lawyers, individuals and groups seeking redress etc) have access to up-to-date and nationally
relevant information on advocacy for the right to education.

CONCEPTUAL FRAME WORK-

1. Well established Case laws regarding RTE
2. Amendments made in Constitution regarding RTE
3. Enactment of Legislation
STATEMENT OF PROBLEM-
The act is a huge step to increase the level of education in our country. This is a not only a mile
stone but also gives the opportunity to the citizen of India where approximately 50 percent of
people are living under the poverty line Those are the people who are sustaining their living in
the viscious circle of poverty; trying there best to come out of that circle but failing every time,
education to there children is quite a dream. This will full fill the dream of thousands of poor
father & mother who once dreamt to get education in their childhood. Now they can give their
children elementary education This fundamental right certainly boost the future generation
country and indeed make the country democratic republic country after passing 64 years of
independence
RTE has been a part of the directive principles of the State Policy under Article 45 of the
Constitution, which is part of Chapter 4 of the Constitution. And rights in Chapter 4 are not
enforceable. For the first time in the history of India we have made this right enforceable by
putting it in Chapter 3 of the Constitution as Article 21A. This entitles children to have the right
to education enforced as a fundamental right.
