ON THE JOB- TRAINING (OJT)

TRAINING AGREEMENT
(Among Training Institution, Partner Establishment and Trainee)

This AGREEMENT duly entered into this ________________________ of

_________________ by among the following:

The Pepsi Cola Products Philippines Inc. with the Office address at Brgy. Sto. Niño,
Tanauan, Leyte hereinafter referred to as the FIRST PARTY:

The EASTERN VISAYAS STATE UNIVERSITY TANAUAN CAMPUS, TANAUAN,

LEYTE herein after referred to as the SECOND PARTY:

Mr/Ms. Fernariza O. Planco a Bachelor of Science in Accountancy student hereinafter referred to as

the THIRD PARTY and being a student represented by his parent Mrs. Marissa O. Planco
hereinafter referred to as the GUARDIAN.

WITHNESSETH: that the FIRST PARTY and the SECOND PARTY together with the
THIRD PARTY who is represented by his/her guardian do hereby agree and bind them as follows:

1. That the First Party and the Second Party shall coordinate their efforts to develop the skills,
knowledge and attitude of the Third Party through the Implementation of the Expanded on
the Job Training Program.
2. The First Party shall provide the Third Party the need of occupation related theoretical
instruction and practical or hands-on training program.
3. That the Second Party shall equip the Third Party the necessary theoretical training of the
dual program inside the work premises which shall not be less that 60 percent but both more
than 70 percent of the training duration.
4. That the Third Party agrees to cooperate with both the First and the Second Parties for the
purpose of acquiring and developing job qualification for his/her course.
5. That the Third Party agrees to attend diligently and faithfully In- Center and In-Plant portion
of the training during this period of the dual program and under the following terms and
conditions.

Training Duration : 300 Hours

Hours of Practical Instruction : 300 Hours
Date of Start of Training : ___________
Approximate Date of Completion : ___________

6. The Third Party shall attend In-Plant Training within the premises of the First party
equivalent to eight (8) hours per day. That in no case that the Third Party shall be required by
the First Party to report for training hours of 6:00 in the morning, since that trainees have to
study to maintain their scholarship. Overtime, may allowed provided the hours of overtime
rendered are duly credited towards hours of training with the effect of shortening period of
In-Plant Training.

 7. That the Third Party shall attend the related and practical instructions within the premises of
the Second party every Friday from 8:00-12:00 in the morning and from 1:00-5:00 in the
afternoon.

8. That a trainees Logbook/DTR shall be maintained by the Third Party wherein he/she will
record his/her daily attendance and accomplishment for the day during the In-Plant Training.

9. That the trainees are not allowed to use cellular phone while he/she on the hour of work.

10. That the Second party provide the Third Party with accident insurance the amount for which
included the fees paid during enrolment.

11. During the period of training, any party to this agreement may terminate said agreement by
serving a written notice to the two parties at least fifteen (15) working days before the actual
date of termination.

12. Any party to this agreement may terminate the same only for the valid causes mentioned in
the MOA Problems that occurred shall be investigated first by the coordinator and shall be
reported to the EVSU-TC BEM Department Head.

13. Upon satisfactory, completion of the expanded on the job-training by the Third Party, the
coordinator/ In-charge of the First Party shall issue the necessary Certificate of Training to
the Participants of the Expanded On-The-Job Training System.

14. Under the Memorandum of Agreement , the following terms and conditions are likewise
included:

1. This COMPANY/INDUSTRY is not obliged to pay the trainee additional

compensation of any kind and shall not enter into any kind of employer/employee
relationship with the trainees during the training. A special pay on the part of the
COMPANY/INDUSTRY is strictly voluntary.

2. The COMPANY/INDUSTRY reserves the right to discontinue the on the Job-

Training of the trainee on reasonable grounds upon written notice to the Job
Training Center. The discontinuation shall take effect immediately upon the
receipt of the said notice. The reasonable grounds that may terminate the trainee
are the following:

 Habitual of absenteeism during In-Plant and related instructions.

 Wilful disobedience of company rules or insubordination to lawful order
of a superior.
 Poor Physical condition, permanent disability or prolonged illness which
in capacities the trainees from working.
 Theft or malicious destruction of company property and/ or equipment.’
 Poor efficiency of performance on the In-Plant Training or in the center
training for a prolonged period despite warnings duly given to the
trainee: and
 Engaging in violence or other forms of gross misconduct inside the
company’s premises.

 3. The EVSU - Tanauan Campus may likewise, pull out any trainee from the On-
the-Job-Training on reasonable grounds after a written notice about such full out.
The written notice shall take immediate effect upon receipt of the said notice by
the COMPANY/INDUSTRY. The reasonable grounds that may terminate the
training program of the COMPANY/INDUSTRY are the following:

 Substandard or deleterious working conditions within the company’s

premises.
 Repeated violence by the company of the terms of the training agreement:
and
 Cruel or inhuman treatment by the company or his subordinates.
4. Any decision regarding behaviour and performance of the trainees shall be
forwarded EVSU-Tanauan Campus for due process on investigation.
5. During the affectivity of this agreement, it is understood that the trainees shall
follow all COMPANY/INDUSTRY rules and regulations, policies and procedure,
particularly those affecting the training activities, duly promulgated by the
COMPANY/INDUSTRY.
6. In case the trainee completes the full advanced In-Plant training program, the
COMPANY/INDUSTRY is not obliged to hire the trainee. However, the
COMPANY/INDUSTRY has the option to hire the trainees if it is so desires.
15. This Agreement shall take effect on this date the start of the training of the Third Party.

IN WITNESS WHEREOF, the parties have hereunto affixed their signature this

agree to undergo On-the-Job Training at Eastern Visayas State University-Tanauan Campus as
required by my course and promise in my volition to the following terms and conditions:

1. Follow strictly the policies, rules and regulations of the Cooperating Agency and of
the Eastern Visayas State University-Tanauan campus;
2. The cooperating agency and Eastern Visayas State University-Tanauan Campus
shall not be liable in case of any untoward incident that may occur during the course
of my training ;
3. The cooperating agency is not obligated to give any form of allowance in my favor
while undergoing the training and;
4. May or may not provide transportation expenses to and from my place of
assignment.
