LEAVE AND LICENSE AGREEMENT

This indenture of the leave and license is made and executed on this__28th June
2014 at Mumbai.

BETWEEN

Mr. SRINIVASAN KRISHNASWAMI PAN - AAHPS4215L


Age – 61 Years, Occupation - Retired

R/at – 5 Kambhoji Borla Uttam CHS , St Anthony’s Road, Chembur, Mumbai

Hereinafter called as OWNER or LICENSOR (Which expression shall be


unless repugnant to the context or meaning thereof shall deem to mean and
include his/her heirs, representatives, administrators, executors and assigns)
OF THE ONE PART.

Hereinafter called as LICENSEE, (Which expression shall be unless
repugnant to the context or meaning there of shall mean and include its
representatives, administrators, executors and assigns) OF THE ONE PART.

WHEREAS the party of the First part is the owner of the Residential
House at Plot No. 20C, 5, Vennila Veedhi, Thangam Nagar, Thanjavur,
Tamilnadu 613007 (here in after called as premises.)

AND WHEREAS the owner is residing elsewhere and at present does


not require the said premises except occasionally, hence the owner intended
to give a portion of the premises for a temporary period of 11 months on leave
and license basis and the said premises is the subject matter of the license
deed. Details of the portions of the house are to be found in the schedule.

AND WHEREAS the party of the other part required a temporary


accommodation for a period of 11 months on coming to know the above fact
the Licensee who was in need of temporary accommodation approached the
owner for the grant of license of the said premises and thereby offered an
amount of Rs.3000/-Per Month (Rupees Eight Thousand Only) for the first
6 months and an amount of Rs. 2500( Rupees Two thousand Five
Hundred Only) for the next 5 months towards license charges for the use of
said premises and owner has agreed to give a portion of the said premises to
the Licensee on leave and licensee basis for a period of 11 months i.e. 1st
July 2014 to 30th May 2015 on following terms and conditions. The above-
referred licensee fee amount payable in advance for each English Calendar
month on before 15th day of every month in Nominated Bank A/C.

The LICENSEE HEREBY COVENANTS WITH THE LICENSOR AS


FOLLOWS:

1. To use the said premises for residential purpose only for this
LICENSEE and not use the same for other purpose without prior
consent of the LICENSOR. The Licensees confirm that they will not
consume non-vegetarian food or alcohol within the premises and
also avoid smoking within the premises.

2. To pay Electricity, Internet, T.V ,Telephone rentals actually


consumed by the LICENSEE in accordance with the service
provider’s bills raised time to time.
3. To Maintain the said premises at all times in good order and
condition subject to reasonable wear and tear, damage to the
premises by earthquake, lightening, violence of mob or other
irresistible, inevitable force beyond the control of LICENSEE or
accidents expected.
4. To deliver the said premises to the LICENSOR on expiry of the
license or it’s earlier thereof in good condition.

5. Not to assign, sublet, transfer or otherwise part with the possession


of the demised premises or any portion to anybody without the
previous consent of the LICENSOR.

6. To permit at all reasonable hours during the daytime with previous


intimation by the LICENSOR or his authorized agent to enter into the
premises for viewing the condition of the said premises as also
residiing in a portion of the premises. Additionally it is also agreed by
the Licensee that a portion of the house consisting of two rooms in
the said premises is reserved for the Licensor or his authorized
agent for their stay whenever the Licensor or his agent wishes to. It
is also agreed that the kitchen and dining room are for common use
of all residents including the Licensor and/or his
agent/representatives.

7. To arrange and bear the cost of any electrical bill / water installation
which may go out of order by the LICENSEE during the period of
agreement.

8. The LICENSEE shall not affect any structural alteration to the said
premises without prior consent of the LICENSOR.

9. THE LICENSOR HEREBY CONVENTS WITH THE LICENSEE AS


FOLLOWS:-

10 To pay the municipal taxes, property and other statutory taxes


levied by the city / municipal Corporation, states or Central
Government on said premises from time to time whether past or
pending dues or during the period of the agreement. The
LICENSOR will also pay and bear all municipal charges, water
charges, sinking fund or any other dues whether past or pending
dues or during the period of the agreement. Any increase of taxes
or any other society charges, etc will be borne by the LICENSOR.

11 To pay and advance or such deposit as may be demanded by the


Electricity Board, Water Supply Authorities or any other statutory in
respect of the said premises from time to time.

12 On the condition that the LICENSEE continue to pay then license


fee hereby reserved and observe and perform the several
covenants on its part herein above contained the LICENSOR
hereby agrees for the LICENSEE PEACEFULLY AND QUIETLY
holding and enjoying the portion of the premises during the period
of license without any interruption or disturbance by the LICENSOR
or by other person lawfully claiming under or in trust for them.

IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:-

13 The license under this agreement shall be effective from 1st July
2014 notwithstanding the date of execution of the deed of the
license and the respective covenants herein set under shall be
operative and effective from 1st July 2014.
14 This Leave and License agreement may be terminated either by the
LICENSOR or the LICENSEE before the expiry of the periods
hereby agreed to by giving one Calendar months Notice.

15 After completion of 11 months there will be increase in rent as per


market and mutual understanding between LICENSOR and
LICENSEE and however not less than 10%.

16 Minimum Six months of stay is mandatory. Incase Licensee is


leaving before 6 months then he has to pay the rent for at least
three future months from the month of leaving.

17 On the expiration of the said term or period of license or earlier


termination of the licensed premises, The LICENSEE or his
employee remaining in occupation of the premises after such
termination will be deemed to be an act of trespass and the
LICENSEE will pay double the stipulated rent till the vacation of the
premises by the LICENSEE. It is further stipulated that the Licensor
is well within his rights to deny the Licensee entry or access to the
premises. In case of any repair / painting / damage to the floor or
the wall, fittings, fixtures, etc. at the time of surrender of the said
premises, the licensee has to get the same repaired to bring it to its
original condition at the licensee’s cost.

18 If any Licensee fee shall be in arrears more than two months and
also if the LICENSEE shall omit to perform or observe any
stipulation herein on its part, the Licensor may have the benefit
against the LICENSEE in respect of any antecedent breach of this
stipulation herein contained. In case the LICENSEE violates the
terms and conditions of the agreement the same will come to an
end with immediate effects.

19 Total occupants shall not exceed three (excluding the licensor and
his representatives). Adding new within the limit of three will be with
the consent of the Licensor.

20 The LICENSEE hereby admits or acknowledges that, it is the


express intention of the parties to this deed that the relationship of
landlord and tenant shall not be deemed to be created hereby or
otherwise between them under any circumstances what so ever.
The deed merely confirms bare permission or leave and license and
does not create easement or interest -- upon the Licensed premises
or any part thereof in favor of the LICENSEE. It is not intended by
this Deed to create any lease or sub-lease or any other right, title or
interest in to or upon the License premises in favor of the
LICENSEE and the LICENSEE shall not claim any right of tenancy,
sub-tenancy or any other right of any nature into or upon the
License premise or any portion thereof.

21 The Original copy of the Leave and License deed shall be retained
by the LICENSOR and the Photostat copy by the LICENSEE.

Common Use)

use by the Licensee)

In WITNESS WHERE OF the parties within named have executed,


signed and delivered the DEED OF LICENSE in token of
acceptance of the terms and condition hereof the day ,
