contain a female
DNA profile. This profile was compared against a buccal standard collected from Victim. Act

On February 20, 2020, Affiant spoke with a member of Victim s family about the investigation. The
family member advised that on September 1, 2019, Victim told her that she had sex with Smith. The
family member then took Victim to a Walgreens, located at Vic Abuse Sex Off
Florida 32073, to get Victim emergency contraception the same evening. The family member advised
that Victim gave her cash to purchase the contraception. Affiant confirmed that the Walgreens
conducted 2 transactions involving emergency contraception on the evening of September 1, 2019.
One of the transactions was in cash and was within the time-frame described by the family member.

On April 13, 2020, Affiant confirmed with Victim that Victim first disclosed the incident to the above-
mentioned family member on September 1, 2019. This family member took Victim to Walgreens to
purchase emergency contraception for her, and Victim stated the family member in fact purchased
the emergency contraception for her with the $100 bill that had been provided by Smith.

Additionally, Victim provided Affiant with voice memos that Smith sent to her via a text messaging
application. On the voice memos a male voice, which Victim confirms is Smith, can be heard calling
Victim baby requesting she spend the night, and on two separate recordings making kissing
noises. Additionally, Victim has provided Affiant with Smith s personal phone number, the address to
his residence, and a description of the vehicle used by Smith to transport her to and from his
residence. Affiant confirmed that the telephone number, address, and vehicle belonged to Smith.

For the above reasons, probable cause exists to believe that Smith engaged in the crime of Unlawful
Sexual Activity with Certain Minors by engaging in sexual intercourse with the Victim, Vic Abuse Sex Off
years old, while he, Smith was 28 years old.
