Alternate Dispute Resolution
Alternate Dispute Resolution typically denotes a wide range of dispute
resolution process and techniques that act as a means for disagreeing parties to
come to an agreement short of litigation. Alternate Dispute Resolution is also
increasingly being adopted as a tool to help settle disputes alongside the court
system itself.

Alternate Dispute Resolution is generally classified into four types:

 Negotiation
 Mediation
 Collaborative law
 Arbitration
 Conciliation

Negotiation

In Negotiation participation is voluntary and there is no third party who

facilitates the resolution process or imposes a resolution .

Mediation

In Mediation there is a third party mediator who facilitates the resolution

process but does not impose a resolution on the parties.

Collaborative law

In Collaborative law each party as an attorney who facilitates the resolution

process within specifically contracted terms. The parties reach an agreement
with the support of the attorneys and mutually agreed experts. No one
imposes a resolution on the parties.
Arbitration

In Arbitration participation is typically voluntary and there is a third party who

as a private judge imposes a resolution. Arbitration often occur because
parties to contract agree that any future dispute concerning the agreement
will be resolved by arbitration . This is known as Scott Avery Clause.

Conciliation

Conciliation is an alternative dispute resolution process whereby the parties to

be dispute use as conciliator who meet with the parties both separately and
together in an attempt to resolve their difference. They do this by lowering
tensions improving issues, encouraging parties to explore potential solutions
and assisting parties in finding a mutually acceptable outcome.
